Michigan Street, South Bend, Indiana, Floors 1, 2, 4, 5, 9 and 11 to 14, and which is more particularly described as follows: Lot 47 40' W Cor & Vacated Alley W & Adj & W 40 X 54' Lot 48 Ex Sw Cor O P So Bend; Lots 47 & 48 Ex W 40' Original Plat So Bend; and 42.18 Ft E End Lot 58 & 19.05 X 42.36 Ft N E Cor Lot 57 O P South Bend and which has Key Numbers 18-3003-0054; 18-3003-0056; and 18-3003-0044, as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrance's and objections from interested persons; and WHEREAS, the Council has determined that the qualifications for an economic revitalization area have been met. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for Real property tax abatement only and is limited to two (2) calendar years from the date of adoption of the Declaratory Resolution by the Common Council. SECTION II. The Common Council hereby determines that the property owner is qualified for and is granted Real property tax deduction for a period of 9 years, and further determines that the petition, the Memorandum of Agreement between the Petitioner and the City of South Bend, and the Statement of Benefits comply with Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code 6-1.1-12 et se . Michigan Street. Also attached is a copy of the petition, Statement of Benefits form, and supporting information. The report contains the Department's findings relative to the above petition. The petitioner, Key SB, LLC (The Hinman Company) proposes to renovate portions of the Key Tower Building in order to accommodate a new tenant, Bakers & Daniels. The total cost of the renovation work is estimated to be $5,951,680. Please Note: The application includes a request for a waiver for part of the renovation work that has already received two building permits. All of the work authorized under one of those permits has been completed. Key SB, LLC is seeking a ten (10) year real property tax abatement, and a representative of Key SB, LLC will be available to meet with the Committee on Monday, May 14, 2007. Michigan Street was filed with the City Clerk by Key SB, LLC (The Hinman Company). Please Note: The application includes a request for a waiver for part of the renovation work that has already received hvo building permits. All of the work authorized under one of those permits has been completed. Pursuant to Chapter 2, Article 6, Section 2-82 of the Municipal Code of the City of South Bend, this petition was referred to the Department of Community and Economic Development for purposes of investigation and preparation of a report determining whether the area qualifies as an Economic Revitalization Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements have been met. The Department of Community and Economic Development has reviewed the petition, investigated the area, and makes the following report. PROJECT SUMMARY The rehabilitation project includes interior office space remodeling and exterior renovation to the Key Tower Building as well as renovation to the adjacent Plaza .Courtyard. The office space remodeling includes the build out of 32,952 sq. ft. on the 11`n, 12`n, 13`n and 14`n floors for the new tenant, Bakers & Daniels. It also includes the build out of 3,300 sq. ft. of office space on the 9`n floor, necessary to relocate tenant, Stiffel, Nicolaus & Company, for the B&D move in. Finally, the ground floor lobby of the building will be renovated to provide additional and improved entry space. Exterior renovations include installing new "Key Bank" and "Baker & Daniels, LLC" signage near the top of the building, the addition of facade and coloring to the building and installing an awning to the north side of the building. The Plaza Courtyard improvements will include a green space. These South Bend Common Council RE: Tax Abatement for Key SB, LLC (The Hinman Company) May 1, 2007 Page 2 renovations are all necessary to bring the Key Tower Building to class "A" space and make it possible for Baker & Daniels to be a long term tenant in the downtown South Bend Building. A total of $5,951,680 will be invested in the project. Please note that two building permits (Nos. 105995 and 106222), valued at $477,000, have been issued for a portion of the renovation work. The work authorized under Permit No. 105995 has been completed. The permits are for work on the 2"d, 4th and 5th floors. The work under both permits is ineligible for a tax abatement, however, the applicant is requesting the Common Council to waive the Condition Precedent requiring approval of the abatement application prior to obtaining a building permit and approve the abatement application with this work included. If the waiver request cannot be approved the applicant is requesting the Common Council to approve a tax abatement without the waiver in the amount of $5,474,680. If the waiver is approved total taxes to be abated during the nine (9) year abatement period are estimated at $1,012,426. Total taxes to be paid during the nine (9) year abatement period are estimated at $824,636. If the waiver is not approved total taxes to be abated during the nine (9) year abatement period are estimated at $931,283. Total taxes to be paid during the nine (9) year abatement period are estimated at $758,548. EMPLOYMENT IMPACT Per the petition, it is estimated that the total project will create four (4) new, permanent, full-time jobs in the first year of production representing a new annual payroll of $406,000. The project will also maintain 49 existing, permanent full-time jobs representing an annual payroll of $2,986,470. ABATEMENT QUALIFICATION 1. A review of the tax abatements previously granted finds that the petitioner has not been granted or associated with any previous tax abatements: 2. The Building Commissioner has reviewed the petition and finds the property to be properly zoned for the proposed project. As noted the Commissioner has found that two (2) building permits have been issued for a portion of the total work. 3. A review of the South Bend Redevelopment designation areas finds that the property is located in the Central Development Area, which is a Tax Incremental Allocation Area; therefore, the petition for real property tax abatement must first be approved by the South Bend Redevelopment Commission. 4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner does meet the qualifications for nine (9) year real property tax abatement under Section 2-82, Office Rehabilitation -Central Business District for work valued up to $5,474,680. If the two building permits had not been pulled the total value of the work would be $5,591,680.
