In the above matter no.remenstrators appeared and no written remonstrances was filed. The Board therefore find that the property assessed in said roll filed 1919is benefited in the amount of assessments as shown on said assessment011 and the Board further find that the assessment roll filed 1919-and the final estimate allowed should be and the satyr are hereby in all things, ra#ifled, confirmed -and approved. • Hearing had on assessment roll and final estimate for Shoit'A. phalt pavemtp.t on Walnut Street_ from Division Street to Sample Street, under Improvement Rasolution No. 6`70. The Board 'after due consideration decided to defer this hearing until Wednesday October22ad.1919 at 7:15 P.M. City Engineer instructed to look up the frontage on the above mentioned property. -Frank Witueki appeared in regard to assessment oZ2 above imprflv'-- meat and complained %f no drain in, Walnut Street between Dunham and Fisher Street., - •Comp1ain-t- about curb broken _dpwn at 509 Walnut Street. Complaint about hole between �urb and crosswalk at Dunham and Harris Street.. Complaint about no crosswalksjat Grand Trunk Ry. Co. crossing at Walnut and Arnold Streets. Also Ford Street and!C. I. & S. Ry. and Grand Trunk Ry. Cs. The Clerk instructed to notify the Grand gunk Ry. Company and the C. I. & S. Rai. Company to place crosswalks at above mentioned places. Mr. James Judie appeared b of o're the Board in regard to the wiring of a house at 311 North Michigan Street, this property is owned by *lta Boromm and Mr. Judie represented Alta Bore= before the Beard and requested ,sped-ial :ea 0ermission to be issued permitting the wiring of t�is property to comply with wiring of like property outside of the fire limits, the sane was granted by the Board. and to be under the supervision of the City Electrician. The following assessment roll were filed by the Board. Engineer filed assessment roll and final estimate for concrete pavement on alley east of St. Louis Blvd. from La Salle Avenue to First alley north of La Salle Avenue, under Improvement Resolution N 612. In the City of South Bend, Indiana. Resolved, that notices as to` the assessments be published for six consecutive days in the South Bend Daily Tribunt,, commencing on. the 20th. day .of October 1919 stating that this Board will give a hearing on the amount of such assessment at its office in the City Hall on the 29th. day of October 1919 at 7:15 P.M. The Board ordered that notices Of such award of damages and assessments of -benef its be sertedd4cc ord ixg to law, and that a hearing be given on the 25th. day of February 1920 at 7: 15 P..M. at the office of the Boabrd in the City Hall for the purpose of hearing namonstraters and receiving remonstrance$ from any person or persons interested in said matter. The City Engineer sutbitted the ;list of property owners in the matter of the appropr iat ion of certain property under Condemnation Resolution No. 55 for the Opening of Edgewater Drive from Arch Avenue to Harper Court as shown in resolution on page 141 of this record No. S. This list iAcludes the namesof the owners and holders of property and of interests there is sought to be �aken or beneficially or injuriously affected, and the -description of the several pieces of property which is affected by the said appropriation proceedings. Thereupo, they Beard proceeded �o award the damages sustained and to assess the benefits accruing to each pied of property upon said list. It was thereupon, upon motionjduly made and seconded and unanimously adapted, ros olved that said list, together with the amounts of benefits and damages and net damages and net benefits therein set forth as to the several parcels of land be adopted and that the respective amount of benefits contained in said list be and are hereby assessed against the several tracts of land as specifically set forth in said list, and that the respective amounts of damages contain in the said 11t be and are hereby awarded to the several tracts of land specifically set forth in said list, and that the net benefits or net damaged, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or asses ed, as the case may boas to the said several tracts if land. The _Board hereby furthersets o f the benefits and damages each against the other whore both benefits and damages are assessed against the samepiece of property, tract of land or interest, sad hereby fixes said respective het benefits as the amount that shall be paid by the respective owners as benefits, and further hereby fixes the respective net damages as to the several tracts as the amount that shi 1 be pa ld to the owners of the respective tracts as d ages. A contract has. been let to the White Construction Company for the paving of Miami Street from Ewing Avenue to south City Limits. It is absolutely necessary that this improvement be completed this year and you are hereby instructed to hove the present line of poles used by the above companies joinly`from their present location to,six inches beyond the face of - the. curb line. The Engineer's stakes are already set and the poles should ail be moved east to the point six inches beyond the present stakes. The White Construction Company is ready to lay curb and gutter anal it is important that this matter will be given attention, any-mdelay .ox your part will cans-e delay to the contract in completing this wort The awarding of the contracts for the grade, curb and walks , on .Elmer Street and Main.
