Studebaker in regard to damages received on the Wideng of Eddy Street and Mishawaka Al; nue . Report of The Fidelity and Guaranty Company of New York on the boilers in the City Hall read andplaced on File. Communication received from John Platz in regard to Mrs. C. P Hearing given on Condemnation Resolution No. 43 for the purpose of appropriating a strip of land to open and extend Lafayette Street from a point 149 ft. north of the north line of Indiana Avenue, in the City of South Bend, Indiana, A In the above matter no remonstrators appeared and no remonstrances were fill A mayority.o.fBoard being fully advised in the matter takes final action on said resdlu- tion, confirming without mods 'ication, all former action taken on the same. Hearing given on Vacation Resolution No. 25 for the purpose of vacating a portion of Lafayette Street between Broadway and -Indiana Avenue, as follows+ Beginning fifty (50) feet east and one hundred and forty nine (149) feet north of the intersection of the north line of Indiana Avenue and the west line of Lafayette Street produced south; thence north one hundred and ninety one (191) feet; thence east thirty two and one-half (32-1/2) feet; thence south one hundred and ninety one (191) feet %hence west thirty two and one half (32-1/2) feet tonthe place of beginning* a majorijy ofn the above matter no remonstrators appeared and no remonstrances were filed, the Board therefore sustain all former action taken and declare the above described property in all thin-.s vacated and this resolution in all things ratified, confirmed and- approved. Resolved further, that the City Engineer be instructed to prepare a roll showing awards of damages and assessments of benefits to all parties and pro- perties interested in the above matter. The Board ordered the City Civil Engineer to prepared resolution for pavement on Michigan Street from South Street to north line of Lam, �Sa3.1e Avenue. Eddy Street from Jefferson Blvd. to Sample Street Bridge, 9,44 Mishawake.-Avenue from Eddy.Street to Nineteenth Street. and Indiana Avenue from Leer Street to Kemble Avenue. Permission was granted E.H. Frederickson an extension of 60 days or until April lst.1916 for the compketion of printing office building on Hibberd Court. The City Engineer filed the following reports. Regarding the attached petition for pavement on St. Louis Blvd. from Jefferson Boulevard to Division Street, I respectfully report that I have investi- gated said utter and recommend that the petition be granted. The estimated cost of the City's Intersections is $1,300.00 and the City's share fo share for street and aky r Park frontage is 0.00 Respectfully submitted, FREDERICK J. ANDERSON City Engineer. The above petition was placed on file until April 4th.91916 at 10:00 A.X, Regarding the attached petition for pavement on Liston Street from Birdsell Street to Adams Street, I respectfully report that I have investigated said matter and recommend, that the petition be granted. Communi cat ion received from the Common Council instructing the Board to install an incandescent light at the alley between Garst and Stull Streets on Lafayette. Street. The sa.e was read and placed on file with other petitions to be investi- gated when trip is made, for said purpose. The follow ng letter was ordered sent to Mr. U. G. Manning, City Controller. Dear Sir You are hereby reT ested to hold out of the funds owing J.H.Oahill Co., Contractor on the Michigan Street Trunk sewer, the sum of Two hundred and fifty (25000)Dollars.- This to be used by the Board of Public Works in repairing and replacing any defects found on sewer. Very truly, BOARD OF PUBLIC W01kS. STREET OR ALLEY IMP ROVEMEIT RESOLUTION NO. 416. BE IT RESOLVED BY THE BOARD OF PUBLIC WOFK S OF THE CITY OF SOUTH BEN#D,ST. JOSEPH COUNTY,STATE OF IND ANA, that it is desired and deemed necessary to improve Indiana Aveme from Leer Street to Kemble Avenue as followsyto-wit- By grading and paving the roadway, also by grading and paving the road- ways of all intersecting streets and a! legs lying within the property lines of said Inch. ana Avenue not included in the roadway; by paving said roadways wd.th either Asphalt, Asphaltic Concerte, Brick or Bitulithie laid o n a five (5) inch portland cement concrete foundation; or with Brie laid on a six (6) inch , rolled gravel foundation; by placing the necessary margin- al cement curb; curbing the roadway with cement curb where same is not already constructed by placing all manholes and inlets to the proper grade; and by the construction of all storm water inlets and conduits; all as shown on the plans and in accordance with the profiles and detail drawings and specifications on file in the office of the Department of Public Works of toe City of South Bend, Indiana. The cost of the improvement herein provided for, except street and alley - int rsections, shall be paid by special assessment to be levied upon the property speciially benefitted, to the amount that the same may be legally assessed therefor, in accords -ace with an Act of the General Assembly of the Ste to of Indiana, entitled *An Act ConceLning Municipal Corporations, * approved March 6,1905 and in accordance with and pursuant to the provisions of all acts amendatory and supplemental. thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys rich run into, but do not cross said roadway herein proposed to be improved and that portion of such street or alley abutting upon property belonging to said City, or upon property snot subject to such assessment shall be paid by the City in cash out of its general fund, if able to do so, or from the fund created by a special assessement to be le ied under the provisions of Section 108 of the above entitled Act. Assessments of ten dollE-rs and more against each lot, if deferred, are to be paid in ten equal annual installments,. vdth. interest at the rate of Six per cent. per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rats payment for such improvement. 36 Tuesday ;January 25th. ,1916. Vontlnued. Under no circumstances shall the City of South Bend, be, or be he',d re- sponsible fir my sum or sums due from said propety owner or owners for said Volk, or for the collection of the same,or for the payment of any bond, bonds, certificate or certi- ficates, issued to said contractor in payment fbr such work, except for sudi moneys as shall have actu lly been received by the City from the assessments. for such improvement or such moneys as said City is by said entitled Act and amendements and supplements thereto required to pay. All proceedings had, and work done in the waking of said improvement, assessment of property, w lleetion of assessments and issuance of bonds therefor, shall be as provided for in said above entitled ,Act and acts amendatory thereof and supplemental'theretu. Be It Further Resolved, That the Board of Public Works fix the 7th day of Mareh,1916 at the hour of 7:45 P.M. at the office of tbE Board of Public W,,rks, of this 'City, as the time and place for the public eonsi(deration of said proposed improvemeat, at which said Board of Public Works will hear all° persons interested, or Yhose property is liable to be assessed for said improvement, and will decide. vhether the benefits to the property liable to be assessed for said improvement wf11 equal the estimated cost thereof. - Be It Further Resolved, That notice of the time and place of such public consideration be published and wailed in the manner provided by law.
