RESOLUTION NO. 773, Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That it is des it d and deemed necessary to improve Walnut Street from Sampl® &tr eat to Prs it ie Avenue as follows, towit: - Said street shall be graded from property line to property lines to the established grade and cement sidewalk and cement .curb shall be constructed on -both sides of the street from Sample Street to Prairie Avenue, all as is more particularly shown and all in accordance with the plans, pro ilex, detail drawings and spa f is i.ations on file in the office of the Department of Publ c Works o the City of South Bend, Ind iena. The cost of the improvement, including the cost of the street and alley intersections, shall be assessed upon the real Dstate on said Walnut Street all according to the method and manner provided for -in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Muncipabl Corporations," approved. March 6,19,05, and in accordance with and pursuance to prov is ions of all am ndatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana, Assessments, if deferred, are to be paid in ten equal annual installmets, with interest at the rate of Six per cant per annum. A bond r bonds shall be issued to the contractor in payment of such work, unless the property owners pay said assessment before said bond or bonds are issued. Under no circumstances the the City of South Bend, . be or be he] responsible for the any sum or sums due from said property owner or owners for said work or for the collection of the same, or for the payment of any bond, bonds, certi- ficates, issued to said contractor in payment for such work, except for such moneys as shall have been aotua lly received by the City from the assessments for such improve- ment. or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making df said improvement, assessment of property collection of assessments and issuance of bonds therefor, shall be as providedfor in said above -entitled Act and amendments thereto. County of St. Joseph, State of Indiana, That it ii desired and deemed necessary t-0 improve at.Bealle Street from.Portage Avenue' to Kessler Boulevard as follows`,to-wit Said street shall be graded and the roadway them -of shall be paved; and also the roadway of certain portions of the streets and allays which enter or intersect said street shall be graded and paved.
