HomeMy WebLinkAboutNo. 0861 joint resolution of the SBRC and resolution No. 30-1988 of the South Bend Board of Public WorksJOINT RESOLUTION OF SOUTH BEND REDEVELOPMENT COMMISSION AND SOUTH BEND BOARD OF PUBLIC WORKS RESOLUTION NUMBER 861 OF THE SOUTH BEND REDEVELOPMENT COMMISSION RESOLUTION NUMBER 30 -1988 OF THE SOUTH BEND BOARD OF PUBLIC WORKS WHEREAS, the South Bend Redevelopment Commission has caused to be construced an elevated pedestrian walkway ( "the Skywalk ") interconnecting with and opening into Century Center, traversing across and above St. Joseph Street (United States Highway 33 North) between East Washington Street and East Colfax Avenue in the City of South Bend, Indiana, and interconnecting with and opening into the mezzanine level of the Marriott Hotel in the 1st Source Center; and WHEREAS, the South Bend Board of Public Works is the owner and titleholder of record of Buildings 3, 4, and 5 of Century Center, as depicted on Exhibit "I", attached hereto and incorporated herein, and is the lessee of Buildings 1 and 2 depicted on Exhibit "I" ; and WHEREAS, the South Bend Redevelopment Commission desires to convey all of its right, title and interest in and to the Skywalk to the South Bend Board of Public Works, and the South Bend Board of Public Works desires to accept such conveyance; and WHEREAS, IC36- 1 -11 -8 provides that a governmental entity may transfer or exchange property with another governmental entity upon terms and conditions agreed upon by those entities by adopting a substantially identical resolution, and that such transfer may be made for any amount of real property, cash, or other personal property as agreed upon by the entities. NOW, THEREFORE, BE IT RESOLVED by the South Bend �+ Redevelopment Commission and the South Bend Board of Public Works, as follows: 1. For good and valuable consideration given each to the other, receipt of which is hereby acknowledged, the South Bend Redevelopment Commission hereby conveys to the South Bend Board of Public Works and the South Bend Board of Public Works hereby accepts conveyance from the South Bend Redevelopment Commission of the Skywalk, which is more particularly described as follows: PARCEL I: A portion of a pedestrian walkway 22.00 feet in width over and above that portion of St. Joseph Street (U.S. 33) adjoining Lot 3 of the River Bend Addition to the City of South Bend, Indiana as recorded in the Office of the Recorder of St. Joseph County, Indiana in Plat Book 31, Page "R ", more particularly described as follows: J Beginning at a point on the East line of said Lot 3 (West R/W line of St. Joseph St.) which is North 0 °25' 1 1" West, 21.82 feet from the Southeast corner of said Lot 3; thence North 89 034149" East, 85.00 feet to the East R/W line of St. Joseph St.; thence North 0 °25'11" West, 22.00 feet along said East R/W line; thence South 89 034149" West, 85.00 feet to the West R/W line of St. Joseph St. (East line of Lot 3); thence South 0 °25'11" East, 22.00 feet to the Point of Beginning; the bottom plane of the vertical space contained herein shall be elevation 720.33 feet (USGS Datum); and the top plane of the vertical space herein shall be elevation 746.50 feet; and PARCEL II: A portion of a pedestrian walkway 22.00 feet in width, from the east line of St. Joseph Street to the entrance at the Century Center and being described from Lot No. 3 of River Bend Addition to the City of South Bend, Indiana, as recorded in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 31, Page "R ", more particularly described as follows: Beginning at a point on the east line of said Lot No. 3 (West Right of Way Line of St. Joseph Street) which is North 00 025'11" West, 21.82 feet from the southeast corner of said Lot No. 3; thence North 89 °34149" East, 85.00 feet to a point on the east line of St. Joseph Street, said point being the Point of Beginning of this Description; thence North 89 034149" East, 8.27 feet; thence South 45 025111" East, 66.66 feet; thence North 44 034149" East, 22.00 feet; thence North 45 °25'11" West, 75.77 feet; thence South 89 034149" West, 17.37 feet; thence South 00025'11" East, 22.00 feet to the Point of Beginning of this Description; the bottom plane of the vertical space contained herein shall be elevation 720.33 feet (USGS Datum); and the top plane of the vertical space herein shall be elevation 746.00 feet. 2. The South Bend Redevelopment Commission and South Bend Board of Public Works hereby authorize their respective officers to execute any and all documents, including but not limited to deeds and other evidences of this conveyance, to carry out the intent of this joint resolution.
