A RESOLUTION OF THE SOUTH BEND
REDEVELOPMENT AUTHORITY
AUTHORIZING THE TRANSFER OF REAL PROPERTY TO
SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the South Bend Redevelopment Authority (the "Authority") is the owner of
certain property identified herein; and
WHEREAS, pursuant to I.C. 36-1-11-8, the Authority, may transfer or exchange
property with another governmental entity upon terms and conditions agreed upon by the two (2)
entities as evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the South Bend Redevelopment Commission (the "Commission"), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department")
and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment
District"), exists and operates under the provisions of I.C. 36-7-14, as amended from time to time
(the "Act") and is a body corporate and politic; and
WHEREAS, the Department, by and through the Commission, has presented to the
Authority, a request for the transfer to the Commission of certain real property previously
Ci acquired by the Authority as follows:
628 Rush Street, as more particularly described in EXHIBIT A
310 East South Street, as more particularly described in EXHIBIT B
602 Carroll Street, as more particularly described in EXHIBIT C
(collectively referred to as the "Property"); and
WHEREAS, the Authority, desires to transfer the Property to the Commission for the
redevelopment purposes of the Commission; and
WHEREAS, the Department, through the Commission, will adopt a resolution consistent
with the requirement of Indiana § 36-1-11-8.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
1. The transfer of the following described real property situated in St. Joseph County,
Indiana:
628 Rush Street, as more particularly described in EXHIBIT A
310 East South Street, as more particularly described in EXHIBIT B
602 Carroll Street, as more particularly described in EXHIBIT C
by the Authority to the Commission, without consideration, shall be, and hereby is, approved and
authorized.
2. The Members of the South Bend Redevelopment Authority are each authorized,
respectively, to execute and attest to the execution of quit claim deeds conveying all the right,
title and interest of the Authority in and to the Property to the Commission and are further
directed to deliver said quit claim deeds to Commission for recording in the Office of the St.
Joseph County Recorder.
3. This Resolution shall be in full force and effect upon its adoption and is subject to
the passage by the Commission of a Resolution substantially identical to this Resolution.
ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana
held on December 21, 2011, at 227 West Jefferson Boulevard, Room 1308, South Bend, Indiana
46601.

Legal Description of 628 Rush Street
A part of Lot Lettered "G" as shown on the recorded Replat and Resurvey of Rush's Third
Addition to the City of South Bend, in St. Joseph County, Indiana, as per plat thereof, recorded
April 23, 1891 in Plat Book 5, page 61, which part is bounded by a line running as follows, viz:
Beginning at the Southwest corner of said Lot "G"; thence running North on the West line
thereof, a distance of 41 feet; thence East, 51 feet; thence South, 41 feet to the South line of said
Lot; thence West, 51 feet to the place of beginning.

Legal Description of 310 East South Street
A Lot or Parcel of land in the West Half of Lot Numbered Twenty-three (23) as shown on the
recorded Plat of Denniston and Fellows Addition to the Town, now City of South Bend, which
Parcel is bounded by a line running as follows, viz: Beginning on the South line of East South
Street in said City at a point 100 feet East of the Northwest Corner of said Lot 23; thence running
East 411/4 feet to the Northwest Corner of a Lot now or formerly owned by John and Susan E.
Hartman; thence South 1151/4 feet to an alley 14 feet in width; thence West 41'/2 feet to a point
due South of the beginning point; thence North 1151/4 feet to the place of beginning.

City of South Bend, Portage Township, St. Joseph County, Indiana, being platted as a part of Lot
Numbered Twenty-three (23) in Denniston & Fellows Addition, as per plat thereof, recorded in
Plat Book 2, page 48, in the Office of the Recorder of St. Joseph County, Indiana, and described
as follows: Beginning at an iron at the intersection of the East Right-of-Way line of Carroll
Street and the South Right-of-Way line of South Street; thence South 89°39'47" East (bearing
assumed), 100.00 feet along said South Right-of-Way line of South Street; thence South
00°00'00" East, 53.50 feet; thence North 89°39'47" West, 100.00 feet to the East Right-of-Way
line of Carroll Street; thence North 00°00'00" West, 53.50 feet along said East Right-of-Way line
of Carroll Street to the point of beginning.
