RESOLUTION NO. 979
A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, I.C. 6 -1.1- 12.1 -2(j) provides that an application for
property tax deduction may not be approved when the property is
located in an allocation area as defined in I.C. 36- 7- 14 -39, unless
the Redevelopment Commission which designated that allocation area
adopts a resolution approving that application; and
WHEREAS, the South Bend Common Council has received a petition
for ten years of real property tax abatement consideration from
Historic Dunbar Corner Partnership, L.P., for real property located
at 128, 130 -132, 136 and 146 LaPorte Ave. and 902, 906 and 910 -912
W. Colfax Ave. in the West Washington- Chapin Development Area, the
legal description of which is attached hereto, marked Exhibit "A"
and incorporated herein; and
WHEREAS, this Commission declared the West Washington- Chapin
Development Area by Resolution No. 818 adopted October 23, 1987,
and in the same resolution declared the West Washington- Chapin
Allocation Area (South Bend Allocation Area No. 7); and
WHEREAS, the property located at 128, 130 -132, 136 and 146
LaPorte Ave. and 902, 906 and 910 -912 W. Colfax Ave. is located
within the West Washington- Chapin Allocation Area (South Bend
Allocation Area No. 7);
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
1) The Commission finds that the application for Historic
Dunbar Corner Partnership, L.P., for ten years of real property
tax abatement consideration for property located at 128,
130 -132, 136 and 146 LaPorte Ave. and 902, 906, and 910 -912 W.
Colfax Ave. in the West Washington- Chapin Allocation Area
(South Bend Allocation Area No. 7) is hereby approved.
2) That a copy of this resolution be forwarded to the
South Bend Common Council to indicate the Commission's approval
of the Historic Dunbar Corner Partnership, L.P., petition for
real property tax abatement.
Approved this 22nd day of February, 1991, at the regularly
scheduled meeting of the South Bend Redevelopment Commission.

The land referred to is located in the County of St. Joseph,
State of Indiana, and described as follows:
Beginning at the Southeast corner of Lot Numbered Seven (7) as
shown on the recorded Plat of Dunbar and Company's Subdivision
of Bank Out Lot Numbered Thirty -one (31) and the Northwest
corner of Bank Out Lot now City of South Bend, as platted by
the State Bank of Indiana; running thence North on the West
side of an 8 feet alley, 56.4 feet to a point distant South
141.8 feet from the South boundary line of Colfax Avenue;
thence South 86 degrees and 50 minutes W -st, 59 feet to the
Easterly boundary line of LaPorte Avenue; thence South
39 degrees and 20 minutes East, with the Easterly line of said
Avenue 69 feet to the North Side of an East and West alley on
the South side of Lot Numbered Seven (7) of said Dunbar and
Company's Subdivision; thence East with the North boundary line
of said alley to the plance of beginning, and being a part of
Lots Numbered Six (6) and Seven (7) and said Dunbar and
Company's Subdivision. Commonly known as 128 LaPorte.
Parts of Lots Numbered Six (6) and Seven (7) as shown on the
recorded Plat of Dunbar and Company's Subdivision of part of
Bank Out Lots Numbered Thirty -one (31) and Thirty -two (32) in
the First Plat of Out Lots of the Town, now City, of South
Bend, platted by the State Bank of Indiana, described as
beginning at a point on the East line of Lot Numbered Seven
(7), Forty -nine and Five - tenths (49.5) feet South of the
Northeast corner of said Lot Numbered Seven (7); running thence
West One Hundred Thirty -six (136) feet, parallel with Colfax
Avenue, to the Easterly line of LaPorte Avenue, Fifty -five (55)
feet; thence Easterly One Hundred One and Seven - tenths (101.7)
feet to a point Thirty -two (32) feet South of the place of
beginning; thence North to the place of beginning, in the
Office of the Recorder of St. Joseph County, Indiana, in Plat
Book 2, page 33. Commonly known as 136 LaPorte.
All of Lots Numbered Six (6) and Seven (7) as shown on the
recorded Plat of Dunbar and Company's Subdivision of Bank Out
Lot Thirty -two (32) of the First Plat of Out Lots of the Town,
now City, of South Bend, in Joseph County, Indiana, platted by
the State Bank of Indiana, excepting therefrom the following
described tracts or parcels of land, viz:
1st: A lot or parcel of land 99 1/2 feet in width,
North and South, taken off of and from the entire width of the
North ends thereof.
2nd: Beginning at the Southeast corner of said Lot
No. 7; thence North on the West side of an 8 foot alley, a
distance of 56.9 feet; thence South 860 50' West a distance of
59 feet to the Easterly line of LaPorte Avenue, in said City;
thence Southeasterly along the said Easterly line of said
LaPorte Avenue, a distance of 69 feet to the South line of said
Lot No. 7; thence East along the South line of said Lot No. 7,
a distance of 13 112 feet to the place of beginning.
3rd: Beginning on the East line of said Lot No. 7, at
co a point 99 1/2 feet South of the Northeast corner thereof;
thence West 136 feet to the Easterly line of said LaPorte
Avenue; thence Southeasterly along Easterly line of LaPorte
Avenue, a distance of 55 feet; thence Easterly 101.7 feet to a
point on the East Line of said Lot No. 7, a distance South
32 feet from the place of beginning; thence North a distance of
32 feet from the place of beginning. Commonly known as 130 -132 LaPorte.
Subject to legal highways.
Lot Numbered Eight (8) as shown on the recorded Plat of Dunbar
and Company's Subdivision of Bank Out Lots Numbered Thirty -one
(31) and Thirty -two (32) of the First Plat of Out Lots of the
Town, now City, of South Bend platted by the State Bank of
Indiana, excepting a parcel of land Thirty -eight (38) feet wide
taken off of the South end of said Lot Numbered Eight (8),
recorded in the Office of the Recorder of St. Joseph County,
Indiana, in Plat Book 2, page 33. Commonly known as 906 W. Colfax.

and Company's Subdivision of Bank Out Lots Numbered Thirty -one
(31) and Thirty -two (32) of the First Plat of Out Lots of the
Town, now City, of South Bend, platted by the State Bank of
Indiana, recorded in the Office of the Recorder of St. Joseph
County, Indiana, in Plat Book 2, page 33. Commonly known as 902 W. Colfax.
A part of Lots Numbered Six (6) and Seven (7) as shown on the
recorded Plat of Dunbar and Company's Subdivision of Bank Out
Lots Numbered Thirty -one (31) and Thirty -two (32) of the First
Plat of Out Lots of the Town, now City, of South Bend, platted
by the State Bank of Indiana, recorded in the Office of the
Recorder of St. Joseph County, Indiana, in Plat Book 2,
page 33, which part is bounded by a line running as follows,
viz: Beginning at the Northwest corner of said Lot Numbered
Six (6); thence running East on the South line of Colfax Avenue
(formerly Market Street), to the Northeast corner of said Lot
Numbered Seven (7); thence South on the West line of an alley
Three (3) rods; thence West Parallel with the North line of
said lots, to the Easterly line of LaPorte Avenue in said City;
thence Northwesterly along the Easterly line of said Avenue, to

(32) in the State Banks First Addition to the Town, now
City of South Bend, Indiana, recorded in the office of
the Recorder of St. Joseph County, Indiana, in Flat Book
2, page 33. Commonly known as 906 W. Colfax.
