Remonstrances were filed. by Dudley M, Shively for the Shively Estate
on Michigan Street Trunk sewer_, and by David U. & Helen E. Bowman.

Air. Louis Nickel appeared before the Bo&rd and Made a request to
have an alley in Nickel's Sub. Div. vc.cated. No action was taken.
The City Engineer submitted the list; of property oviners in the
matter of the appropriation of certain property under Condemnation Resolution Number 42
as shovn on page 776 of Record 5, It ich list includes the nacres of the owners afid holds•s
of property and of interests the •ein souFjit to be taken or beneficially or injuriously
effecte4k. and t-he description of the several pieces of property Which is affected by the
said appropriation proceedings.
Thereupon the Board proceeded to award the damages sustained and to
assess the benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and unanimously
adopted, resolved that said list, together with the amounts of benefits and damages anch et
benefits and net damages therein set forth as to the several parcels of land. be adopted,
and that the respective amount of benefits contained in said list be'and are hereby assessed
against ttie several tracts of land as specifically set Forth in said list, anri that the
respective amounts of damages contained in the said list be and are :gereby awarded to t e
several tracts of land, contained in said list ure hereby awarded or assessed, as the
case may be in said several tracts of land.
The Board hereby further sets o-f' the benefits and. dames_es each
against the other vfh re both benefits and dame. es are assessed against thr. same piece of
property, tract p land or interest, and hereby Fixes said respective net, benefits as the
amount that shall be paid by the respective owners as benefits, and further hereby fixes
the respective net damages as t3D the several tracts as the amount that shall be paid to
the owners of the respective treats as 'damages.
Thereupon, upon -notion duly made and. seconded and. unanimously
adopted, the ` 1st. day of February 1916 was fixed as the day on which this Board will
receive or hear remonstrances from persons with regard to the amount of their respective
awards or assessments, and the Clerk of this Board was instructed to prepare and cause to be
duly and legally given, notices to the owners of each parcel of property, showing the amount
of the assessment or award, with a description of the property affected, and the date of said
hearing.

Board met in regular session at 7:45 P.M. All members preseftt. Session held
in Common Council Chambers.
Hearing had on assessment roll and final estimate for Trunk sewer on
Michigan Street From La Salle Avenue to Monroe Street, under Impro vement a
Resolution No. 367* in the City of South Bend, Indiana.
In the aboue.matter remonstrators appeared and written remonstrances
were, filed by Grand Trunk Ry. Co., Birdsell Mfg. Co. and Estelle X. Knapp, as to
the amounts of t leir. assessments* -The Board after £due consideratton decided to
defer sr: iej hearing until Tuesday January Ilth.,1916 at 7:45 P.M.
