Bids were received, opened and read for pavement on Keasey Street from Michigan Street to Carroll Street. The same were referred to the City Engineer for tabulation to be reported on at 7:45 P.M. this 29the day of Larch 1916. Bids were receivedv opened and read for curb and walk on various Street sin the City. The same were referred to the City Engineerfor tabulation to be reported on at 7:45 P.M. this 29th. day of March 1916. Mayor Keller and Tyr. U. G. Marming, CiJry Controller appeared before the J Board and discussed the cost of the intersections on the streets to be improved. The Clerk of the Board w<: s instructed to bvdee' 100-40 Watt Electric bulbs -for the City Hall. Petition for grade, curb and v,lk on Logan Street from Scott Street to Leland Avenue and three inches of gravel pavement W s presented to the Board, u, nd the d same was referred to the City Engineer for a resolution. Petition for the establishing of a grade in alley north of Madison Street ✓ from Main Street to Lafayette Blvd. was ordered. Communication received, read = nd placed on file from A. B. Thielens in regard to a, Street flusher and the present condition of. various streets. The same was read and placed on file. Bond signed bynLoren H. Vander Kerr and signed by Guy Staples and Walter Hildebrand as surelies was approved by the Boards, and the following contract was approved. CONTRACT. Ss.id party of the first part agrees- to use first class material in doing said work , and he further agrees to place barri— cades add red lights at the places where said repair work is being done by Itim, in such manner as to protect all persons, in using said street, from injury. In consideration of the performance of said work by the party of the first part, the said party of the second part agrees to pay him therefor the sum of Two ($2.00)Dollars per square yard for all —re —surfacing and repair work, except where the grouting or foundation concrete is broken through or is in such condition that it cannot be used, in which instance the party of the first part shall receive two and 35-100 (2.35) Dollars per square yard . S id sums are to be paid after said mrk has been inspected and approved by the Street Commissioner of said City, or by the City Civil Engineer. The party of the first part further agrees that he will do all s---id work in a good workmanlike manner, find that he hereby guarantees all of said repair work tob be and remain in good condition for a period of one year from the time such repair wok work is dne; and if during said year said repair work is done should become de— fective, the party of the first part agrees to replace the same with good material, or upon failure to do so, to refund to said City the amount received by him for such repairing. rim And said party of the first part further agrees to indemnid[y and save harmless the said party of the second part from all damages to any person or property by reason of the negligent performance of said wor-K by the party of the first part. And said party- of the first part further agrees that after repairing any place in any of the streets of said City, he will immediately thereafter remove 11 dirt and refuse to the curb of s..id street. The said party of the first part grees to do and execute the said work at times and places as designated by the Street Commiss#oner of said City, and under his dieetion. And if he should fail Ind refuse to do the same, as by the terms of this m ntraet required, then said party of the second part may at its option terminate this agreement. And if said party of the First part should fail to perform this agreement or any of its terms and conditions, or if he shall fail to do any work within 15 days after he is directed to do so then he agrees to pay said party of the second part the sum of Fifty Dollars $50.00 as liquidated d.mages for such failure, and sai, party of the second part may retain said sum out of any money due said party of the first part, said sum to be paid to said first party upon the completion of thework to be done under this contract. And in addition to said sum above referred to, the said party of the first part further agrees to give a bond with a good and suf scent surety thereon to be apgooved by the Board of Public Works of said City for the faithfull- performance of this contract. ResOlved by the Bard of Plablic Works of the City of South Bend, County of St. Joseph, State of Indiana, That thel.construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and. not intend d or adapted for receiving sewerage from collateral drains, .be and the same is hereby ordered in and along Prances Street from South Bend Avenue to a point 100 feet slort h of the north line of Sorin Street, as follows, t o—wot :®Beginning at the center line of South Bend Avenue and Prances Street; thence South along the center line of Frances Street to the center of Campeau Street with a 15 inch vitrified pipe serer; thence still south along the center line of sid Frances Street to a point 100 feet nosh of the north line of Soria Street. Together with the necessary manholes, inlets, con— duits, flush tanks and house connections to the curb line 'along the line of said Improvement. All as shown on the plans add in accordance with profile, detail draw— ings and speci i.cations on file in the 0 flee of the Department of Public Works of the City of South Bend, Indiana, ...nd said sewer, with all its appurtenances shall be eon— structed in accordance with the profile and specifications now on file in the office -of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon' and upon the City of South Bend, if the City is benefitted my said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana entitled R An Act Concerning Municipal Corporations," approved March 611905 Assessments, if deferred, are to be paid in ten eQual annual installments with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in paym nt for such work, unless the property owners pay said assess— ments before said bonds or bonds are issued. Board held first part of session in the Council Chambers, owing to the crowd of property owners on Mishawaka Avenue nand Eddy Street pavement improvement hearing* The, decision of the Board being held up until this date on the Eddy Street and Mishawka Avenue pavement improvement from Jefferson Blvd. to Sample Street Bridge and from Eddy Street to the center of Nineteenth Street, under Improvement Resolut=ion No.- 417 in the City of South Benxi , Indian-.. In the above matter a few remonstrator s appeared against the putting in of the pavement this year. Also over one hundred p rope rty owners on Mis haw ka Avenue and Eddy Street and in River Park appeared` for the pavement to be put in thisyear.(Mr. C. D. Emmons requested that, the -improvement be postponed one year on f:.ccount of the settlment of the sewer,also that they were unable: to get steel rails very so on) And the Board being fully advised in the premises, decides that the benefits to the property liable to be assessed for soid improvements are equal to the estimated cost of ,the same, as reported by the City Civil Engineer, t-.nd thereupon takes final action on said resolution as modified. Pavement on Eddy Street from Je_ferson Blvd. to Mishawaka Avenue and on Mishawaka Avenue from Eddy Street to tie center of Nineteenth Street, and the —se —me is hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the 7th-day of April and on the l4 _"i of April 1916 in a. newspeper of gener{,l circulation in said City, stating that this Board will receive bids for the constructionof said improvements up to 10:00 A.M.. on the 16 day of May,1916. The Board reserves the. right to reject any and all bids. Clerk instructed. to advertise in outside journals for bids. In the matter of the defefd hearing on the assessment roll for the Widening of Webster Street and Indiana Avenue. Mr. Noland appeared before the Board and stated ne A interested .in having Indiana Avenge opened up. Mr. Ryell T. Miller, represe— nting Mrs. Mary L. Hoover ppposed to the widening of the Street. Mr. - Carbinier did not think his dhmages should be reduced any. The Board after due consideration decided to . defer all action on said assessment roll until tuesday April 4th.,1916. at 7.45 P.M. . Mr. Lindner appeared before the Board in regard to having an alley in his plat crAnged opposite Linder Street so as to interesteet. . The Board instructed him to take this matter up with some of the other property holdera and see if same was agreeable to them. Contract for the repair And construction of cement sidewalks on Various Streets in the City undo r Improvement Resolution No. 422, was awarded to H. N. Barnes. I have taken this matter up with -Messrs Bugbee and Sehock, Abstractors, and they -,hi ve promised to pay the -Treasurer- Mr. Emberlains penalties and; I have noti ied ;ors. I. as the time when petitions must be filed, and the Board hereby continues this matter until the llth. day of April 1916 at 10:00 A.M. and .all bids were referred to the City Engineer for tabulation and he has reported the lowest and best bid. AND RUDOLPH SEIFFERT, partners doing business under the firm name and style of Seifert Brothers parties of the first part, and THE CITY OF SOUi H BEND,INDI11 NA by and through its Board of Public Works, party of the second part,WITNE,�ZETH: That for and in consideration of the agreements and prmises herein made to be performed by the party of the second part, the parties of the first part agree to paint the fence surrounding the City Cemetery in the City of South Bend with one coat o.f ou.re graphite paint, -standard quality, mixed with pure linseed oil, and in good wnrkffian3ike manner. Said fence being 41,420 feet in length and six feet in height. The front entrance now painted white shall be painted. white with one coat of pure white white lead and pure linseed oil. And they further agree to do all said work under the direction of and to the approval of the City Sexton. Said painting shall not be done wrien the surface is wet or damp. All material to be furnished by parties of the 'first part. All cans of paint and' oil shall be opeadd on the ground alid in presence of sexton Said work shall be completed on or before May 27th.1916. In consideration of -the performance of the above contract in the manner as abovr provided by the parties of the Hirst part, the party of the second part, agrees to pay said part es of the first part the sum of One Hundred Fifty -three ( $15-3. 00) Do lla rs. And it is further agreed that the party of the second part may require the parties of the first part to furnish satisfactory proof that all accounts for material and labor used and furnished in doing said work have been fully paid:- by the parties of the first part; and that the party of the second part may retain out .of said sum to be paid to the parties of the first part any amounts necessary for the payment of any labor or materials not paid for by the parties of the first part.
