Board met; in regalar session at -9:00 A.M. All members present.
Stanley Kolkiewica appeared before the Board and requested
light be placed at Jefferson Street, and Kaley Street. Same referred to Inspector
for report. _
Atty. Be*tsah`WJ,th-,Dr. -Wirt appeared before the Board in regal
regard to petition refused for moving of pole at alley off of Portage -,Avenue near --
Keller Street. Board advised Dr, Wirt and Atty. Bertsch to take this matter
up with the Indiana & Mich. Elec. Co. tohavepole moved ah.d,if poll is moved the
City will see about rounding off corners.

In the above matter Mr. Gray and Attorney W.,W. Pepple

appeared and filed written remonstrance against assessment, and certificate of
Public Service Commission in regard to surrender of franchise was pre en,ted to

FOR THE IMPROVEMENT OF LASALLE AVENUE,
REMONSTRANCE OF THE CHIdAGO, LAKE SHORE & SOUTH, BEND
RAILWAY AGAINST SAID PROPOSED ASSESSMENT AGAINST IT.

Gentlemen:-.
The undersigned respectfully remonstrate against the assessment
against it for the improvement of La Salle Avenue, between West, line of Bridge ad
and West line of Main Street for. the following.Teasons, to -wit:_
1.- That the property of the ChIftgb, Lake Shore & South Bend Railway
Company is not subject to an assessment for said improvement;
2.- That on the 2nd, day of Mai 1922.9 the Chlca�o, Lake Shore & South
Bend Railway Company, ;under its then existing franchise did then and there file
with the City of South Bend, Indiana, which granted daid'fri=hise, and with the
public service commission of Indiana, a written declaration; legally executed
then and there surrendering its said franchise theretofore duly entered into,
all as provided by Section 10052e5 of Burn's Annotated Statutes of .Indiana,
Supplement of 1921. _
3.• That, the Chicago, Lake Shore & South Bend Railway Company, at
the time of the le-..ting of the contract for the aforesaid improvement of said
La Salle Avenue by paving, received and was operating under and indeterminate
permit,- duly authorised by-law, as provided in the act of the public service
commission of Indiana, entitled " An Act Concerning Public utilities, creating
a public service eomfnission, abolishing the railroad Commission of -Indiana, and
conferring the powers of the riilroad commission on the public service commission
approved March 4th, 1913.
4.- That said alleged assessment herein for said improvement, by
paving, of La Salle Avenue, in the -City of South Bend, Indiana, is contrary to
law.

Wherefore your undersigned remonstrant respectfully requests that
the a�ssessmsnt herein placed against its property for the improvement of La_.Salle
Avenue, in the City of South Bends Indiana, by paving, or any assessment whatsoever#
be stricken from said assessment roll,

Petitions viere filed and resolutions,ordered_on the following:
Sidewalk and curb and grade on Otsego from Angella Avenue to
Pokagon Street.
Pipe sewer on O-tsego Street from Angella Avenue to Pokagon Street.
Petitions for lights reported - on as follows: -
Light on W. Wash. Ave. at intersection of alley between Elm St.
and Walnut Street. Reco mended single light post be placed on corner of Spruce Street
and W. Washington Avenue on thesouthwest corner of Washington Avee Approved.
No lights necessary on Ewing Avenue east of Miami Street, a light
will be alright there next summer.
Not necessary to place lights at the cornerof Robinson Street
at corner of East Calvert Street as there is now an are light a short, block _to the
northeast and south also an are light at the Lincoln School west.
Complaint about, poles and anchors reported on as follows by
inspector.
Complaint about pole in way of entrance to garage kKkff tnin
alley between Cushing Street and Scott Street located near 721,W. La Salle Avenue
This is a dismantled anchor and should be removed at once as it is dangerous -to
automobiles. notify Indiana► Bell Tel. Co.' Report approved,
Pole in way of driveway to a garage in the rear of 317 W. Marion
Street. This is an Indiana & Michigan Elec. Co. pole and should be reset to the north
about five feet. Approved
Request received from the Board of Park Cpmmissioner requesting
that lights be placed at the Lagoon in Pottowatomie Park for skating rink.__ Referred
to the inspector for. report.
Permit granted to the Studebaker,Corpo ration to close Bronson
Street from end of new building near Main Street to Lafayette Street for a period of
Thirty days from date of closing, same to be properly barricaded, red lights, and
Police and fire departments to be notified.

Commissioner, read and placed on fiel and approved granted after March 15,1923.

Gentlemen: -
.Mr. Harold Smith, Assistant Commissioner and Mr. N. S. Marsh Inspector
ask me to apply to this Board for an allowance for the.upkeep of a car for each of
them, bicycles have always been used for inspection work but the work has become
so heavy that an inspection is only possible about every 10 to 12 days, and if the
volume of building for the coming year equals or increases over this year this depart -
went should have at least one more inspector to take as re of furnaces and flues
alone.

bearin on the amounts of such assessments at Its office in 4,he City °Hall on the
loth. lay of January 1922 at 7:15 P.M. at the office of said Board in the City

hear remonstrances against the amounts assessed against each of the logs and p
