Besning Pole and dire Inspector appeared before the Boad Board and request a leave of absence until April lst., 1923. Same grai,ted, Robt. Dinan, Asst pole and Wire Inspector to take Mr. Beaning place, Attys Gilmer and Obenehain appeared before the Board sand took z up matter of opening of.an alley in FranAddition. Resolution ordered on same, as per petition filed August 9th,, 1922. BEFORE THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH. BEND: PETITION FOR EXTENSION OF ALLEY. Clara H. Noland'z respectfully petitions the Honorable Botrd of Public Works of the City of South Bend, and says: - That she is the owner of a part of lot numbered Four (4) and a. part of Lot Numbered Five (5) in Franz's Second Addition to the City of South Bend, and that her said real estate is known and described as 745 Lincoln Way East in said City. Petitioner further says that a Ten (10) foot alley extends from Osborn Street in said'City of the Southeast line of.lo.t numbered Six (6) in Franz's Second Addition; That the properties owned by the following described persons and situated on lots Tumbered Four (4) , five (5) and Six (6) of said Franz's Second Addition are served by no public alley: on George Avenue, John F. C. De Mar Jr., Richard Schultz and C. M. Schultz, and Dennis-H. Ruddick and F. E. Ruddick; on Vistula Avenue, B. F. Dunn, Barbara Schultz., Clara Noland and Leslie. Osborn and wife,,.. P-6titioner further says that the extension of, said' alley northwesterly to a point twenty (20) feet Northwest of the Northwest line of sad said lot numbered Five (5) would be no public benefit, and .is a public necessity that all of the above named persons and described properties will, be benefited by said extention. WHEREFORE your petitioner prays that the Ten (10) foot alley lyig. lying between and approximately paralleling Lincoln Way East and George Avenue, and extending from Osborn Street to the Southeast, line of -lot numbered Six (6) in Franz's Second Addition to the City of South Bend, be extended Northwesterly to a point twenty (20) feet northwest of .the Northwest line of said lot numbered Five in said Addition. December 2391922. Board of Public Works, - City of South Bend, Ind. Sirs: At your suggestionsI immediately saw Frank M. Jackson , , Chairman of the - Committee appointed by the Reafi:estate Board to make a report a's to whether the Board should endorse Mr. Hughes' proposition of getting up A plat book of South Bend and Mishawaka and told him of the situation, and he immediately called up Mr. Moore of Moore and Cole, whom he tells me came to see him Thursday, from from whom, he got no satisfaction whatever as to whether or not they propose to get out a plat of South Bend and Mishawaka, Mr. Moore stated that he would talk with his partner, Mr. Cole, and let Mr. Jackson know that same day, Thursday, but as yet, at this time (10:00 A.M. Saturday) has not made any report whatever, so Mr. Jackson says as far as he is personally concerned, he is ready to join in a report to the real estate Board recommending Mr. Hughes'�proposition. I feed therefore, that we have done all that we ought -to do to learn their position `in the matter, having given them an opportunity to state their position and they having refused to do the same. Under the circumstances, unless some thing unusual intervenes, I shall join with Mr. Jackson in making the recommendation. The other members of the committee have not been considered as yet, so I do not, know what their attitude or position will be, but have no reasn to believe that they will not agree with us. Resolved that, the entire work done under the above r. resolution and contract let thereunder be in all things accepted and approved and that said final estimate be allowed, Resolved that said notices in form required by law be published on the°29th. day of December 1922 and on the 4th. day of January 1923 in the"South Bend. Tribune and News Times in said City, fixing and setting the 17th. day (ff January 1923 at 7:15 P.M. at the office of said Board in the City Hall South Dend, Indians as the time and place when this Board will receive and hear remonstrances against he amounts assessed against each of the lots and parcels of land on said roll and will hear and determine whether such lots and parcel sof land will be specially benefitted by said improvement by the amount stated and sat forth in said roll.
