The Board instructed the Clerk to write letters `to the appraisers on the Widening of Ewing Avenue and request them to f ile ' an itemized statement of their bill, It was unanimously approved by the Board that the -salaries of We E. Liraves, P. *. Rill in and J. T. Neenan of the Engineering Department be in- ccreased and paid at the rate of $2,000.00 per year starting August 1st.,192o. Attorney Schellinger appeared before the Board and presented Plat of Richland 1st,.. Add it ion and same was approved by the Board as follows: - The attached plat is a plat of " Richland First Addition"., an - Add it ion to to city of South Bend, Indiana. Board. TRUNK SEWER IMPROVENENT RESOLUTION NO.8?_8. , Resolved by the Board of Public Works of the �City of South Bend, County of' St. Joseph, State of Indiana':' That it is des ireid and deemed necessary to construct a sewer in Meade Street from Huron Street to,Sample 0-Street all in said C itX. which, .from its size and character, is not only intended and adapted for use by -property owners whose property abuts along the line of said sewer, but is also intended and adapted for receving sewage from collateral drains already con- structed or which may be hereafter constructed, and the same is hereby ordered con- struoted 'in and along the following line in said City, to -wit:- Beginning at the manhole in the center of Meade Street and the nor h line of Huron Street; thence south along the center line of Meade Street to the center lineoff grace Street with a 24 inch vitrified pipe sewer; thence still south along the center line of Meade Street to the center of Ford Street with a 22ddch vitrified pipe sewer; thence still ailiagsouth along the center of Meade Street to the center of Poland Street with an 18 inch vitrified pipe sewer; thence still south along the center of Meade Street to the center of Dunham Street with a 15 inch vitrified pipe -sewer; thence still south along the center lin of Meade Street to the center of Sample Street t:f with a 12' inch vitrified pipe sewer, together with the necessary manholes, storm water inlets, conduits, flush tanks and house connections to the curb line along the. line of said improvement, all as is more particularly shown .and alll in accordance with the plans, profiles, detail drawings and. spec if icat ions on file in the Office of the Department of Public Works of the Department of Public Works of the City of South Bend, Indiana. And to be built in accordance with the profiles, specifications, detail plans, maps and estimates now, on file in the Office of. the Department of Public Works of said City, which includes an estimate of the proportion that the cost of an adequate local sewer, built along the bove line, bears to the Cost of the main sewer, to be bu ilt as follows: The cost of an adequate local sewer, built along the line above described, is hereby estimated and fixed to be of the cost of the main sewer to be built along the said line of above set forth, which proportion as herein estimated and fixed, shall be taken and adopted in all computations requiring a knowledge of the cost of such local sewer if built along the line where the main sewer is to be built, The cost of the constructionn of said sewer shall be divided as follows:- 1. So much of such cost as shall be equivalent to the construction of an adequate Local sewer not adopted Lo receive sewage from collateral drains or sewers, if built along the porposed .Line as here inabove set forth, shall be paid by the abutting property holders and the City of South Bend, if it be determined that said City fs benefitted by said sewer in the same manner arkd to ,t1je same .extent .as..lo.c,al sewers, are paid for by them, under the Statutes in such cases made and provided. 2. The excess of cost over and above what would be equivalent to the cost of a local sewer, if built along said line, shall, b,e ,asks,9.ed oa&a,ins.t..eZZ-h piece of property in the district or area to be drained and against the City, if it be determined that the said City if benef itted by the, said s,ewer,, apeording to the manner and method prescribed by law, all of which said property beneficially affected lies within the following described territory in the City of South Bend County of St. Joseph, and State of Indiana, to -wit: - Beginning at the intersection of the center line of Meade Street and the south line of Huron Street; thence east along the south line of. Huron Street to the west line of the first alley east of Meade Street; thence south to the south line of the first alley south of Huron Street thence east along the south lin of 1st. alley south of Huron Street to the west line of the Ist. alley west of Olive Street; thence south along the west line of lst, alley west of Olive Street 87 feet; thence east to the west line of Olive Street; thence south along the west line of Olive Street 136 feet; thence west to the west line of the 1st. alley west of Olive Street; thence south along the west line of the lst. alley west of Olive Street 188 feet; thenoe east to the west line of Olive Street; thence south along the west line of Olive Street to the north line of Ford Street; thence west along the north line of Ford Street 40 feet; thence south along aline parallel with and 40 feet west of the west line of Olive Street to the north line of the No aJ. Said Improvement shall ,be known as the Meade -Street Trunk sewer, under Improvement Resolution No. 828 in the City -of South Bend, Indiana. And said City of South: Bend, if the said City; is ;benef itted, shall be assassed as afores ,to pay said excess ,;of cost ever and above what .would be equivalent to the cost of a local sewer, ._all of whichcwill' more ,fully appeare by reference to the 'profiles, map, drawings, and s pec if icat ions- now on file in the office of the Department of Public Works of said City, which', among other things, gives the eza'et course of said proposed main sewer; overflows, and its' appurtenances, and the district or: area which may be injuriously or beneficially affected `thereby, as shown by the heavy boundary.l.ines marked on -said map i and drawings, with proper words and figures written thereon, clearly indicating what said heavy boundary lines represent, and the district or area embraced thereby. Assess— ments if deferred, are to be paid in ten annual equal installments, with interest at the rate of' six per- cent per annum.. A bond or bonds shall be issued to the contractor in payment for said work, unless the property owners pay said asessments before said bond or bonds are issued. nder no circumstances shall, the City of South Bend be or be held respons able for any sum or sums due from said .property owner or owners for said work, or for the collection of the same, or for the payment of any bond o bonds, certificate or certificates issued to said contract in payment for such work, except for such moneys as shall have been atually received by sail City, from the assessments for such improvements., All proceedings had and work done in the construction of said main sewer and its appurtenances, manner of assessment of property collection of assessments ah.d issuance of bonds therefor, s hall be' as pr-ovided for in an Act of the general Assembly of the- State of Ind iana, ant itled . Finanical statement of the Cemetery Sexton filed. 3 Cdhoerning the improvement of the roadway of Frances Street from Cedar Street _to Grand Trunk Ry. with asphalt, -asphaltic concrete, bitulithic, concrete or brick, pursuance to resolution No. 789 the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing on said ;st.reet to be improved requesting that it be improved with a -different kind of pavement than . the kind heretofore adopted by the Board in its preliminary order; and :the City Engineer report that the Williston Construction Company is the lowest and best bidder for the kind of pavement heretofore adopted by the Board, and the Board find tlia,t said Williston Construction Company is the lowest and best bidder and hereby letp the contract for said improvement to him, and orders that said Improvement be made with Trinidad Lake Asphaltic concrete and all proceeding's heretofore had in this matter are hereby confirmed and ratified. Concerning the improvement of the roadway of Church Place ,from LaSalle Avenue to lst. alley South with asphalt, asphaltic concrete, bitulithic, concrete or brick,, pursuance to resolution No. 790 the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing on said street to -be improved requesting that it be improved wit)x adifferent kind of pavement than the kind heretofore adopted by the Board in its preliminary orderi and the City Engineer reports that the McCread Construction Company is the lowest and best bidder` for the kind of pavement heretofore adopted by the Board and the Board find that said McCready Construction Company is the lowest and best bidder and hereby lets the contract for said improvement to him, and orders that said improvement be made with 'concrete pavement and all proceedings heretofore had in this matter are hereby c onf irmed and rat if ied. Street, by paving the roadway the same, and WHEREAS, the City Civil Engineer has prepared and filed in the office of this Board a repori showing the number and location of the service pipes, mains, conduits, laterals, and connections which are, or will be necessary to accorrmcd.ate the abutting property and the owners thereof with gas, water, seweF, and other conveniences and necessaries: and aho said City Givil Engineer has prepared and filed in said office specifications showing the material to be used and the maner of laying said service pipes mains, conduits, laterals and connections from the mains to the points in- side the curb lines. THEREFORE, be it -resolved by the Board of Public Werkes of the City of South Bend, .Indiana, that the report of the City Civil Engineer is adopted, and, sa-*d report arc the specifications prepared and filed by him are made a part of this resolution as -fully and effectually as if copied herein at full length; and it. is fur- 1 thei ordered that all of such private connections with the sewer, gas, and water ' mains be made in said street • by bringing them inside the curb lines thereof. Works, then . said Board will cause the, same to be made and will asses the cost thereof against the property abutting epcn said - street, and shall do all other things pertaining thereto according to the provisions ar.d regnirments cf Ordinance No. 1842 adopted by the Common Council of the City of South Pend on July 24, :1916, and -cf .all other ordinances and law relating thereto. And, be it further resolvedand ordered that after- the 20 day period` has elapsed for the making cf said connection by the property owners, a notice shall be published for two weeks, once each week,. in the. South Bend Tr lbun-e , a newspaper of general circulation publ'shd in said city, req:restirg bids from contractors for the making of such connections as have not been made by the property off ners, and such notice shall fix a day, not earlier than ten days after the first of such publications, when bids shah be opened and a contract let for the doing of said work.
