Farabaugh in regard to money due H.N.Barnes on Hydraulic- Avenue pavement put in in 1912 The same was read and placed on file. Is THIS AGREFAENT, Made, and entered into this 14th. day of N me aly 1916 by and between the Chicago, Lake Shore and South Bend Railway Company, party of th e first part, and the City of South Bend, Indiana, party of the second part, J WITNESSET$ .• That, 1hereas, on the 29th., day of April 1913, the parties hereto entered into a written contract and agreement which, among other things,,provided for the use by the party of. the first part, of certain land in the southeast corner of La Salle Avenue and La Pete Avenues in the City of South and thet by said written agreement,.the'party of the -first part agreed that certain of its land at said corne^ mif%t be used for street.purpQses, a.nd that said corner should be rounded off and improved with curb and sidewalk in a manner to be approved by the Board of Public !forks of the party ofthe second part. And mhereas, said innprovement has never been made, and said parties have never agreed and determined upon the manner and method of making said.improvement, and it is desired to fix and determine the same, in order that its construction may be safe to both parties hereto and to the public. Company and on the north by present curb line.;,, Parties of the first part agreed to fill the triangular space between the track and the present sidewalk line with four (40) inches of crushed stone, If at any time hereafter the Board of Public WoPA s finds that the appearance of the grass plot between the curb and sidewalk on La Salle Avenue adjacent to -the track and right of way of the Chicago, _Lake Shore and South Bend Ry. Co. -is unsatisfactory, then, upon written notice from said Board of.Public Works said Company agrees to fill Rdth Broken lime stone to a depth of four inches, all to the satifaction of said Board of Public Work s • ' The sidewalk to be constructed by the party of the first part shall be five feet wide connecting the walks of La Porte Avenue and La Salle Avenues and shall be built according ,to the specifications used by the City Engineer of said Ci%r in construc- tion of sidewalks in said City. Also, said party of the first part agrees to move the storm inlet located near the southeast corner of said avenues to a point near the new curb, and at a location to be designated by -the City Engineer. A blue print of said streets and of such intersecting point is hereto attached, which shows the location -of -such new curb and side- walk, and also showing parts -of streets to bepaved and parts to be filled in with crushed lime stone. It is agreed that all of said work is to be done -according to such drawing, n and blue print, and also the approval of the City Engineer of said City and trie Board of Public Works. _ IN WITNESS WHEREOF, The parties have hereunto set their 2:Ends in duplicate the day and year first above mentioned. Plat of the North-west Addition to the Pity of South Bend was presented to the Board and the same was referred to the City Engineer for investigation. President. Tuesday February 15th.-9,1916. Continued. Board met in regular session at 7:45 P.M. All members present. Petition presented to the Board for grade on. Poka.gon Street from Tecumseh .%Avenue to the right of way of the Michigan Central'Ry. Company. The same was referred to the City Engineer for a resolution for grade with a three inch wearing surface of gravel. Guarantee Bond. on Fray¢; lin Street Brick pavement from Sample- Street to ,( Indiana Avenue signed by C.H. De Frees was approved by the Board. In regard to the hearing can Vacation Resolution No. 20 for the vacation of a Plat known as Stover-Longley Addition to South Bend, Indiana was deferred until Tuesday February 22nd 1916 at 7:45 P-M- The following communication was approved by the Board. Gent l emen: - Regarding the filing case which we ak s your Beard to install in the City Court Room will state 'that we have carefully examined the prices and sketches submitted to you by the firm of Herr h Herr, local agents of the Art Metal Construction. Co. and find that the steel stacks at $74.00 (eliminating base) is the most desirable and we again ask that you order same installed in said Court Room. LOCAL SEWER IMP ROVER NT RE SOL . `T ION N0. 4181 Resolved by the Board of Public worts of the City of South Bend, Indiana County of St. Joseph.i That the construction of a local sewer, intended and. adapted - only for local use by =the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and t1ee same is, hereby ordered in and along goose Court -from Chapin Street to a point 100 feet west of the west line of Scott Street as follows, to -wit;' - Beginning at the intersection of the center line of Chapin :street and Hoose Court; thence east along the center line of Hoose Court to a point 100 feet west of the west line of Scott Street with a 12 inch vitrified pipe sewer. Together with tine necessary manholes, inlets, conduits 'and house connections to the curb' line along the line of said improvement. All as shown on the plans, and in acerdance with the profiles, detail drawings and specs ications on file in the office of the Department of Public works. of the City of South Bend, Indiana, --nd said sewer, with sill its appurtenances shall -be -constructed in accordance with t he profile and specifications now on file in tie o fice of the Department of Public woks of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts theren, and upon the City of South Bend, if the City is benefited by, said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled,* An Act Concerning Municipal Corpor- ations,* approved March 6,1905• Assessments, if deferred,' are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond - or bonds shall be issued to the contractor in payment for such work, unless the pro- perty owners pay said assessments before said bond or bonds are issued. sday February 15th.,1916.
