Remonstrances received from Attys. for J. .Studebaker against assessment of damages on Widening of Eddy Street and Mishawaka Avenue. The same were read and placed on file. Bond and contract for Pipe sewer on Indiana Avenue from Michigin Street to Pain Streets under Improvement Resolution Ito. 409 signed by Staples and AckerrFan we approved by the Board. Bond s.-Ii contract for pipe sewer on Fox .Street from St. Joseph St.. to`Fellows Street, under Impmvement Resolution No. 412. sued by Staples And Ackear.an and approved by the Board. Communication received from Ja_es A. Judie with bill from W.W.Sibley Company for repairing cave in on Michigan Street.. The same was read, and placed on file. The following communication was received from the County Attorney dead and placed on file, the Board to make a trip and investigate said Ernsperger Street. Nov. 22nd,1915. Board of Public Works South Bend, Indiana. Gentlemen: — IN THE MATTER OF THE DRAINAGE OF ERNSPERGER ROAD,EAST OF TF- IS CITY AND SOUTH OF THE LAKE SHORE TRACKS. The Board of County Commissioners was out there today to view this road, and instructed me to write you regarding the drainage of the same. They fear that unless some provisiions be made to take care of the drainape this fall, that by spring this road will be almost unpassable, and be of great injury to the same. Will you kindly take this matter up with your engineer regarding it, and advise this Board at your earliest convenience ghat action you have taken in regard to same? City: — Dear Sir You are hereby requested to turn over to DePeape Coussens $100.00 held by you by order of the Board of Public Works as a guaranty for work to be peri'nrred on the Dubail Avenue sewer. The Street Commissioner filed with the Bo€. „d request from the Grand Trunk Ry. Co. foreman Chas. Bovmtan to u-se. crushed stone between tracks at Ford St. crossing (both street and sidewalk) and recommended that permission be given Grand Trunk- R'y. Co. to to use crushed stone base with screen ng top, and well tamped at this particular crossing. The Board approved Street Commissioners report. The Street Commissioner was instructed to enforce the followAng letter received by him from the foreman of the Grand Trunk Ry. System, which reads as follows: — Mr. Chas. Bowman, B.&B. Foreman —Battle Creek,. Dear Sir : In connection with the repairs required to brick platform and sidewalk at St. Joseph Street, South Bend. You may arrange to have this work done as outlined in Supervisor of Bridges & Buildings Sander's letter of November 19th. and arrange with Mr. Layton to have this amount ,viz., $35.20 assessed against the property. Communication received from Central Union .stat ing that our letter of Nov. 12th. had been complied vdr th.- Permission w,s granted the Postal Telegraph Company to extend their present line of conduit on Vistula avenue from the east side of St. Joseph Street to about thirty feet woutn of the south line of East Jefferson St. <.The Board ordered that the bill of Alex Bukowski for the construction of cement walk and curb on the northeast corner of Seeberger Drive and South Michigan Street be paid for out of Intersection fund. a Mr- Duc�k of North Hill Street appeared before the Board and complained of property owner fiXng' up lawn to property line. The Board instructed the City Engineer y to investigate said matter and report at meeting at 7:45 P.M. this 23rd. day of Nov-1915 President. Board met in regular session at 7:45 P.M. All members present. Hearing had on assessrent roll and final estimate for pipe sewer on Leeper Avenue from Howard Street to Angella Avenue, under improvement Resolution No. 391 In the City of South Bend, Indiana. In the above,matter a remonstrator appeared but no further Witten remonstrance was filed. The Board therefore find that the property assessed in said roll filed November 2nd.1915 is benefitted in the amount of assessments as shown on said rolls And -,that the Board further find that the assessments m 11 filed November 2nd.1915 and the final estimate allowed November 2nd.1915 should be and the same are hereby in all things ratified, confirmed and approved. Hearing given on roll of awards of damages and assessments of benefits in the matter of appropriating for public use a strip of land bn the east -side of Eddy Street, northeasterly and north side of Mishawaka Avenue for the purpose of Widening Eddy Street and Mishawaka Avenue from Jefferson Blvd. to east line of Pottawatomie Park, under Condemnation Resolution No. 38. In the City of South Bend, Indiana. In the above matter Atty. Crumpacker appeared representing J.W.. Studebaker and remonstranced against the amount of damage allowed, as per remonstrance filed, but no further remonstrators appeared and no further remonstrances were Oiled. The Board after due consideration decided to defer all action on the same until Tuesday November 30th.,1915 at 7:45 P.M. Hearing had on improvement Resolution No. 413 for the Grading and paving, curb and sidewalk on tract of land located at the southeast corner of West La Salle Avenue and La Porte Avenue, 1 n the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no remonstrances were filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, And thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, ©nfirmed and approved. Resnlved further, that notices be published on the 27th. day of Noverber21915 and on the 4th. day of December,1915 in a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improve— ments up to 10:00 A.I. on tze 14th. day of December21915.-The Board reserves the right to re je ct any and all b ds. The Board ordered the following li�� its placed. One 100 C.P. Incandescent lii:f�.t placed at corner of Tecumseh Ave. and Angell& Avenue. One Are light placed at corner of Marquette Avenue and Michigan Street. One SO C.P. Incandescent light in alley west of Michigan Street 1/2 block south of Division Street. Tire City Engineer Piled the following report. To the Hon. Board of Public WorKs, of the City of South Bend, Indiana. Gentlemen! — in accordance with, your instructions I have investigated the complaint of Mr. D-a ck in regard to the making of a fill in Hill Street, at the southwest corner of Howard Street. I find that the property orn.er has extended the terrace of his lot from the street line, to line of the walk. The height of this terrace is approximately two or two end one fialf Peet high. There is a similiar terrace on the east side -)' f the street in front of the Meyers papperty to which -Mr. - Duck does not object ind to remove which would make it necessary to destroy tyro very large maple trees. In case the owner ".oF the lot at the southwest corner of dill Street and Howard Street is compelled to remove his terrace the other owner should also be compelled to remove the terrace on the east side of the street, The above was read and placed on file. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South'Bend Daily;.Tribune, commencing on the 29th. day of November,1915 stating that this Board will give._a hearin-g on .the amount of such assese merits at its office in the City Hall on the 14th. day o-., December,1915 at 7:45 ,P.M. Resolved further, that the entire work under the above contract be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 29th. day of November,1915 in the South Bend Daily Tribune stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the-14th. day of December 1915 at 7:45 P.M. J Engineer filed assessment roll and final estimate for Asphalt pavement on Allen Street from Oak Street to Van Buren Street, under Improvement Resolution No. 379, In the City ' o f South Bend, Indiana. Resolved, that notices as to the amounts of asses-ments be published for six consective days in the South Bend Daily Tribute, commencing on the 29th. day of November,1915 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 14th. da'T of December1915 at-7:45 P.P. Street Commissioner -filed report with the Board in regard to petition f of Joseph Berner, asking for damages to hares that had leg "broken frori falling into the small leak back, opening in the pavement on Michigan Street between Sample Street and Garst Street. Attorney Jellison, appeared before the Board in regard to the same, but the Board deferred all action on the same until Tuesday November 30th. 1915 at 7:455 P.M. Upon request permission vms granted the. Postal Telegraph Company to'remove old pole twelve feet from curb line on South of East Jefferson Street on east side of Vistula Avenue and replace it vdth a new pole forty eightf eet south of present location of old pole. This pole to be set in order to make a dead eyed for their aerial lines. Permission granted the Central Union Tel. Co. to lay conduit in a -.ley between Lafayette Street and Main Street north of Jefferson Bl vd. at rear of Farmer's Security Bldg. a, ---out 30 feet of conduit. President.
