Representative of the Chamber of Comeree appeared before the Board and requested that permission be granted to the C4olden `Eagle Inn_on -South Michig%n Street to place an electric sign -over -the sidewalk at entrance to Golden Eagle Inn.' Same refused, a Hearing haden roll of awards of damages anal assessments of bene- fits for the Condemnation of Land for the relocation of Catalpa Avenue and Chapin Street from Bruce'St eet to Calvert' Street, under.Candemnation Resolution No. 65, in the City of South;Bend, Indiana, Upon said hearing Attorn#7-0benehain representing Kovach and Kish appeared with Mr. Joseph Kish, .Jr. ,and filed'a written remonstrance. BEFORE THE BOARD OF PUBLIC -WORKS OF THE CITY OF SOUTH BEND In the matter of the Relocation of ) Catalpa Avenue.under Condemnation REMONSTRANCE Resolution Number 65. Louis E. Kovash and Joseph Kish Jr. remonstrate against the sward of damages and the assessment of benefits in the above entitled proceedings and for their ground of remonstrance say: FIRST: That on September 5th. 1922s they executed a certain contract for the sale of the West Thirty-fourN)j feet of the Eas:L one hundred and twos (102) feet of lot numbered Six (6) and Eleven (11) in Kerr ble's Addition to the Town of Mylery now a part of the City of South Bend, and that on said day and by virtue of said land contract, the West thirty-four (34) feet of said East one hundred and tw#o (102) feet became and was detached and severed from the remainder of said One hundred and two (102) feet of said lots; that said purchases Fabian Kalos$ar and Rosa Kalosaar, were under and by virtue of said contract of purchase in actual possession of said West Thirty-four ( 4) feet from and after said September 5th.1 1922; that the East Sixty-eight (6m. 8� feet of said One hundred and two (102) feet of said lot Six and eleven (11) are or will be under this condemnation proceeding, destroyed for residential purposes; that the frontage of said Sixty-eight (68) feetremaining on Calvert Street after said condemnation is made effectual will be fourteen (14) feet; that the effeet.of such condemnation will be to give these remonstrance a long frontage for improvement assessments without any adequate land for improvements and developement; that the cost of curb_, walk, grade, sewer and pavement will far exceed the value of the remainder of said Sixty-eight (68) feet even after such improvements are put in. SECOND: That the award of damages as to the,land owned by these Parties in lots Numbered Six (6) and Eleven (11) in said Addition is too small; that the assessment of benefits as to the land owned by these remonstrants in lots Numbered Six (6) and Eleven (11) is toes large. Also: The vacation of a part of Chapin Street and Catalpa Avenue from Bruce Street to CatNAP , Straert,under Vacation Resolution No. 68. In the City of South Bend, Indiana. In the above matter Joseph Kish. Jr. and Attorney Obenchain present but no written remonstrance filed. The Board after hearing all interested parties deferred the hearing on this roll until Wednesday January 31st., 1923 at. &;15 P.M. - Wednesday January 24th., 1923, Continued. Nearing given on Condemnation Resolution No. 68 for the Widening of Seeberger Drive from a point one hundred fifteen feet, east of Michigan Street to Fellows Street , in, tip -,,C- -ty of -,South.Bond- �ndx In the above matteb Mr. Mark War.lich appeared and objected and filed written remonstrance. The Board therefore being fully advised and -hearing all parties inter osted ever-ru&ed said written remonstrance and sustain all former action taken, and declare the above described property in all things, a*Adamned and"appropriated.for`', public use and this resolution in all things, ratified, confirmed and approved. The Board further ordered that the City Engineer be instructed to prepare a roll of all owners or holders of prmpertyand of valuable interests therein sought to be taken or to be -injuriously affected which list, or roll shall also describe the pro- perty beneficially affected and" show the awards of damages and assessments of benefits in the above matter. Hearing had on resolution for pipe sewer on Seeberger Drive from Michigan Street -to Fellows. -Street, under Improvement Resolution No. 1087 , in the City of South Bend, Indiana. Upon said,._hee,ring no remonstrators appeared and no written remonstrance was filed. A d the Board being fuliy advised in the premises, decides that the benefits to property liable to be assessed for said improvement are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby in all things, ratified, confirmed' qnd approved. Resolved further, that notices be published on the 26th. day of January 1923 and on the 2nd day of Fehruary!923 in the South Bend News Times and Tribune, in this City, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. Tuesday February 13th., 1923. The Board reserves the right to reject any and all°bids. o Hearing given on roll of awards of damages and assessments of benefits, in the matter of the Vacation of alley north of Navarre Street from Main Street to first alley east of Main Street, also from Michigan Street to lst. alley west of Michigan Street under Vacation Resolution No. 67. In the City of Soubb Bend, Indiana. In the above matter no remonstrators appeared and no written remonstrance was filed. The Board therefore declared that the above mentioned roll filed October 31st., 192 Is a in all things ratified, confirmed and approved and these proceedings closed. the following roll approved. LOCAL SEWER IMPROVEMENT RESOLUION NO. 1089, Resolved by the Board of .public Works of the City of' South Bland, County of St. Joseph, State of Indiana. That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted-for-reeeiving sewerage from collat4ral drains, be and the same is hereby ordered in and along Bak Paark Court from Miami Street to the first alley west of Marine Street as follows, to -wit: - Beginning at the intersection of the center line of Miami Street and.
