To the•Members of the Board of Public Works, South Bend, Ind. Gentlemen: - We, the members of the Board of School Trustees, are very anxious to that yuur proceed with the proposed pavement on West Sample Street. The Street is practically impassable the greater part of the school year, making it very diffeult for teachers and pupils as well as -,patrons and visitors to reach the Washington School which is located on the unpaved part of the Street. It would be very 'd iffteult for the fire department 'to reach this school In case of fire while the street is in its present condition. Concerning the improvement of the roadway of Kline and Calvert Streets from Lincoln Way East to Kerr Street with asphalt, asphaltic concrete, b itul ithic, concrete or brick, pursuance to resolution No. 763 the Board finds that no petition has been 'f iled with said Board by a majority in numbfr of the freeholder residing on said street to be improved requesting that it be improved with a d iffern ent kind of pavement than the kind heretofore adopted by the Board in its preliminag order; and the City Engineer reports that the White Construction Company is the lowest .and best bidder for the kind of pavement heretofore adopted by the Board and the Board find .that .the said -The White Construction Company is the lowest and bast bidder and hereby lets said contract, for said improvement to him, and orders that said 'improvement be made with Trinidad Natural Lake Sheet Asphalt pavement and all proce-ed ings 'had 17T 'this' lta't'te�r are hereby confirmed and rat if ied . Board of Public Works, City Hall , South Bend, Ind. - Gent lemen: - Replying to your let ar of the 26th. , u t. it is agreeable to us for the Walnut'Street sewer to be temporarily connecte with our private sewer in order to provide for any overlooking of the Walnut Stree sewer due to connecting it with a sewer on Indiana Ave. from Walnut Street to Webs er St. ` We would like it understood however, that should our private sewer be overloaded at any time other arrangements will be made for taking care of this overflow -'and that as soon as anoth_ir connection can b e made the temporary connecti with our private sewer will be discontinued. We further understand that the tempor- ary connection with our private sewer will be so constructed that it will not take any of the 'normal flow ih the Walnut Street sewer but will only provide for an un- 1 oad ing of that s ewer . Gentlemen: - Referring to the contract for the pavement of College St., from Lincoln Way West to Vassar Avenue., which was awarded to us by your Board on June 1st., We wish to advise that investigation shows that the total amount of this contract, less the City's share for intersections, is in excess of 50% of the assessed valuation of the property abutting. Since the 1&w forbids the awarding of a contractin excess of 50% of the assessed valuation, unless the consent of thw owners to be assessed is secured within ten days from the taking of bids, which unfortunately was not secured in this case,. our attorneys have advised us that 'the legality of this contract is doubtful and we, therefore, request that your Board rescind their award.
