Bids were received,` opened quid read for the construction of pavement on
`Michigan Street From the northerly line of La Salle Avenue to the south line of South
Street, under Improvement Resolution No. 415. The same were referred to the City
Civil Engineer for tabulation to be reported on if ;ready at 7:45 P.M. this 4th. day of
April 1916 at regulat session of the Board.
Bids were received, opened and read for construction of pavement on
Indians. Avenue from Leer Street to Kemble Avenue, under Improvement Resolution No. 416
The same were referred to the City Civil Engineer for tabulation to be reported on at
regular session of the Board ati7:45 P.M. this 4th. day of April 1916.
Bids were received opened and read for pipe sewer on Hoose Court from
Chapin Street to 100 feet west of tkie west line of Scott Street, under Improvement
Resolution No, 415. The same wwre referred to the City Civil Engineer for tabulation to
be' reported on at regular session of the Board to be held at 7:45 P.M. this 4th. day of
Apri1,1916.
Atty. L. J. Meyers, Attorney for the Chicago, LF:.ke Shore and South
Bend Railway Company appeared before the Board in regard to their company placing s
fre*ght house on property at the Corner of La Salle Avenue and La Porte Avenue. The some
was taken under consideration by the Board.
Clerk was instructed to notify Mr. Eli. Seebirt, City Attorney to
draw up and present Ordinances for the salaries of the Assistant Building Commissioner
and Assistant City Electrician.
The following petitions were presented to the Board and referred to
the City Engineer for investigation.
Concrete pavement curb and walk on Bridge'Street from Colfax Avenue
to La Salle Avenue.
Pipe sewer on High Street from Indians. Avenue to Broadway.
Pipe sewer on Haney Avenue from Michigan Street to High Street.
y Pipe sewer on Marietta Street from Dubsit Avenue to Souttb z - . A
Establishment of a grade on 2nd. alley west of Vistula Avenue and
Dale Avenue south of Indiana Avenue.
Petition for an electric light at ,the corner of Miami Street and
`Fox Street. The same placed on file until investigated by the Board.
The following petitions filed sometime ago for pavements were
continued on account of lack of funds for the City!s share of 'pavement.
Asphalt pavement on East Broadway from So. Carroll Street to High St.
Pavement on Liston Street from Birdsell Street to Adams Street.
Pavement on St. Louis St. from Jefferson Blvd. to Division Street.
Billboard bond for the stun of $1.000.00 signed by W. E. Bryan
vas principal and The Aetna Accident & Liability Co. as sureties was approved by the
Board.
Wm. H. Ryan, of Lansing, Michigan contractor bidding on Indiana Ave.
and. Michigan Street Paving improvement, appeared before the Board after bids were opened
and requested that he be given permission to withdraw bids and certified checks in the
amounts of $2.100.00 on Michigan St. and $1.74OwOO on Indiana Avenue. The Board granted
the same.

STREET OR A_ LEY IMPROVEMENT RESOLUTION NO, 427.
Be It Resolved' by the Board of Public Works of the .City of South Bend, St.
Joseph County, State of Indiana, that it is desired and deemed necessary to improve
Logan Street from Scott St r(-et to Leland Avenue as f ollows,to-wit : •-
By grading said street
from property line to property line; by,paving the roadway from curb line to curb line
with gravel three (3) inches in depth;.by curbing the roa.dwa,y with cement curb and
by c onst ru-ct ng _cement° walk three and one-half (3-1/2) feet wide on both sides of said
street. All as s own on the. pl ns and in acco`rda--ice with the profiles,, detail draw—
ings and specifications on file in the Office of the Department of Public Works of the
City of South Bend, Indiana.
The cost of the improvement herein provided for, except street and alley
intersections., shall be paid by specis;l assessor nt` to be levied upon the property spe6i—
ally benefitted, to the amount that the same may be legally assessed therefor, in
accordance with an Act of the Generale`Assembly of the State of Indiana, entitled "An
Act Concerning Municipal Corporations," approved March 6„1905, and in accordance with
and pursuantto the provisions of all acts amendatory and supplemental thereto.
The cost of -all street .end alley intersections, including one-half of the
the width of .the improvement opposite street and alleys which run into, but do not
cross said roadways herein proposed to be improved and that portion of such street or ,
alley abutting upon property belonging to said City, or upon "property not subject to
such assessment-, shall be paid- by the City in cash out of its general fund, if able to
do so, or `from -a fund created byy special assessment to be levied under the pro--
visions of Section 109 of the above entitled Act.
Assessments of ten -dollars and more against each lot, if deferred, are o
t-o be paid in ten equal annual installments, with interest at the rate of Six per cent
per annum. A bond or bonds will be issued to the contrsetor to the amount of such
deferred asssessments in pro rata payment for such improvement.
Under no circumstances shall. the City of South -Bend be, or be held,
responsible for arty sum or sums due from- said property oviner or o,lners for sdid work, or
for the collectio n of the same, or for the payment of any bond, bonds, certificate or
certificates, issued to said contractor in payment for such work, except for such
moneys as -said City is by said entitled Act and tmendments and supplements thereto
.required to pay. All proceedings had, and work dnae in the making of said improvement,
assessment of property, collection of assessments and i suance of bonds therefor, shall
be as provided for in said above entitled Act, and Acts amendatory thereof and supple—
mental thereto.
Be, It Further resolved, that the Board of Public works fix the 2nd. d.c.y
of May 1916 at the hour of 7;45 P.M. at the office of the Board of Public Works$ of this
City, as the time arid place for the public consideration of said proposed improvement,
at trhich said Board of Public Works will hear all per ons interested, or whose property
is liable to be assessed for said improvement, and will decide whether the benefits to tOL
the property liable to be assessed for said improvement will equal the estimated cost
thereof.
Be It further resolved, That notice of the time and place of such
ptblie consideration be published and mailed in the manner provided by law. Notice of
this resolution shall be published on the 7th. day of April 1916 and on the 14th. day of
April 1916 in the South Bend Daily Tribune.

SIDEWALK IMPROVEMENT RESOLUTION NO. 42-90
Resolved by the Board, of Public Works of the -City of South Bend, St. Joseph
County, State of Indiana, That it is deemed necessary to improve the south side of Ewing
Avenue from Michigan Street to St. Joseph Street as followsrto-wit:-
By constructing cement
curb and cement walk. on the south side of said Ewing Avenue. All as shown on the plans and
In accordance with the plans, detail drawings and sp eci t'ications on °file in the office of the
Department of Public Works of the Ci;-y of South Bend, IndIamp in accordance '�Ath the
prof ile, details, drawings -and speci ication on file in the Office' of the Department of the
Board of Public Works of said City; and such improvement is now ordered.
The cost of said improvement, including the cost of street and alley inters -
sections, shall be assessed upon the real estate abutting on said Ewing Avenue all accord-
ing, to the method and manner provided for in an Act/ of the General Assembly of the State
of Indiana; entitled M An Act Concerning Municipal Corporations,* approved Burch 6,1905,
and in accordance with trod pursuant to the provisions of all emendatory and supplemental
acts thereto, passed •by the General Assembly of the* State of Indiana. Assessments, if
deferred, are to be,paid in ten equal annual installments, with _interest at the rate of
Six per cent per annum. A bond or bonds shall` be issued -to the contractor in payment
of such work, unless the property owners pay said assessment before said bond. or bonds are
issued. Under no circumstances shall the City of South Bend, be, or be held responsible
for ary sun or sums due from s!.id property owner or owners for s#id work or for the
collection of the same, or for the payment of any bond* bonds, certificate or certificates
issued to said contractor in payment .for such work, except for such moneys as shall have
been actually received by the City from the assessments for such improvement, or such

Remonstrance was presented signed by .fifty property owners , remonstrating
against the Board permitting said Chicago, Lc-.ke Shore and South Bend Railroad Comps: ray
to use said Company's property, located between La: Porte Avenue and Colfax Avenue
as a freight yard.nd placing freight depot and %ruling freight trafts through the
City to La Salle Avenue. The same was reed and ply, ced on file.
A Committee of rive business men, represented by Mr. Brandon as President
appeared before the Board from the Cho -tuber of Corrnneroe in to hRvlag down-
to-bYn ;streets sprinkled or flushed at night so as to settle the dust$ as they stated
it was a detriment to their business. The Board took the above matter under advise-
ment
Mr. McNabb and Mr. Cook representing the Plumbers Assoc. appeared before
.� the Board requesting that a licensed plumber be employed by the City.
Hearing had on Improvement Resolution No. 4A for the pipe sewer on
Indiana Avenue from Prairie Avenue to a point 100 feet west of the west line of
Kembl:_ Avenue. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrance was
filed. The Board after due consideration decided to defer all action on said Improve-
ment until Tuesday April 19th.,1916. at 7:45 P.M.

from Tecumseh Avenue to right of way of the Michigan Central Ry. Company,under

The Board after due consideration decided that said improvement be defer
deferred until Tuesday April llth. ,1916. at 7:45 P.M.

Councilman, Seifert appeared beffdre the Board in regard to having
South St. Louis Street :'rom Jefferson Blvd. to Division Street, taking care of,
starting the same needed pavement. The same wqs taken under consideration.
Contra at for the p-pe sewer on Hoose Court from Chapin Street to
100 feet west of the west line of Scott Street, was awarded to L. H. Webster,

In regard to making a preliminary order desikneting the kind of pavement
on ichi An Street from North line of La Sa i.le Avenue to South line of South Street, and
on Indiana: Avenue from Leer Street to Kemble Avenue, the City Civil Engineer being unable to
report on said tabulation of bids at this time, it was decided by the Board that the time
for making saidpreliminery order designating rind of paverients on the above mentioned streets
be deferred until Friday April 7th.,1916 at 4.30 P.M.
Deferred hearing on assessment roll of awards of damages and assessments of bene-
fits in the matter of widening of Webster street and Indiana Avenue, Under Zondernnation Res.
No. 39, In the City of South Bend,. Indiana.
In the Pbove matter no remonstrators appeared and no .further remonstrances
were filed. The Board decided that roll for the widening of Indiana Avenue a1 Webbter
Street under Condemnation Res. No. 39 is modified as follows. Tots 74,75976977s7 ,79,54,
