Board met in special session at 5: 00 P.M. All members present.
The Board discussed the matter of paving of Michigan Street with Mr. C. D.
E mmons Mgr. of the Chicago, South Bend & Northern Indiana, Ry._ Company., Mr. Emmons. informed
them, that, lkt would be the lst. of July before %is company could do_ &rW of their work on,
the above mentioned Street, as he could. not get shipment of steel before that date.
He also informed the Board that he thought his work could be taken care of -in sixty days after
that, as he intended to viork ahead of the contractor,

1_�P:IL AGREK4E_1 T, Made and entered into in the City of South Bend, St. Joseph
County' State of Indiana, by and between the City of South Bend, Indians-, by acid through
its Board of Public Works, party of the first part, and the Western Construction Company
a Corporation, party of the second part, WITNESSETH
That, whereas, on the 26th. day of January,l9169 the Board of Public Works
of said City adopted Declaratory Resolution No. 415 for the improvement of Michigan Street
from the North line of La Salle Avenue, to the south line of South Street, by grading and
paving the roadway of said street and the roadway of all intersecting streets and alleys,
allin accordance with and by virtue of an Act of the General..Assembl_y of the State of
Indiana, entitled * An Act Concerning Municipal Corporations," approved March 6th.19052
and all amendatory and suppRiemental acts thereto. And, whereas, the said Board of Public
Works thereafter designated sheet asphlat as the kind of material with which said street
was to be paved and improved; and
Whereas, the said Westeri Construction Company was the lowost and best
bidderi for the above meat io~red work;
THERE�DRE, it is hereby agreed that the said party of the second part shall
do and perform all the work in the prosceution of the above described improvement
according to the terms and conditions of said improvement resolution No. 415, and the
plans, profile and specifications on file in the office of the Board of Public Works of the
City of South Bend, Indiana, which resolution, profile, plans and specifications are made
parts of this contract as folly and effectually as if copied herein at full length,
and also do all said work in a good and workmanlike manner and under the direction and
control of the Civil Engineer of said City, and to the satisfaction and acceptance of the
Board of Public Works of said City.
It is agreed that the party of the second part shall not assign this con—
tract„ or sub —let the work or any part thereof to be done hereunder, without the written
consent of the said party of the first part first obtained.
Said party of the second part agrees to pay for all labor or materials
used in the construction of said pavement or in the performance of this contract, whether
done or furnished for the party of the second part, or its agent or any sub —contractor
and said party of the first part may reserve the right out of any allowance nade in any
estimate in favor of the said party of the second part, or out of the amount due said party
of the second part upon the completion of said work, so much as may, be necessary to pay
laborers or material men.for amounts due them for work done or materials furnished in the
performance of said contract and the construction of said work, and the City Treasurer of
said City may require said party of the second part to file receipts from such laborers and
material men for amounts so due them.

Said party of the second part agrees that in the prosecution of said
work- all proper skill and car a will be exercised;- that he will properly and fully
guard and protect all excavations, dangerous places* and will use a1.1 due and proper
precaution to prevent injury to any person or property, and will save and keep the
party of the first part harmless from any and all liability whatsoever growing out of
any injury or da.maga to persons or property because of any neglect or fault of said
party of the second part, its servants, agents, employees, assignees or sub -contractors
in the perfo nuance of this contract or in any matter connected With 'or, related,
thereto, and to pay any judgement with costs which maybbe obtained against se id City
growing out of any such injury or damage.
In consideration of the pre ices and. agreements herein made, to be
kept and performed by said party of the second part, said _party of the First part will
cause to be paid to said party of the second part, according to the law governing
such matters , the following prices o nd rates;
Gradir_g, I)e r cubic yard, fifty five cent e ($.55) ;
Extra concrete, six inches in thickness under street car ties per square yard, sixty
five cents ($.65) .
Storm grates, each, Three and 75/100 Dollars M.75)
Conduit pipe, lineal foot, fifty cents ($.50 )
Resetting inlet s-Annd- ms Wholes , each One and 50/100 Dollars ($1.50 )
Marginal curb, lineal f� got, twenty-five ( .25) cents.
Combined curb and gutter, lineal foot, fifty cents ($.50)
Stretcher block adjoining inside of streetcar rails, lineal foot,
thirty-eight cents (• 3$)
Trinidad. Lake Asphalt, square yard,, one and £11%100 Dollars ($1.51)
Metropolitan bricks on mortar cushion for pavement of space
occupied by street" railway, per=z 'r-e Tard', Two and' 40/100 Dollars ($2.40)
The pavement adjoining inside of rails of the street railway
shall be of such material as melf be agreed upon and directed by the Board of Public
Works, and the City Civil Engineer.
Said party of the second part agrees to remove all rubbish and
unused material left on the completion of the work from the street along the line of
said street. And it is agreed that all of said work shall be completed on or before
the lst. day of September 1916.
IN WITNESS WHEREOF, we, the foregoing named parties hale here
unto set their hands and seals in duplicate this 2$th. day of Ap ri1,1916.

KNOW ALL MEN BY THESE PRESENTS, That we the Western Construction
(/ Company as principal and Massachusetts Bonding & Insurance Company as sureties, of the
County of St. Joseph and State of Indiana, are held and bound by the City of South
Bends Indi a na g in the sum of THIRTY FIVE THOUSAND ($35, 000. 00) Do ila rs for the
payment of which, well and truly to be made, we jointly and severally bind ourselves
firmly by these presents.

The conditions ofthe abe.ve obligations are such that if the above bound Western
Construction Company shall faithfully comply with the attached eontraet(and the drawings and
specifications therein referred to( made and entered into this 25th. day of April,1916
with the City of South Berri, Indiana, for the const.ructon of a pavement on Michigan Street

from the oith line of La Salle Avenue to the south line Of South. Street, and fufill all the
conditions and stipulations, therein contained, according to the true intent nd meaning
thereof in all respects, then_ this obligation shell be void; otherwise to remain in f*ll
force and virtue in law; End in the event said City shall extend the time for the completion
of said work or alter said contract in any respect , such extension or alteration shall not
in any way operate to release the sureties on this Bond.
