Hearing had on Resolution for pipe sewer on Sibley Avenue from from Brookfield Street to Wilber Street, under Improvement Resolu Lion No.'1058. In the City of South Bend, Indiana, Upon said hearing property owners appeared and objected to water, standing.in the gutters, but; no written remonstrance was filed. The Board being fully adv,i,sed in the Ipremises, decides that the benefits to porperty liable to be assessed for said improvement are.equal to the estimated cost of thee same, as reported by the city Civil Engineer, an thereupon takes final action on said resoltt tion as originally adopted and the same -is hereby in all things, ra-tified, confirned and approved. City Engineer requested to notify the Street Commissioner to open up inLens and catch basins, Contract of Iaaac Van Trump for asphalt inspection for the year 1923 was approved by the Board as follows: - Chicago, Ill. January % 1923, Hon, Board of Public Works, City Hallo South Bend, Indiana. Gentlemen: - We hereby offer to test and inspeet,'in the same intelligent and scientific manner as heretofore, the asphalt paving awarded for construction_ in your city during the year 1923 on the same basis as last, year, vis: Two and one- half (2 ) cents per square'yard for axe course asphaltic eonerete'pavement, and thre three (3) cents per square yard for two course sheet asphalt pavement. The Engineer final measurements to govern. The character of —our' service will be similar in every respect to that rendered in the past. In Addition, should you desire any change or modification to your present asphalt specifications we will perform that service without addition al compensation. In fact,., any service we can reader toward the success of your. 1923 improvements will be yours for the asking. This proposal is merely a renewal of our Qrrmageeient with your City of Cast year and, imposes no obligation on your city in the event that no asphalt Paving is awarded during the present year. Continued. r Petition filed for grade, cu and walk on Clyde Street from Indiana Avenue to Ewing Avenue.Q Resolution ordered: The City Engineer submitted the list.of.property owners in the matter of an appropriation of certain property, under Condemnation Resolution No. 67 as shown on Page.-592 of this record No. 10,-for the.Widening of'Sorin Street at Notre Dame Avenue, in the City of South Bend Indiana, which list includes the names of.the owners -and holdera of property and of interests sought to be taken or benficially or injurious.ly,affected, and the description of the several pieces of property which is affected by said appropriation proceedings. Thereupon theBeard proceeded to award the damages sustained and toe assessed the benefits accruing to each piece of property on said roll. It was thereupon, moon motion duly made and seconded and unanimously adopted, resolved that said list, together with the amount of benefits and damages and the benefice and net damages therein set forth as the several parcels, nt land be adapted and that the respective amount of benefits contained in said lisp, be and are hereby -;assessed against the setreral tracts of land as specifically set forth in said list be and are hereby awarded to the several tracts+of land as specifically set forth in said list, and that net benefits or net damages, ss the ease may be as to the respective tracts of land, contained in said list ara hereby awarded or aslsessed, as the case meal b� as to the said several tracts of land. The Board hereby further sets off the benefits and damages each against the ether where both benefits.and damages are assessed, against the same piece -of property, tracil, or land or inie.rests, and hereby fixes the said respective not benefits as the amount that khall be paid by the respective owners -as benefits and further hereby fixes, the respective net damages as to the several tracts as the amount that shall be paid to the owners of the respective tract as damages. Thereupon, upon motion duly made and seconded and unanimously adopted t the 7ch. day of March 1923 at 7:15 P.M. was fixed as the day on which this Bard will receive or hear remonstrances from persons with regard to the amount of their respec- tive awards or assessments, and the Clerk of this Board was instructed to proper and cause to be duly and legally given, notices to the owners of each parcel of property, showing the amount of the assessment or awards, with a desetition of the property affected, and the date of said hearing: The fallowing claims were approved: - So.
