The current zoning of 947 Louise Street is Light Industrial and the requested change is to Mixed Use to make it consistent with the YMCA's other adjacent properties. The current zoning of the parcel to the north of 1145 Northside Boulevard and west of 947 Louise Street is Mixed Use and the requested change is to Community Business to allow for a reception hall (a special use for Outdoor Recreational Uses is also being applied for on this parcel). NOW THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION 1. Ordinance No. 9495 -04, is amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate located at 1145 Northside Boulevard in the City of South Bend, St. Joseph County, State of Indiana: PARCEL I: A part of the Northwest Fractional Quarter of Section 18, Township 37 North, Range 3 East, which part is bounded by a line running as follows: Beginning at a point on the Northeasterly line of North Side Boulevard in the City of South Bend, 46.9 feet Southeasterly from the point of intersection of the said Northeasterly line with the Southeasterly line of the right of way of the Grand Trunk Western Railway, said point of beginning being at the intersection of said Northeasterly line of North Side Boulevard with the Southerly line of proposed Ruskin Street; thence Southeasterly along the said Northeasterly line of said Boulevard, 50.35 feet to an angle in said Boulevard; thence continuing Southeasterly along said Northeasterly line of said Boulevard, 178.10 feet to another angle in said line; thence continuing Southeasterly along said Northeasterly line of said Boulevard, 63.79 feet to an iron stake; thence Northeasterly along a line which forms an angle of 89 °11' with the Northeasterly line of said Boulevard, 202.2 feet to an iron stake; thence Northerly along a line which forms an angle with said Southerly line of proposed Ruskin Street of 90 °, a distance of 78 feet to the said Southerly line of proposed Ruskin Street; thence Westerly along said Southerly line of said proposed Ruskin Street, 325.82 feet to the place of beginning, now within and a part of the City of South Bend. Jurisdiction: City of South Bend Requested Action: The petitioner is requesting a zone change from MU Mixed Use District and LI Light Industrial District to MU Mixed Use District and CB Community Business District to allow athletic fields and a reception hall. Land Uses and Zoning: On site: On site is a vacant industrial building and two lots, one used for recreational District uses and development standards: The MU Mixed Use District is established to promote the development of the a dense urban village environment. The regulations are intended to encourage all the elements of a traditional urban village, including: storefront retail; professional offices; and, dwelling units located either in townhouse developments or in the upper stories of mixed -use buildings. The development standards in this district are designed to: encourage a pedestrian oriented design throughout the district; and, maintain an appropriate pedestrian scale, massing and relationship between buildings and structures within the district. The CB — Community Business District is established to provide a location for high volume and high intensity commercial uses. Activities in this district are often large space users which may include limited amounts of outdoor sales or outdoor operations. Developments within the CB District shall be coordinated to facilitate vehicular and pedestrian access from nearby residential districts. Site plan description: The total affected area is just over 4 acres. The area to be zoned to CB Community Business is .2.45 acres (Parcels A & C as shown on the site plan). The area to be zoned MU Mixed Use District is 1.6 acres (Parcel B as shown on the site plan). Parcel A is open space. The only building on Parcel B is a 1,440 sq. ft. picnic shelter covering 2% of that site. Parcel C has a 7,900 sq. ft. building covering 15% of that site, and 29 parking spaces covering 52 %. On November 2, 2011, a parking variance was approved by the Area Board of Zoning Appeals to allow for the reduced parking of the proposed use on Parcel C, by sharing 108 of the YMCA's parking spaces.
