Bill No. 71 -11 — Rezoning of 3311 Mishawaka Avenue
This bill would return this property from OB zoning to its original single - family zoning.
Zoning & Annexation Chairperson Oliver Davis. With full committee opened the hearing asking for
a report from the Area Plan Commission. Christa Nayder, representing the APC, reported the
petition had no remonstrance at its public hearing where it sent a unanimous favorable
recommendation to Council.
Steve Weaver the owner /petitioner made a brief presentation, saying he had purchased a former
vacant commercially zoned home which he has redone into his own home.
With no questions Councilmember Varner motioned and Councilmember Gavin Ferlic seconded
the petition be sent to Council with a favorable recommendation. All affirmed.
Bill No. 72 -11 — Rezone Eddv Knolls Area of Eddv St. Commons
Chairperson Oliver Davis noting a substitute bill had been filed accepted a motion from
Councilmember Gavin Ferlic and a second from Councilmember Varner supported by all to
consider the substitute bill.
Christa Nayder, representing the Area Plan Commission presented a site -plan noting minor
changes from the original. She reported both the APC staff and the Commission fully endorsed
the petition.
Mike Danch representing the City of South Bend, South Bend Heritage, and the NNRO said the
petition would designate one zoning to a development which previously had five. The housing
project would call for 53 home sites for both upper and affordable homebuilders.
Tim Sexton representing Notre Dame said while there are design guidelines for the homes, all
builders can potentially participate.
Councilmember Henry Davis asked if the project would use local labor. Gary Gilot outlined steps
already taken to assure local labor would be given first consideration.
Six members of the public were present to speak for the project. Marguerite Taylor spoke to the
"affordable component' of the project. Bill Stenz, President of the Near Northeast Council said it
was a good project, along time coming. Tim Sexton, speaking as the President of the NNRO-
Board of Directors urged the committee take this final step of a long trek.
Andy Kostielny, St. Joe County Commissioner, as well as Louella Webster, a nearby resident and
Ann Puzzello, former 4th District Councilmember, also strongly supported the project.
There were no remonstrators.
On a motion by Councilmember Varner, a second by Councilmember Fred Ferlic and support
from all the bill was sent to Council favorably.
Bill No. 12 -02 — Special Exception for 918 Oliver Plow Ct.
This bill would simply allow reconfigured storage for business in Oliver Plow Ct.
Mark Lyons, representing the Board of Zoning Appeals (BZA), reported the petition had received
unanimous approval of the BZA.
Mike Danch briefly spoke to the technical reason for the petition.
On a motion by Councilmember Gavin Ferlic, seconded by Councilmember Varner and supported
unanimously the bill was sent to Council favorably.
There being no further business to come before the committee at this time, Chairperson Oliver
Davis adjourned the meeting at 3:53 p.m.
