A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION AUTHORIZING THE TRANSFER OF
REAL PROPERTY TO THE CITY OF SOUTH BEND
BOARD OF PUBLIC WORKS
WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") has
custody of and may maintain and dispose of all real property owned by the City of South Bend,
Indiana (the "City ") pursuant to I.C. 36- 9 -6 -3; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may
transfer or exchange property with another governmental entity upon terms and conditions agreed
upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of
each entity; and
WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ") and
of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District "),
exists and operates under the provisions of I.C. 36 -7 -14, as amended from time to time (the "Act ")
and is a body corporate and politic; and
IL WHEREAS, the Department, by and through the Commission, desires to present to the
Board, a request for the transfer to the Board of certain real property previously acquired by the
Commission commonly known as the Kizer House and more particularly described at Exhibit A
(the "Property "); and
WHEREAS, the request provides that the Board will then transfer the Property to Historic
Landmarks Foundation of Indiana, Inc. ( "HLFI "), a non -profit corporation whose charter or articles
of incorporation allows the corporation to take action for the preservation of historic property; and
WHEREAS, the City, through the Board, desires to accept the transfer of the Property from
the Department and thereafter, to transfer the property to HLFI; and
WHEREAS, the Board has adopted or will adopt a resolution consistent with the
requirement of Indiana § 36- 1 -11 -8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH
BEND DEPARTMENT OF REDEVELOPMENT, AS FOLLOWS:
1. The transfer of the Property described at Exhibit A situated in St. Joseph County,
Indiana, by the South Bend Redevelopment Commission to the South Bend Board of Public Works
shall be, and hereby is, authorized and approved.
2. Donald Inks, a member of the Department, is appointed and authorized to act on
behalf of the Commission in executing any documents necessary to effect the intent of the
Commission, pursuant to the terms and conditions evidenced by this Resolution.
3. This Resolution shall be in full force and effect upon its adoption by the Commission
and upon the adoption of a substantially similar resolution by the Board. The transfer of the
Property shall not be effective until deeds are duly recorded effecting the same.
ADOPTED at a regular meeting of the South Bend Redevelopment Commission held on
November 22, 2011, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, IN
46601.

Legal Description of the Propert y
A part of Bank Out Lot Numbered 31 and 32 of the First Plat of Out Lots of the Town, now City
of South Bend, platted by the State Bank of Indiana, which part is bounded by a line running as
follows, viz: Beginning on the North line of Washington Street (now Washington Avenue) in
said City; at a point 24 3/4 feet West of the Southeast corner of said Bank Out Lot Numbered 31;
thence running West on the North line of said Washington Avenue a distance of 70 feet; thence
North 198 feet; thence East 70 feet; thence South 198 feet to the place of beginning.
