Hearing had on ass4ssment roll and final estimate for water connections on Division Street from'Olive Street to Liberty Street, under Improvement ResolutionNo, 1020 , in the City of -South Bend, Indiana. -In the above ratter no remonstrators appeared and no written remonstrance was filed. The Board therefore find that the property assessed in said roll filed November.;Sth., 1922 is benefitted in the amount of assessments,as shown on said roll and the Board further find that the assessment roll filed November 8th. 1922 and the final estimate allowed November Bth.,. 1922 should be and the same are hereby An all things, ratified, confirmed and approved. KNOW ALL MEN BY THESE PRESENTS that, Whereas, McHugh & Cole Company, an Indiana Corporations, has entered into a contract with the Board of Works of the City of South Bend, Indiana, bearing date of the 5th. day of September, 19220 forthe construction by said McHugh and Cole Company of a trunk sewer in said City of South Bend, known as the River Park Trunk Sewer District No, l., authorized under Trunk Sewer Improvement Resolution Numbered 1016„ which said sewer is now in process of construction; and, WHEREAS, the assessmeNts against the property benefited by th the construction of said sewer have not yet been made, nor said sewer completcd or accepted by said Board of Works: NOW THEREFORE, for a good and valuable consideration received to the satisfaction of said McHugh and Cole Company, the said McHugh and Cole Company hereby sells, assigns, transfers, sets over and delivers to and unto the Lincoln Trust Company of the City, �f Fortlsyne, Indiana, the assessments roll to be hereafter fer made for the construction of said sewer, and all assess ments levied or assessed against property kenefitted thereby•by said Board of Works, together with all sums of money due, or to become due to the said McHugh and Cole Company from said City of South Bend for the construction of said sewer and all sums and amounts due or to become due and payable to them by reason of the construction -thereof, whether payable in money or bonds, and said McHugh and Cole Company hereby authorize and empower the officials of said City to isle issue to said Lincoln Trust Company all bonds to which the said McHugh and Cole Company may at any time be entitled by reason of the construction of said sewer, and to pay unto the said Lincoln Trust Company all moneys which may at any time 'become due and payable to said McHugh and Cole. Company on account thereof, it being the intention hereby to assign and transfer unto said Lincoln Trust Company any and all claims accruing or to accrue to said McHugh and Cole Company of any kind or nature whatsoever grwoing out of the construction of said sewer.
