Beard met in regulhr session at 9:00 A.M. All members present,
Councilman Sid Thornton appeared before the Bearer and
requested permission to have St. Peter Street and Notre Dame Avenue
at La Salle
Avenue closed during the coasting period. This natter referred
to the Safety Board
Upon raquest of the Building Commissioner

Mr. A. Colpeart of Colpeart Realty Company, )Ar. Wolfe of River Park
Civic Club and Mr. Bidder appeared before the Board and the matter of River Park
Trunk sewer District No. 3 was discussed.
Mr. Hughes before the Board in regard to Plat Books. A form of
contract presented. .
The Beard ordered the fallowing instruction to the City Engine* r:
City Engineer is instructed to make such eoittract as he sees fit
with Mr. Hughes Bar Atlas, the City to furnish maps under such terms and compensation
as the Engineer may find proper.

Petitions filed for pipe sewer on Oak Park Court from Miami Street
to end of Court. Board ordered all petitions held up until after,Febuuary,1923.
petition received for grade, curb and walk and pavement on Eckman
Street from Fellows Street to Michigan Street. Sam filed. -
Bond of Jas. Brink on,Contractard bond with.Wm. K. McHenry signature
as surety is hereby released.
Excavation bond of City Plumbing Co. for $1,000:00 approved.
Petition -filed for light at corner of Eighth Street and Pleasant St.
Placed on file.
Petition filed for -the extension of College Street from"Hamilton
Street north to Bergan Street. Brookfield Street to Pershing Street and Johnson
Street to City Limits. Petition read and referred to the Planning Commission.

For the information of these bidding on the sewer in Charles Weidler's
Second Addition, I wish to bring to your attention that I -have let the contract
for the grading of all streets where the sewers will be placed:,and that this
grading will pre cede the sewer eonstruction*and that'the grading contractor will
put the streete to the levels designated by your ordinance.

Gentlemen:-
This letter is to notify you Of a Resobution approved and adopted by
the Bark Commissioners in,rogular session &A January 5,1923.
Bit It Resolved that the . Board of Park Commissioners do hereby
relinquish their rights thereto, and vacate for Boulevard
purposes Lafayette Boulevard from La Salle Avenue to Division
Street. And that the jurisdiction of the said Boulevard,
as described,°be transferred to the Board of Public Works.
This reslution was desired by the Mayor and has been adopted in
accordance with his wbsh.

The following communication received read and Clerk instructed'to
notify parties that City is not responsible.

Gentlemen:--
The enclosed is an itemized expense list tendered to us by the River
Park Plumbing & Heating Company for placing a lateral sewer from the main sewer
to the curb line, at lot #829 Berner Greve- First Addition.
The plumbers failed to locate the sewer at, the point first designated
by the City Engineer. They were then given a second Location to #ig to and failig
to find A lateral at'that point, were required to go to the main sewer.
We therefore enclose expense bill for this work.

Board ordered notice sent that the City is not responsible for the
sewer cgnnecticn. Further in this case, the records showthat the lot owner assumd
the responsibility of contracting directly with a plumber to have the tap extended
em the new curb line ahead of paving rather than permitting the City to let the
ccntractoe and inspect the work at the exepnse of the lot owner. There are no
frounds on which the Board of Works could reimburse you for the expense you have
ncurred.

The following resolution was adopted:
COPY OF VACATION RESOLUTION NO. 7191923.
Resolved by the Board of Public Works of the City of South Bend,
Indiana: That it is desirable to vacate the following:- a Ten (10) root alley north
of lots n-4mber*d 3 and 4 ,in ,Ward s Sub -Division of lot 329 and a part of 328 in
Cottrell's Firdt Addition, as follows, to,
. Beginning at the northeast corner of lot
4 in said Ward's -Sub -Division; thence west 75 feet to the northwest corner.of lot
3 in said Ward's Sub -Division; thence north 10 feet; thence east 75 feet; thence south
10 feet to the place of beginning.
The following property may be injuriously or beneficially affected by
such vacaet;ion: Beginning at the intersection of the north line of Wayen Street, and
the east line of St, Peter Street; thence north along th-e east line of St. Peter Street
132 feet; thence east, 165 feet to west line of alley; theme south along th west line
alley to the north nine -of Walme Street; thence west along the north line of Wayne
Street to the place of beginning.
Notice of this resolution shall be published on the 22nd. day of
Jan. 1923 and•on_the 29th. day of Jan. 1923 in.the South Bend Daily Tribune and News
Times. .
This Board, at its ®ffic in, .the City Hall on the 14th. day of
February 1923 at 7:15 P.M. will hear and receive remonstrances from all persons inter-
ested in or affected by these proceedings.
