referenced amendment to prepare construction bid documents for the Century Center
damage inspection report in the amount not to exceed $38,400, for a new total of $49,900.

SUPPLEMENTAL AGREEMENT NO. 1
This Supplemental Agreement No. 1 is made and entered into this q day of On", 20_U),
by and between the City of South Bend, Indiana, acting by and through the Board of Public Works,
hereinafter referred to as the "Owner", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN
46615, hereinafter referred to as the "Architect -Engineer".
WITINESSETH
WHEREAS, the Owner and Engineer did, on August 28, 2018 enter into an agreement for the
Damage Inspection Investigation for the north wing of the lower level of the Century Center (Project No.
118-082 and Code cc2018)
WHEREAS, during the course of Project, certain additional services not included in the original
contract dated August 28, 2018, have become necessary; specifically:
• Preparation of Contract Documents
• Bidding Services
• Construction Administration Services
NOW THEREFORE, the Owner and the Engineer desire to amend the above referenced Design
Contract as follows:
Agreement
A. Section L01 Basic Agreement and Period of Service
1. REVISE paragraph B as follows:
B. Architect/Engineer shall complete its services within a reasonable time, or
within the following specific time period:
a. Investigative Study: September 19, 2018.
b. Prepare Draft Construction documents (CD): within 3 weeks
from Notice to Proceed from the Owner.
Prepare final CD plans within 1 week of review of Draft CD plans
by Owner.
Construction anticipated to be completed within approximately
8 weeks from award of Construction Contract by the Owner.
B. Section 7.01 Basis of Pavment--Lump Sum and hourly rate
1. REVISE paragLaph A as follows:
A. Using the procedures set forth in Paragraph 2.01, Owner shall pay
Architect/Engineer as follows:
1. A Lump Sum amount of $43,900.00, plus
2. A not to exceed amount of $6,000.00, based on hourly rate of
actual work performed.
3. Total Basis of Payment: Not to Exceed $49,900.00.
II. Part 1— Basic Services
A. Paragraph A1.01 Design Services
1. ADD paragraphs B, C & D as follows:
B. Prepare Construction documents (Lump Sum)
A. The Architect/Engineer, shall provide the following:
a. Perform on -site review of existing conditions

b. Review Owner -provide As -Built drawings of existing construction,
including original construction and sub Sequent renovations and
remodel projects within designated areas.
c. Prepare construction documents, including drawings (plans,
sections, interior elevations, schedules and details) and technical
specifications for identified corrective work.
i. Documents will be based on As -Built design documents, including
configuration, construction and finishes of impacted areas prior to
damaged conditions.
d. Prepare opinion of probable construction cost associated with
corrective actions.
e. Prepare draft construction documents for Owner's review and
comment
f. Prepare Final Construction Document and Specifications as a single
set of documents to allow for competitive bidding per State of
Indiana requirements for Public Works Projects. Documents shall be
signed by a professional Architect/Engineer within the State of
Indiana.
C. Bidding Services (if required)
A. The Architect/Engineer, shall provide the following:
a. Assist Owner with Advertisement for Bid or Quotation.
b. Release Documents for Bid/Quote.
c. Coordinate distribution through a local web -based plan room (i.e.,
ARC Document Solutions).
d. Assist Owner and facilitate Pre -bid meeting with prospective
Bidders, if applicable.
e. Response to prospective bidders' questions via Addendum.
f. Issue Addenda, if applicable.
g. Attend Bid Opening, if applicable.
h. Review received Bids and confirm bid proposals.
i. Attend meeting and prepare recommendation for Award of
Construction Contract, if requested.
j. Assist the Owner in filing Contract Documents to receive State
Release permits, if required.
D. Construction Administration Services
A. The Architect/Engineer, shall provide the following:
a. Attend pre -construction meeting.
b. Review shop drawings and submittals related to the design.
c. Respond to Contractor's request for information that may arise
related to architectural and engineering design.
d. Review Contractor Payment Applications, review work
completed and provide recommendation for payment.
e. Perform Substantial Completion Inspection and issue Certificate
of Substantial Completion.
f. Assist Client with Project Closeout.
g. Provide one (1) final inspection of work

Ill. Part 2 — ADDITIONAL SERVICES
A. Paragraph A2.01.1.A., REPLACE with the following:
A. On -Call Construction Phase Services:
1. Perform as -needed on -site observation of construction conditions to
facilitate responses to unanticipated conditions discovered during
construction activities, only at Owner's authorization and direction.
B. Delete item 1,8;
C. Delete item 1,C;

A. Replace Exhibit A.1, to reflect project area including the reference to the Damage

VI. Amendment:
This Supplement Agreement No. 1 increases the current contract fee of $11,500.00 by $38,400.00, to a
total contract amount of $49,900.00 and incorporates all other terms and conditions as set forth in the
original Agreement dated August 28, 2018. The original Agreement, dated August 28, 2018, shall remain
in full force and effect, except as herein modified.
The undersigned attests, subject to the penalties for perjury, that he is the contract party, or that he is
the representative, agent, member or officer of the Engineer that he has not, nor has any other member,
employee, representative, agent or officer of the firm, company, corporation or partnership represented
by him, directly or indirectly, to the best of his knowledge, entered into or offered to enter into any
combination, collusion of agreement to receive or pay, and that he has not received or paid, any sum of
money or other consideration for the execution of this Contract other than that which appears upon the
face of the Contract.
