Home My WebLink About12/11/07 Board of Public Safety Minutes~~~ PUBLIC AGENDA SESSION DECEMBER 11.2007 The Board of Public Safety met in the Public Agenda Session at 8:03 a.m. on Tuesday, December 11, 2007 with President Donald Alford. Board Members Juanita Dempsey, Patrick D. Cottrell, Bruce J. BonDurant, and Jack Reed were present. Also present were Police Chief Thomas Fautz, Fire Chief Howard Buchanon and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13`" Floor, County City ' Building, South Bend, Indiana. Board members discussed the following items from that list: -Addition to the Agenda Mr. Bodnar noted the addition of an Amended Resolution No. 43-2007, establishing the 2008 holiday schedule for the South Bend Police Department. Section III of the Resolution lists the holidays for officers assigned to the South Bend Community School Corporation. Mr. Bodnar stated this was not included in the original resolution. These officers follow a different holiday schedule from the rest of the Police Department, and that schedule is based on the school corporation's teacher's holiday schedule. Those officers assigned to the school corporation get two extra holidays. - Retirements -Police Department Chief Fautz noted that ten retirements in the Police Department are a result of the Drop Program. He stated the program is a good idea, even though it creates a large number of vacancies at once. - Letter of Understanding -Police Department Mr. Bodnar stated that the original Letter of Understanding was agreed upon on June 11, 2007, sent out to various parties for approval, and lost in the process. The Letter has now been re-done with the original terms addressing the amount of the insurance rebate for those officers not using the City's insurance, and the dates of the School Resource Officer's holidays, which is also addressed in the amended Resolution No. 43-2007. ACCEPT MINUTES OF PREVIOUS MEETINGS Upon a motion made by Mr. BonDurant, seconded by Mr. Cottrell and carried, the minutes of the Public Agenda Session, Executive Session, and Regular meetings of the Board held on November 27, 2007 were approved. POLICE DEPARTMENT ACCEPT AND APPROVE RETIREMENT -CORPORAL DAVID JELINSKI President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Corporal David Jelinski effective December 26, 2007. In his letter, Chief Fautz noted that Corporal Jelinski is retiring in good standing after serving for the last thirty-three (33) years and one (1) month. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVERETIREMENT -CORPORAL ROBERT BADOWSKI ' President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Corporal Robert Badowski effective December 31, 2007. In his letter, Chief Fautz noted that Corporal Badowski is retiring in good standing after serving for the last thirty-two (32) years and sixteen (16) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -SERGEANT ARTHUR DEAK President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Sergeant Arthur Deak, effective December 24, 2007. In his letter, Chief Fautz noted that Sergeant Deak is retiring in good standing after serving for the last thirty-four (34) years, and eight (8) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. ACCEPT AND APPROVE RETIREMENT -SERGEANT THOMAS MAMMON President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Sergeant Thomas Mammon, effective December 21, 2007. In his letter, Chief Fautz noted that Sergeant Mammon is retiring in good standing after serving for the last thirty-three (33) years, six (6) months, and fourteen (14) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -CHIEF RICHARD KILGORE President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Chief Richard Kilgore, effective December 28, 2007. In his ' letter, Chief Fautz noted that Chief Kilgore is retiring in good standing after serving for the last thirty-six (36) years, and eight (8) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -CAPTAIN JOHN WILLIAMS President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Captain John Williams, effective December 25, 2007. In his letter, Chief Fautz noted that Captain Williams is retiring in good standing after serving for the last thirty-four (34) years, nine (9) months, and twelve (12) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -LIEUTENANT DONALD KUZMITS President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Lieutenant Kuzmits, effective December 31, 2007. In his letter, Chief Fautz noted that Lieutenant Kuzmits is retiring in good standing after serving for the last thirty-four (34) years, and fifteen (15) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RETIREMENT -LIEUTENANT PAUL W. BRADFIELD III President Alford advised that Chief Thomas Fautz has submitted to the Board the Application and Declaration for Retirement for Lieutenant Paul W. Bradfield III, effective December 28, 2007. In his letter, Chief Fautz noted that Lieutenant Bradfield is retiring in good standing after serving for the last thirty-two (32) years, and thirteen (13) days. Chief Fautz joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. ACCEPT AND APPROVE RETIREMENT -CHIEF THOMAS FAUTZ President Alford advised that Mayor Stephen Luecke has submitted to the Board the Application and Declaration for Retirement for Chief Thomas Fautz, effective December 28, 2007. In his letter, Mayor Luecke noted that Chief Fautz is retiring in good standing after serving for the last thirty-four (34) years, five (5) months, and five (5) days. Mayor Luecke joined the Board in thanking him for his years of distinguished service to the South Bend Police Department and the citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and approved. Board President Donald Alford asked Chief Fautz if he would like to say a few words before the Board continued with the agenda. Chief Fautz stated he would like to thank the Board for their help over the last five (5) years. He noted that a lot of times people don't understand why things are done the way they are, but the Board has done a good job of administering the rules and regulations of the Police Department. Mr. Cottrell stated he was on the Police Department when this group of retirees came on, and in his twenty-some years on the department this is the best group to come on. He noted that he worked with Chief Fautz when he was an officer of the Police Department, and he was a great officer and continues to be a great leader. He stated that he hopes to get a Chief that takes the Department in the same direction Chief Fautz is going, and thanked Chief Fautz for the great job he has done. APPROVE LETTER OF UNDERSTANDING Mr. Bodnar requests the Board's approval of a Letter of Understanding between the City of South Bend and the Fraternal Order of Police concerning the holiday schedule for Police Department School Resource Officers, and the amount of rebate for officers using another health care provider instead of the City's health insurance. The holiday schedule was amended in amended Resolution No. 43-2007 to provide for a separate holiday schedule for those officers's working in the school system. The Letter of Understanding regulates the amount of rebate to be $92.50 per pay period for the remainder of 2007 for those officers's not using the City's health insurance, under Article 20, Section 6 of the Working Agreement of the Police Department. APPROVE AMENDED RESOLUTION NO.43-2007 In a Memorandum to the Board, Mr. Tom Bodnar, Board Attorney, requests the Board approve the following amended resolution regarding Police Department holidays. The amended resolution addresses the issue of holidays for South Bend Police Department School Resource Officers. These officers follow a holiday schedule based upon the South Bend teacher's holiday schedule. Although they don't have as many holidays as the teacher's, they do have two more days than the regular Police Department holiday schedule. This was missed in the original Resolution No. 43-2007. Upon a motion by Mr. Cottrell, seconded by Ms. Dempsey and carried, the following amended Resolution was approved by the Board of Public Safety: RESOLUTION NO. 43-2007 AMENDED RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING THE 2008 HOLIDAY SCHEDULE FOR THE SOUTH BEND POLICE DEPARTMENT WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is empowered by law to establish rules and regulations for the South Bend Police Department; and WHEREAS, it is in the interest of the City of South Bend that the Police Department holidays be set with certainty. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of South Bend: 1 1 1 SECTION I. SECTION IV. To be eligible for a Critical Duty Day stipend, the Officer must either work the entire shift or have suffered an injury on the job which prevents working the entire shift. Any Officer who works recall on a Critical Duty Day, whether voluntary or required, shall receive in addition to overtime pay the normal Critical Duty Day stipend.
