to the Board, and they would submit the same` to the City Attorney.

Company, stating that he had no underground work to do on Michigan Street. Same was

Petition received for a Asphalt, Brick or Macadam pavement on East Howard

The undersigned, the Chicago, South Bend and. Northern Indiana
Railway Company, hereby notifies ,you that it elects to improve that portio=i of
Indiana Avenue from Marietta Street to Miami Street in the City of South Bend, being
part of the street described in Improvement Resolution No. 416 which is occupied by the
tracks of said Company, and that portio n thereof which said Company is bound by con—
tract with the said City to improvq. Such improvement will be made and constructed by
said Company in the following manners,
Metropolitan or other equally good paving brick, to be used,
with such detail as to laying of the same as shall be determined by the Bog rd of Pubic
Works and the City Engineer, such brick to be laid on tither sand cushion or cement
mortar cushion and to be underlaid by sie inches of concrete extending between the
ties and underneath the rail; all subject to the further detailed specifications which
may be supplied_ by the Cit y Engineer.
This notice and election is given and served under and in
accordance with the Law of 19099 as set forth in the Published Acts of the General
Assembly of the State of Indiana for the year 1909 at pages 412,417 et seg. same being
Section 9710 Buzns R.S. 1914, and other laws and parts thereof applicable thereto.
The undersigned further hereby req -ests your Honorable Body b
to include the paving and improvement above mentioned and described and the cost thereof
in the general contract let by your Board for the Improvement of said Indiana Avenue
under said Improvement Resolution No. 416.

The undersigned, the Chicago! South Bend and Northern `Indiana. Railway
Company, hereby notifies Stou that it elects to improve that portio n of Eddy Street from
Jefferson Blvd. to Sample Street,, and Mishawaka Avenue Prom Sample Street to Ninetenth
Street in the City of South Bend, being part of the streets described in Improvement
-
Resolution No. 417 which is occupied by the -tracks of said Company, and potion thereof
that
which said Company is bound by contract with the said City to imp rove. Such improvement
will be made and constructed by said Company in the following manner.

Pole and wire inspector reported on the following complaints and the
reports were approved by the Board.
Complaint of pole at rear of 112 W. South Street in way of garage .
This is a Home Tel. Company guy stub and tenants want to make a garage in rear of
part of the house now there. This pole iS not on the dividing line or property line
The pole must be moved in order to get into the garage.
Complaint .of pole owned by the A.T.&T. Company Standing in front of door
of new house at La Salle Avenue between St. Louis Blvd. and St. PAte r Street'.
Inspector reported that this pole should be placed to the east within 3 or 4 feet
,/ of the property line as thereis a young maple tree very near to the property line.
Complaint of Central Union Telphone Company pole in way of building
at rear of 1127 E. Cedar Street. Inspector reported that this pole is no standing
almost entirely on the property lineq Owners ground and the pole s hould be trenched
out into alley. Clerk instructed to notify comprinies of complaints.
Permission granted the Central Union Telephone. Co mpany to move one -
pole at the corner of Michigan Street and Broadway. Also Company to be notified to
that poles on cross streets should not set less than twenty feet from Michigan Street
when holding wires which cross Michigan Street.
The Board ordered that the City Contractor H . N. Barnes be notifed
to put in the following sidewalks and extnesions under Various Street contract.

LOCAL SEWER IMPROVERENT RESOLUTION NO. 436.-
�! RESOLVED By :thAe Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana' That the construction of a local sewer, intended and
adapted only for local ,use by the property holders whose property abuts thereon,
and not intended o r adapted for receiving sewerage from collateral drains, be and
the same is, hereby ordered 'in and along -Liston Street from Studebaker Street to a
point 70 --feet -rest or, the west line of Walnut Street as follows,to-wit Beginning
at the intersection of the canter line of Studebaker Street and Liston Street; thence
east along the center line of Liston Street to a point_ 70 feet west of the crest line
of Walnut Street vdth s 12 inch vitrified pipe sewer. Together with the necessary
manholes, inlets , conduits and house connections to the curb line along the line
Of said improvement. All as shovm on the plans and in accordance with the profile
detail drawings and specifications on file in the Office of the Department of Public
Works of tip City of South Bend, Indianap and said sewer, with all its appurte-mnces
shall be constructed in accordance with the profile and specifications now on file
In the office of the Department of Public Works of said City. The cost of said
Improvement shall be apportioned against and paid by the property holders whose pro-

Be It Resolved by the Board of Public Works of the City of South Bend'
St. Joseph County, State of Indiana, that it is desired and deeme necessary to improve
the second alley West of Elm Street from Washington Avenue to Colfax Avenue as follows,

By grading and paving the roadway, also by grading and paving the roadways
of all intersecting and entering streets and alleys lying within the property lines of said
Second alley west of Elm Street not included in the roadway; by paving said roadways with
either gravel or cinders six(6) Anches in depth, by placing the necessary marginal cement
curb; by placing all manholes and inlets to the proper grade; and the construction of the
necessary storm water inlets and conduits; all as shown on the plans and in accordance with
the profiles detail drawings and specifications on file in the office of the Department of
Public Woks of the City of South Bend, Indiana.
The cost of the improvement herein provided for, except street and alley
intersections, shall be paid by special assessment to be levied upon the property specially
benefitted, to the amount that the same may be legally assessed therefor, in accordance with
An Act of the Genera? Assembly of the State of Indiana, entitled "A-n Act Concerning Municipal
Corporations,°1 approved March 6,1905, And in accordance vjith and pursuant to the provisions
of all amendatory and supplemental the rent .
The cost of all street and alley intersections, including one—half of the
width of the improvement opposite street and alleys which run into, but do.not cross said road—
way herein proposed to be improved and that portion of' such street or alley abutting upon
property belonging to. said City, or upon said property not subject to such assessments shall
be paid by the City in cash out of its general funds if able to do s0, or from a fund created
by a special assessment to be levied under the provisions of Section 108 of the above entitled
Act*
Assessments, of ten dollars and more against each lots if deferred, are to
be paid in ten equal annual installments with intevest at the rate of Six per cent per anmum.
A bond or bonds will be issued to the contractor to the amount of such deferred assessments
in p=-o rata payment for such improvement.
Under no circumstances shall the City of South Be ,d be or be held respons-
ible for arT sum or sums due from said property owner or owners for said work, or for the
collection of the same, or for the payment of any bond, bonds,, certificate or certificates
issued to said contractor in payment for such work, except for such :Honeys as shall have
actually been received by theCity fro the assessments for such improvement, or such moneys
as said City is by said entitled Act and amendments and supplements thereto required to pay.

Be It Further Resolved, That the Board of Public Works fix the 23rd. day of
May 1916 at the hour of 7 :45 P.M. at the office of the Board of Public Works, of this Citys
as the time and place for thepublic consideration of said proposed improvement, at which
said Board of Public Works, will hear all persons interested, or whose propertyis liable
to be asse sed for said improvement, and will decide whether the benefits to the property
liable to be assessed for said improvement will equal the estimated cost thereof.
Be It Further Resolved, That notice of the time and place of such public
consideration be published and mailed in the manner provided !,by law. Notice of this resolution
shall be publi hed on the 27th. day of April,1916 and on the 4th. day of May 1916. in the South
Bend Daily Tribune.

RESOLUTION OF THE BmARD OF PUBLIC 'CORKS No. 441,
On Motion duly made and seconded., the following preamble and resolutions
were unanimously adopted:—
WHEREAS, This Board did on the l9th. day of April 1916 deem it expedient
and of public utility to permamently improve Jacquith Court fry, Chapin Street to PrairiE.
Avenue by paving the roadway, of the same, end did on said date pass and adopt a rwsolut ion
authorizing said Permanent improvement, and,
WHEREAS, The City Engineer h s prepared and filed with this Board a report
showing the number and location, as well F-s.the materiel to be used and the manner of laying
the same, of the service pipe s mains, conduits, laterals and connections which are, or will
be, necessary to accommodate the abutting property owners with gas, water, heat, steam or
any other product for which any person, firm or eorporation has been granted a franchise
for supplying the citizens of the City of South Bend, Indiana, which report on file- -
In the Office of the Board.
BE IT RESOLVED, That said report of said City Engineer be and is hereby
adopted. And be it further Resolved, That it is contemplated by this Board to improve
Jacquith Court from Chapin Street to Prairie Avenue, all in said City of South Bend, by tree
co istruction of a pavement, and that it is, and is hereby so declaredl necessary for the
Northern Indiana Gas & Electric Company, which has, and operates under, a franchise from si
said City to supply gas to the Citizens of said City, to provide and install manins,
laterals , service pipes and connections for ga -s in said part of said street, of the
description, location and number set forth in said report of said City Engineer, which
mains, service pipes and connections are hereby declared necessary for the immediate use
of said Company in supplying gas tonthe owners of property abtting upon said part of said
street.

Upon said bearing no remonstrators app ea red and no remonstrances were filed,
And .the Board being fully advised in the premises, decides that the benefits to pro-
perty liable to be assessed for said improvement are equal to the estimated cost of the
same,<.s reported by the City Civil Engineer, and thereupon takes final action on said
resolution as originally adopted, and tine same is hereby in all things ratified,
confirmed and approved.,
Resolved further, that notices be published on the 26th. day of Apri1,1916
and on the 3rd. day. of Mpy 1916 in a newspaper of general circulation in said City, stat-
ing that this Board will receive bid, for the construction of said improvements up
to 10:00 A.M. on the 16th. day of May 1916. The Board reserves the right to reject
any and a 11 bids.

action on said resolution as originally adopted, and the same is hereby in all things

Resolved further, that notices be published on the 26th. (lay of April.
1916 and on the 3rd. day of May 1916 in a newspaper of ._general circulation in said City,
stating that this Bard will :receive bids for the construction of said -improvements, up
to 10:00 A.M. on the 16th. day of May 1916. The Board reserves the right to re je et
any and all bids.

The conditions of the above obligations are such that if the above bound
W.B.Brady Construction Company, a, corporation shall faithfully comply with the attached
contract and the drawings and specifications therein referred to( made and entered into this
25th. day of April 1916 with the City of South Bend , Indian, for the pavement of Indiana
Avenue from Leer Street to Kemble Avenue and fufill all the conditions and stipulations
therein eontai•.ed, according to the true intent and meaning thereof in all respects, then

by and through its Board of Public Works, party of the first part , and the W. B. Brady
Construction Company, a corporation of Chicago, Illinois, party of hhe second part,
VITNES.SETH: -
Thats whereas,, on the 25th. day of January 19161, the Board of Public
Works of said City adopted Declaratory Resolution No. 416 for the improvement of
Indiana. Avenue, from Leer Street to Kemble Avenue, by grading and paving the roadway
of said street and the roadway of all intersecting streets and allrys, all in accord—
ance with and by virture of an Act of the General Assembly of the State of Indians
entitled " An Act Concerning Municipal Corporations, approved March 6th.919051, and
all amendatory and supplemental acts thereto. And, whereas, the said Board of Public
'Forks hereafter designated asphaltic concrete as the kind of material with which said
street was to be paved and improved; and
Whereas, the said party of the second part was then lowest and best
bidder for the above m ntioned work;
THEREFORE, it is hereby agreed that the said party of the second
part shall do a d perforimall the work in the prosecution of the above described
Improvement according to the terms and conditions of said improvement Resolution No.
416, and the plans, profiles and specifications on file in the office of the Beard of
Public Works of the City of South Bend , , Indians., which resolution,, profiles plans and.
specifications are made parts of this contract as fully and effectually as is copied
herein at full length, and also do all said work in a good and workmanlike manner and
under the direction and control of the Civil Engineerof said Ciy, and to the satifac—
tion and acceptance of the Board of Public Works of said City.
It is agreed that the party of the second part shall not assign
this contract, or sublet the work or any part thereof, to be done hereunder, without -
the written consent of the said party of the first part first obtained.
Sadd party of the second part agrees to pay all labor or materials
used in the construction of said pavement or in the performance of this contract, whethe
done or furnished for the party of the second part, or its agent or any sub —contractor
and said party of the first part may reserve out of any allowance made on any esti—
mate in favor of the said party of the second part, or out of the amount due said party
of the second part upo the completion of said work, so much as may be' necessary t io
pay all laborers or material men for amounts due them for work done or materials
furnished in the perfo_►miance of said contract and tie construction of said work; the
City treasurer of said city may require to said party of the second part to file
receipts from such laborers and materials men for amounts so due them.
Said party of the second part agrees that in the prosecution of
said work all proper skill a d care will be egerised; the t he will properly and
fully,quard and protect all excavations, dangerous places, and will use all due
and proper precaution to prevent injury to any person or property, and will save- and
keep the party of the first part harmless from any and alli liability whatsoever
growing out o� any. injury or damage to persons or property because of any neglect
or fault of said party of the second part, its servants, agents, employees, assigns
or sub —contractors, in the performance of this contract or in any matter connected with
or related thereto, and to pay any judgement with costs which may be obtained against
said City growing out of any such injury or damage.
In consideration of the promises and agreements herein
made, to be kept and performed by s:_ id party of the second part, s id party of ttie first
part will cause to be paid to said party of the second part, according to the law
governing such matters, the following prices and rates:—

by Street railway, per square yard, Two and 20/100 Dollars ($2. 20 )
The paveme rat ad joining; inside of rails of the street railway shall be
of :,uch material as' may be agreed upon and directed by the Board of Public Works, and the
City Civil Engineelr.
Said party of the second part agrees to remove all rubbish and unused mateer-
ia.l left on the completion of the work from the street along the line of said street.' And
it is agreed that all of said work shall be c ompleted on or before the 1st. day of August,
