DORAU This is EXHIBIT K, consisting of 3 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated Dec 12, 2017, AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. _1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: Dec 12, 2017 b. Owner: Board of Public Works, City of South Bend, Indiana C. Engineer: SmithGroupJJR Inc. d. Project: Seitz Park Reconstruction, South Bend Project No. 117-093 2. Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: 1) Perform Task 3: Documentation as previously described in Attachment A to complete Preliminary Engineering, Permitting, Final Engineering and Construciton Documents. b. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: 1) The limits of the scope of work to be included in the final construction documents has been revised per the Schematic Design deliverables. Please refer to attached Exhibit K-I that graphically outlines the limits of work. 2) SmithGroupJJR Inc. will be performing the underground civil engineering replacing the role DLZ performed in Task 1 and 2. 3) SmithGroupJJR Inc. will be subcontracting with local geotechnical firm and local dive inspection firm to complete further field investigaitons under Task 3. 4) The project documentation will be divided into two phases as follows: a) Phase 1: South Riverwalk and East Parking Entry/Parking improvements (site elements located east of the East Race and not impacted by UND Hydroelectric construction) b) Phase 2: North Rivet -walk, Seitz Park and East Race 5) SmithGroupJJR Inc. will complete up to 90% Engineering drawings for all phases of the project. Final Design & Bidding documents will proceed for Phase 1 only with anticipation to begin construction within 2019. Hydroelectric project and receipt of as -built documentation for UND infrastructure impacting final design of Seitz Park improvements. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: 1) Six hundred eighty-three thousand and five hundred dollars ($683,500) d. The schedule for rendering services is modified as follows: 1) Extend the period of professional Services for construction documents, as shown in attached Attachment B — Project Schedule Revised (dependent on UND Hydroelectric project completion). 5. Agreement Summary (Reference only) a. Original Agreement amount: $ 186,400 b. Net change for prior amendments: $ 0 c. This amendment amount: $ 683,500 d. Adjusted Agreement amount: $ 869,900 The foregoing Agreement Summary is for reference only and does not alter the terms of the Agreement, including those set forth in Exhibit C. Owner and Engineer hereby agree to modify the above -referenced Agreement as set forth in this Amendment. All provisions of the Agreement not modified by this or previous Amendments remain in effect.
