CITY OF SOUTH BEND, INDIANA AMENDING
ORDINANCE NO. 10119 -11 FIXING MAXIMUM
SALARIES AND WAGES OF APPOINTED OFFICERS AND
NON - BARGAINING EMPLOYEES OF THE CITY OF
SOUTH BEND, INDIANA, FOR THE CALENDAR YEAR
2012 AND TRANSFERRING FUNDS FROM CERTAIN
ACCOUNTS TO OTHER ACCOUNTS WITHIN
DEPARTMENTS OF THE CITY OF SOUTH BEND,
INDIANA FOR THE CALENDAR YEAR 2012
STATEMENT OF PURPOSE AND INTENT
On September 27, 2011 this Council adopted Ordinance No. 10119 -11 which set forth the
maximum salaries and wages of appointed officers and non - bargaining employees of the City of
South Bend for the calendar year 2012 (the "2012 Salary Ordinance "). This Ordinance amends
the maximum salaries for certain designated appointed officers and managerial level employees
of the City, and it also changes the job titles and creates one new position for certain managerial
level employees including certain executive staff positions as originally described in the 2012
Salary Ordinance.
Salaries will be paid pursuant to the budget approved by the Common Council, and the
budgeted amount to be paid may be less than the maximum amounts set forth in this Ordinance.
The changes in compensation shall be made by transfer of funds from certain accounts to other
accounts within Departments of the City of South Bend.
This Ordinance is in the best interest of the City and the affected non - bargaining
employees.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I. Amendment to Ordinance 10119 -11
The 2012 Salary Ordinance is hereby amended to change the maximum compensation amounts
for certain positions, rename certain positions, and create a new position with corresponding
maximum compensation, as set forth in Exhibit A.
Section II. Transfer of Funds
To effect the foregoing amendments, the following accounts shall be adjusted by
increase or reduction in the designated sums.

This Ordinance shall be in full force and effect from and after its passage by the
Common Council and approved by the Mayor.

Attached is Substitute Bill No 01 -12 amending South Bend's 2012 non - bargaining
employee and appointed officer salary ordinance (No. 10119 -11).
The sole amendment to Bill No 01 -12 is to change the job title "City Attorney" to
"Corporation Counsel" per Indiana Code 36- 4- 9- 6(b)(3) which requires the executive of a second
class city to appoint "a corporation counsel ". It is that appointed position for the head of the law
department whose salary is covered by Bill No. 01 -12.
