Petition to Release Accrued Tax and Remove Property from Tax Rolls
March 2010 Tax Sale Properties

In March 2010, the Commission acquired a group of properties at the St. Joseph County
Commissioner's tax sale. Because of the length of time it took to receive tax deeds and get
those tax deeds recorded, property taxes were assessed on many of these properties.
Of this group of properties, five are in the name of the Commission (the remainder being in
the name of the Board of Public Works). To release these accrued taxes and remove them
from the tax rolls, the Auditor's Office requests a Petition to Release form be signed.
Resolution No. 2993 authorizes this action, and authorizes Don Inks to sign these forms on
the Commission's behalf.
Staff requests approval of Resolution No. 2993, to allow the removal of the accrued
property taxes and penalties on these five parcels, and to remove them from the tax rolls.

RESOLUTION NO. 2993
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION AUTHORIZING THE FILING OF
PETITIONS TO RELEASE ACCRUED TAX
AND REMOVE PROPERTY FROM TAX ROLLS
WHEREAS, the South Bend Redevelopment Commission (the "Commission "), is the
governing body of the City of South Bend Department of Redevelopment (the "Department ")
within the meaning of I.C. 36 -7 -14 (the "Act "); and
WHEREAS, the County of St. Joseph offered several properties for sale at its tax sale
conducted in 2010 (the "Sale "); and
WHEREAS, the Department was the successful bidder on the following five properties
in the Sale:

018- 3059 -2331
018- 3059 -2333
1325 S. Main
1520 S. Taylor
505 W. Indiana
1117 -1119 S. Ford
Vacant Lot on Ford
all located within the City of South Bend (the "Properties "); and
WHEREAS, the Department acquired the tax sale certificates for the Properties during
October and November, 2010, however, the Commissioner's Deeds were not recorded until
April, 2011, following the completion of the statutory process set forth in IC 6- 1.1 -24; and
WHEREAS, each of the Properties have accrued taxes and penalties assessed which may
be released upon the filing of a Petition to Release Accrued Tax and Remove Property front Tax
Rolls (the "Petition "); and
WHEREAS, the Commission desires to file a Petition with respect to each of the
Properties; and
WHEREAS, Don E. Inks is an appropriate person to be designated as the Commission's
authorized representative to sign and file a Petition for each of the Properties.

NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission, governing body of the City of South Bend, Department of Redevelopment, as
follows:
1. The Commission authorizes the filing of a Petition for each of the Properties.
2. The Commission designates Don E. Inks as its Authorized Representative for
filing such Petitions.
3. The Commission directs Don E. Inks to sign and file such Petitions and to take all
further actions necessary for the completion of the Petition process.

3, 2012, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana
46601.
