Hearing given on Condemnation.Resolution No. 69 for the Widening of Fellows Stre6t'.fbeginning at the northwest, corner -of lot one (1) in Riverside Tearace Addition; and running _thence north on the west line of said tot..One (1.) produced. north one hundred_ fifteen and.five tenths (115,5) feet to -the south line of Division Street; thence west twenty (20) feet;- thence south one hundred fiftyen and five tenths (115.5) feet to a point west of beginning;, thence east twenty (20) feet'.to the place of beginning., in the City of south Bend, Indiana. Hearing had on awards of damages and assessment of benefits in the matter -of Condemnation of land for the Relocation of Catalpa Avenue and Chapin Street from Bruce Street to Calvert Street, under Condemnation Resolution No. 65 in the City of South Bend, Indiana described as follows, to -wit: - Condemnation of -land-for the relocation of Catalpa A venue and Chapin Street in Kemble's Addition: CHAPIN STREETr Beginning at -a point on the south line of Lot 9 Kemble's Addition 9.92-feet easts of the south west cover of said lot 9, thence in a northerly direction along a eurve�to the right, with a�rerdius of 283.44 feet a distance of 115.23 feet) thence northerly along a curve to the,left with a radius bf 233.84 feet. a distance of•94.84 feet to a point in the north line of lot one (1) Kemble's Addi- tion;.which point is .33 feet east of the northwest corner of said lot one (1) thence east along the north line of said lot one (1) 50 feet thence in a southerly direction along a curve to the right, with a radius of 233.35 feet a distance of 115.21 feet; thence southerly along a -curve to the left with a radius of 283.79 ..feet; a distance of 94.81 feet to a point in the south line of lot 5 Kemble's Addition; thence west 50 feet: to the place of beginning. CATALPA AVENUE: Beginning at a point on the south line of lot 11, Kemble's Addition 58.18 feet west of the south east corner of said lot 11, thence northerly along a curve to the right,,with a radius_ of 297.01 feet a distance of 116.87 feet; thence in a northerly direction along a curve to the left, , with a radius of 236.<' feet, a distance of 92.99 feet to the north line of lot 3 Kemble's Addition; thencd° east.17.18 feet to the north east corner of lot 3, thence south along the east line of lots 31 6 and 11 Kemble's Addition to the southeast corner of lot 119 thence west 58.18 feet to'the place of beginning. -All as given under Condemnation Resolution No. 65 in the,City of South Bend, St. Joseph County,' State of Indiana. Ili the above matter remonstranors appeared and Attorney Obenchain representing Kovach and Kish appeared and 'fob jected fur i,heY to amount .of damages allowed Koch and Kish for property taken but: no further written remonstrance was filed. Tie Board after du# consideration over -ruled said written remonstrance of_January 24th.9 1923 filed by Attys. Jones, Montgomery and Obenehain for Louis E. Kovach and Joseph Kish and find that the properties in said roll filed November 21st. 1922'are benefited and damaged respectively as -shown on said roll and hereby in all things ratifigd, confirm and approved: said roll and all action under Condemnation Resilition No.,65 adopted October llth., 1922 is hereby concluded. Thereupon, the Board proceeded to award the damages sustained nd to assess the benefits accruing -to tGk each piece of property upon said list. It wad thereupon, upon motion duly made and seconded and unanimousl adopted, resolved that said list,;together with the amounts of benefits and damages and net damages and net benefits therein set forth as to the -several parcels of land be adopted and that, the respective amount of benefits contained in said list be and are hereby assessed.against the several tracts of land as specifically set forth in said list and that the respective-amountsof damages contained in the said list be and are hre y awarded to the several tracts of land specifically set, forth .in said list, and that the bent benefits and net damages as the case may be as to the respective tracts of, land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land. .The Board hereby further sets off the benefits and damages each, against the other where both benefits and damages are assessed against the same piece of property, tract or land or interest, and hereby fixes the said respective net, bane- fits.as the amount that shall be paid by the respective owners as benefits, and further hereby gixes Ahe respective net damages as to'the several tracts as the amount, that shall be paid to the owners of the respective tract as damages. . Thereupon, upon motion duly made and seconded and unanimously adopted the 28th. day of Fenruary 1923 at 7:15 P.M. was fixed -as -the day on which this Board will receive or°hear remonstrances from persons with regard to the amount of their respective awards or assessments, and the Clerk of this Board was istructed to prepare and cause to be duly and legally given, notices to the.awnert<>offeach parcel of property, showing the amount of the assessments or award, with a description of,the property affeete nd the date of said hearing.
