Resolved by the Berard of Public, Works "of the City of South Band, County of>St.
os Jeph , StaW of Indiana: That it is desired and deemed necessary to construct Is sewer
in Division Street from Meade Street to Chicago Street all in sad City, whiehm, from:
its-s ise and character, is not only intended and adapted for use by property owners
whose property abuts along the 1 in of said sewer. but , is also intended and adapted f pr
receiving sewerage from collateral drains already constructed or which may' be hereafter
constructed, and the same is hereby order1 3d constructed in and along the following
line bn said City, to -wit:- Beginning at the intersection of the center line of Division
Street abd Meade Street; thence- west along the center line of Division Street` 1165 feet
to the center of Liberty Street with a 24: inch l ipe sewer; thence still west along the
center line of Divis I= Street 1312 lineal faet�to the- center of Iowa t-eet, with a 20
inch v itr if ied pipe sewer; thence still west al ng the center line of Div is ion -Street
1000 feet to the center of --Kenmore Ste'eet an lf inchovttrified pipe sewer; thence still
west along _ the _ center line of Div is ion Street 1 OO feet to the center of Chicago
.Street with, an 15 inch vitrified pipe sewer, tee eth•�r with the necessary manholes,
storm water inlets, conduits, flush tanks and house connections -fro the curb line along
the line of s aid• improvement all ds is more particularly shown and all in accordance
with the plans,. prof iles, detail drawings and s ec if scat ions on File in the Office
of the Department of Public Works of the 'City of' South Bend, Indiana.
And to be -built-in accordance with they prrfil,3s, specifications, detail plans,
maps and estimates, now _ono f ila in the office "of the Department of Public- 'Works, of said
C ity, which includes an estimate ,of the proport-1 diLrithat the :cost of an adequate .local
sewer, built along the above line, bears to the oos t of the main sewer, to be built as
f ollows; The cast 'of an adequate local sewer, built along the line above described
is hereby estimated and fixed to be of the cost of the main sewer, to be:
built along said line as above set forth, which proportion., as herein estimated and
fixed, shall be taken and adopted in all oomputaticna requiring a knowledge of the cost
of such local sewer if built along the line where the main sewer is to be built. The
cast of the construction of said sewer shall be divided as follows:-
1. So much of such cast as shall be equivalent to the construction; of an
adequate local sewer not adapted to receive sew age From collateral drains or sewers,
if built along the proposed - line as here inabove set forth, shall be paid by the abutting
property holders and the City of South Bend, if it be determined that s d is City is
benefit4d by said sewer in the same manner and to the same extend as local sewers, are
paid for by them, under the Statutues in ouch cases made and .prov ided.
2. The excess of cost over and above wbat would be equivalent to the cost of
a local sewer, if built along said line, shall be assessed against each piece of property.,
in the district or aread to be drained and against the: City, if it be determined that
the said City if benefitted by the said local sewer, according to the manner and method
prescribed by law, all of which said property beneficially affected lies within the
following described territory in the City of South Bend, County of St. Joseph, and State
of Indiana, to -wit:- Beginning at the intersection of the center line of Meade Street
-and Division Street; thence north to the center of the first alley north of Division
Street; thence west on !renter line of said all!y to the first alley east of Kaley
Street.; thence north along the said alley to the aorta line of lot 800 in 3rd. Plat of
Summit Place; thence west to the center line of Kaley Street; thence north to the center
of the 2nd. alley north of Division Street; thence west long the center of said alley
to the center of the first alley west of Chicago Street; thanee .south along said alley
to the north line of let 203 Lincoln Park; thence east to the east lime elf Lincoln Park
Add it ion; thence north 6-feet which point is 306 feet south -of the south line of Division
Street; thence east prallel with and 306 feet south of the south line of Division Street
to the center.bine of Kaley Street; thence north to the center of Monroe Street; thence
ast along the center of Monroe Street to the center of the first alley east of Kaley
Street; thence north along said alley to the f it t alley south of Division Street; thence
east along the lat. alley south of D iv is ion Street to the center of Meade Street; thence
north along the center line of Meade Street tot the place of beginning.
Said improvement shall be known as West Division Street Trunk sewer under
Improvement Res olut ion No. 740. in the City of South Bend, Indiana.

azzd the said City of South Bend, if the said City is benef'itted, shall be assessed
as aforesaid, to pay. said- excass of cast over and above what would be equivalent
to the cost. of a local sewer; all of which will more fully appear by reference to the
.profiles, maps, drawings -and specifications now on file in the` off ice of the Depart-
ment of Public Works of said City, which, among other things, gives the a xaet
course of said proposed main sewer, overflows,'and its appurtenances, and the. dis-
triat or area whi.oh may be injuriously or beneficially affected thereby, as shown
by the. heavy boundary lines. marked on said map an drawings, with proper words and';
Rigures written thereon, clearly indicating what aid heavy boundary lines ,represent.
and the district or area embraced thereby. Assessments if_4aferred, are to be paid
in" ten equal annual installments, with interest at the.,rate of six per cent per annun
;A bond or bonds sh.all.be issued to the contractor in payment for said work, unless
the property owners -pay said assessments before:- s id bond or bids are issued, Under
no circumstances shall the City. of South Bend be r be held responsible for any sum
or ssms due _from said property ewner or owners fo said work, or for the collection 8
of the; same, or for the payment. of any bond, bond , cert if ioate or cePt if icates, fssd
issued to said contractor in payment for such wor , except for uch moneys as shall
have been actually received:by said City from the assessments for such improvements.
All proceedings had and work done in the c onstruat ion of -said main : sewer
and its appurtenances, manner of assessment of pr perty collection, of assessments,
and issue ce af''bonds therefor, shall be ;as provided for in an act of the General
Assembly of the State of :_Indiana, entitled ".An A _t Concerning Municipal,Corporations
.,in matters pertaining to the constitution,- altera ion and maintenance of public
drdns, :and sewers, provideng for the construction alteration and 'maintengnct of
such sewers and 'drains in such Cities and within our milesthereofalso providing
for the 'assessment f property specially benef itad thereby for the payment thereof, in
whole -'or _in part, and for -the collection of suchassessments; repealing all laws
and parts of laws 'in conflict therewith, and declaring an emergency , approved March
6- 1905, and all acts supplemental and 'amendatory thereta, pass-ed by the General
Assembly of the State of Indiana.
Notice of this resolution shall b.e. _p bl ished on. the 25th, day_ of March
1920 and on the 1st. day of April 1020 in the South Bend,_ Daily, Tribune_. This Board
will give a hearing on this resolution at its office in the City Hall on, the 21st.
day of . April 1920 at 7:15 P.M.

County of St. Joseph, State of Indiana:, That th construction of a local sewer, intended
and adapted Ynx only for local use by the prope ty holders whose property abuts. thereon,
and no intended or adapted for rece iv ing sewera a from collateral drains, be and the
same is, hereby ordered in and along Chapin Str et from Indiana Avenue to Oliver Street
as follows, t owit : -
Beginning at the intersection of the center line of Chapin Street and
Indiana Avenue; thence south along the center 1 e of Chapin Street 250 feet with a 15
inch vitrified pine sewer; thence still south along the center line of. Chapin Street
to the center line of Oliver Street with a 12 inch vitrified pipe sewer, together with the
