Sylvester Williams, Bruce Huntington Agenda: Bill No. 12 -08 Special Exception 730 & 734 29th Street Bill No. 12 -09 Special Exception 1902 Western Avenue Bill No. 12 -08 — Special Exception 730 & 734 29h Street Noting three of four members of the Zoning & Annexation Committee present, representing a quorum, Chairperson Oliver Davis opened by asking Mark Lyons to give the report from the Board of Zoning Appeals (BZA). Mark reported that the BZA gave the request a unanimous favorable recommendation. Only one nearby resident spoke in support at the BZA hearing and one against who expressed parking concerns. Oliver then recognized Bernie Feeney representing the petitioners for the formal presentation. Using a spiral bound handout (attached) Mr. Feeney noted 46 neighbors had voiced support and the parking concerns had been addressed with off street parking at the Lutheran Church of the Redeemer. Opening for Council questions, Oliver recognized Karen White who complemented Mr. Feeney for his thorough presentation. Councilmember Gavin Ferlic motioned a favorable recommendation seconded by Councilmember Varner and affirmed by all. Bill No. 12 -09 — Special Exception 1902 Western Avenue Having been called upon by Chairperson Oliver Davis to give the BZA report, Mark Lyons said while the Building Department staff reports to the BZA was favorable, the request received a 4 -2 unfavorable vote. Mr. Lyons said this was due primarily due to parking concerns there being only 5 spaces on site. Mark said the reason for the exception was that while the building was previously a bar and was again hoping to open as a bar it had been closed for over a year and lots its previous parking exemption. Chairperson Oliver Davis then recognized Bruce Huntington, an attorney representing the petitioners. Mr. Huntington noted the owners had a contingent lease for 22 more off - street parking spaces. During the Council portion, Councilmember Varner asked if special exemptions ran with the owner or the land. The Council Attorney, Kathleen Cekanski - Farrand answered the land. Councilmember Varner then said he would like to see a parking lease longer than 1 year, more like 5. Councilmember Scott had concerns about the proximity to residences and hours of operation. Mr. Huntington responded saying homes were no closer than any other Western Avenue business. Also normal tavern hours of operation were expected. He also said the petitioners were okay with presenting a 5 year parking lease. At that, Councilmember Varner motioned the request be sent to Council favorably with an agreement for a 5 year parking lease added. Councilmember Gavin Ferlic offered a second and all supported.
