All members. resent. g 9 P Mr. George Harrop appeared before the Board and took up the matter of the Board releasing money held up On Hill Street Grade, curb and Walk Imp. contract. This matter referred.to -the City Controller. i At,torn ey W. A, McInerny appeared before the Board and presented petitions as follows:8 Grade, curb and walk on Nlwood Street from Wilber St. to Johnson Street. Grade, curb and walk on NorthJahnson Street from the north line of Mayr's Mich. Avenue Addition to Elwood Avenue n the west side of street and from Humboldt, Street to Elwood Ave o on east side of street. Resiution ordered Petition filed for pavement on Randolph Street from Leer Street to Kline Street. 1. Petition filed for pavement, on E. Wayne Street from St..Louis Blvd. to Eddy Street, Petition filed for pavement on Sadie Street from Washington Avenue to Linden Avenue. All the above petitions placed on file until'a later date. Report of City Cemetery Sexton for January 1923 read and placed on file. The following communication received from W D. O'Brien read and placed on file. Sout Bend Indiana. February 3,1923. The Honorable Board of Public Works, City Hall, So,&th Bend, Ind. Dear Sirs :- I may not be able to attend the hearing which'is to be held on Februay 7th , concerning the opening of an alley in Dunbar's.Sub-Division, resolution - No. 70, and I therefore take this means of placing before you my protest against this movement. The fact that the Opening of this alley may result in the assess- ment against property owned by me and by Mr. M. O'Biren is not of great interest .to me. I object to the opening of this alley from the fact Chit I believe that it, will result in very great damage to properties directly connected with the proposed alley, and I believe that this damage would be greter than would be the benefit which would result to the City in general. Communication received from Welsbach Street Lighting Company of Chicago, Ills, in answer to letter sent in regard to gas light bids in River Park. Same read and placed on file.. Financial report of the Building Department filed. Partial estimate No. 3 allowed to Reorge Pontarelli Contractor for River Park Sewer District No. 2 at the amount of.......J2,421.12 Report of Officer Moritz on River Park Gas Lights read and placed on file, Wm. S. Moore Civil Engineer representing H. A. Wood Realty Co. appeared before the Board and took up the matter of Plat of Woodlawn Addition'to the City of South Bend, Indiana approved by the City Planning Commission under daa date of September 22nd., 1922 and referred by them to this Board for approval. The -Board unanimously refused to approve said Plat of Woodlawn Addition to the City of South Bend, Indiana, unless a street is put thru from Portage Avenue to the River. Blue prints of Plat were returned to Mr. Moore. 667 The following Resolution was adopted by the Board. COPY OF VACATION RESOLUTION NO. 72, 1923. RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA: Thai, it is desirable to vacate the following: 1. The alley running 'north and south between lots Nos. 6 & 7 in Raff's First Addition to the City of South Bend on the.East, and lots 5 and 8 R�iff's First Addition to the City of South,Bend on the West. 2. The"first alley.north of Leon Court, beginning at the East line of Kendall Street and extending to the first alley running south from said alley to be vacated. 3. The alley running North and South between Kendall Street on the East and Chapin Street and Praiiie-Avenue on the west, beginning at -a point 36 feet north of the north line of the east an West alley between Leon Court°and Stull Street and extending north to where said alley connects with Kendall Street.' 4. The alley running North and South between Chapiri:Street on the East and Catalpa and Prairie Avenues on the Westf beginning at a point 36 feet north -of the north line of the_east and west alley which lies between Leon Court and Stull Street and extending north to°a point where said alley intersects Chapin Street. 5. Leon Court from the east line cif Kendall Street eastward to the first north and south alley. 6. Kendall Street from a point 36 feet north of'the north line of the east and west alley lying between Leon Court and Stull Street to the north end of Kendall Street. 17. Chapin Street from a point 36 feet north of the north line of the east and west alley lying between Leon Court and Stull Street north to Prairie Avenue. 8. Catalpa Avenue from a point 36 feet north of the north line of the east and --west alley lying between Leon Court and Stull Street nvtlh to Prairie Avenue. 9. The alley North of Lot No. 1. Oliver's First Addition, extending from Prairie to Kendall Street. 10. Stull Street from the east line of Catalpa Avenue to- the west line. of Kendall Street. 11. Garst Street from the east line of Chapin Street to the west line of Kendall Street. The following property may be injuriously or beneficially effected by such vacation: Beginning at the intersection of the center line of Indiana Avenue nd the center line of the first, alley west of Catalpa Avenue; thence north along the center line of said alley west of Catalpa Aveme and said alley extended north to the censer of Leon Court; thence east along the center line of Leon Court to the first alley west of Catalpa Avenue; thence north along the alley west of Catalpa Avenue to the first alley north of Leon Court; thence west along the first alley north of Leon Court to the west line of Prairie Avenue; thence north to the cen-ter line of Garst Street; - thence east along the center line of Garst Street tothe ist. alley west of Chapin Street; thence north along the alley west of Chapin Street to Sample Street; thence east, along Sample Street to the center line of Scott Street extended north; thence south along the center line of Scott. Street extended north and Scott Street to the center line of the right of way of the St. Joseph, South Bend and Southern R. R. Co. thence west along the center line of said right of ve to the first alley west of Scott Street; thence south along the first alley west of~ Scott Street to the center line of Indiana Avenue thence west along the center line of Indiana Avenue to the place,of beginning. Notice of this resolution shall be pub ed_on the 7.th. day of Feb. 1923 and on the 14th. day of Feb. 1923 in the South Be ffibune and News Times, This Board, at its office in the City Hall on the 7th.'day of March 1923 at 7:15 P.M. will hear and receive remonstrances from all persons interested in or affected by these proceedings.
