Minutes from November 21st., 192S-to December 20th., 192$-- were read and unanimously approved by the Board. Attested: - Clerk of the Board. r Wednesday February 28th., 1923. Pr sident. Board met in regular session at 7:15 P.M. All members present. Deferred hearing had on resolution for the Vacation of a ten foi t alley lying north of lots 3and 4 in Ward's Sub -Division of lot 329 and a part of lot 328 in Cottrell's First Addition, under Vacation Resolution No, 71. In the City of South Bend, Indiana. In the above matter remonstrators appeared and amended remonstra.nee°:filed by Johanna Humphrey, Leafy R. Smith and She man Metzger filed February, 27th., 1923 was read:& The Board after hearing all interested parties modified resolution by vacation said alley to a point 17,.5 feet east of the Iwest line of lot 3 and as modified declare the above described property in all things, vacated and this resolution as modified in aT1 things, ratified, confirmed "end approved. And the Board now orders that a list or roll be prepared of all owners or holders of property and oi' valuable interests therein sought tob be tkkan or to be injuriously affected which list or roll shall also describe the property beneficially affected. . Mr. E. L. Mossey agreed to ,file a deed for a proper turn at intersection of alleys. Deferred hearing had on resolution for the Opening of an alley in Duhabrs addition between Washington Avenue and Colfax Avenue under Condemnation Resolution No.- In this matter property owners appeared but this hearing deferred,until Wednesday March Ith., 19 23 at 7�:15 P.M. Hearing had on resolution for the Change of Location of a Part of Rose Street in Portage Heights Addition; under 19nndemnatten Resolution No. 71. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no remon strances was filed. The Board therefore sistain all former action taken, and declare the Bove described property in all things, condemned and appropriated for public use and this resolution in all things, ratified, confirmed and aproved The Board further ordered that the City Engineer be in- structed to prepare a roll of all owners or holders of property and of valvbale interests therein sought to be taken or to be injuriously or beneifically affected which list or roll shall also described the property benefi Tally affect affected and show the awards of damages and assessments of benefits in the above matter. Boardordered deed of Indiana Title and Loan Company for a part of Lots 27 and 26 Portage Heights Addition and approved under date of Dec. 12th., 1922 rejected as Engineer reports description is incorrect. 717 Wednesday February 28th., 1923. Continued. Hearing had on roll of awards of damages and assessments of benedits in the matter of Widening of Seeberger Drive from 115Duet, E. of Michigan Street to Fellows Street, under Condemnation Resolution No. 6a, In the City of South Bend, Inc? iana . In the :above. matter no remonstratvaetors appeared and no written remonstrance was filed. The Board therefore find that the property mentioned in said roll are benefited and damaged respettvely as shown on roll filed January 31st., 1923 and.said roll is hereby in all things ratified, confirmed and approved and all action under Condemnation Resolution No. 68. is hereby concluded. Carlisle appeared before the Board in regard to petition filed.Feburar 27th4.9 1923 for vacation of alley extending in a northerjr and southerly direction from the south side of Broadway to South Line of Lo,t No. 30 in Stull's Third Addition to City:-- Board approved said petition, and _ the followirig resolution was adopted subject , to an easement of agreement being made to provide for poles and wires.or underground conduits for public - utilities: _ copy of Petition. Gentlemen We, the undersigned property owners, petition your Honorable body to vacate the alley extending in a Northerly and Southerly direction from; the South side of Broadway Street, to the South line of Lot #30 in Stull's Third Addition to the City of South Bend, St. Jose.h County, Indiana, and lying on the west side of and adjacenet to lots 26,27,28,� and 30, in said Stull's Third Addition. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is desirable to vacate the following:- The ollowing:- The First alley west of Main Street from Broadway to the south line of lot 30 in Stull's Third Addition. The following property may be injuriously or beneficially affected by such vacation: Beginning at the intersection of the west line of Main Street and the south line of Broadway; thence south along the west lineof Main Street to the south line of lot twelve (12) in Well's Addition; thence west along the south line of said lot twelve (12) and said south line extended west to the eatt line of Lafayette Street; thence north along the east lime of Lafayette Street to the south line of Broadway; thence east, along the south line of Broadway to.the place of beginning. Notice of this resolution shall be published on the 3rd."da:y:` of March 1923 and on the loth. day of March 1923 in the South Bend News Times and Tribune. This Board at its office in the City Hall on the 28th. day of March 1923 will hear and receive remonstrances from all persons interested in or affected by these proceedings. Plane are light on property line in front of 1230 North O'bitanStreet approved. Request of Indiana Bell Tel. Co. for.per mission to place 4 inch sewer the underground dip from existing pole on Leer Street at -Indiana Avenue to the alley north of Indiana Ave me approved. Complaint about pole in driveway at 13131 Randolph Street, reported that it belongs to Iniana Bell Tel. Co, and should be moved about 2 feet east to property line. approved. Parties residing on Calvert Street near b1lin Street appeared before. the Board in regard topetition filed for light.
