All members presenT Hearing had on assessment roll and final estimate for Pavement n on .Pagin Street from Hine Street to Linden AveNue, under Improvement, Resolution No. 1009, IN the City, of South Bend, Indiana. In the above matter no remonstrators appeared and no written remonstrance was filed, The Board therefore find that tie ,rpoperty assessed in said roll filed October 31st., 1922 is benefitted to the amount as.shown,on said roll, and the Board further find that the assessment' ro11 filed October 318t., -192 1922 and the final estimate allowed October 31st., 1922 should be and the same se ,,are hereby in all thinga ratified, confirmed and approved, Hearing had on assessment roll and final estimate for water connections on Leer Street from Calvert Street to Ewing Avenue, under,Improvement Resolution No. 1049, In the City of South Bend, Indiana, In the above matter no remonstrators appeared and no written remonstrance was filed, The Board therefore find that the property assessed in said roll filed October 319t., 1922 is benefited :in the amount of assessments as shown on said roll and the Board further find that the poperty assessed in said roll filed October 319t,, 1922 should be and the same are hereby in all things ratified, confirmed and approved. Hearing had on assessment roll and final estimate for water connections on Fassnacht Avenue from Walnut Street to Johnson Street, under Impro• ment Resolution No. jb6�. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remmonstranoe was filed. The Board therefore find that the assessement roll filed Xovember 19t#*-1922 is benefited in the amount of assessments as shown on said roll and the Board further find that the property assessed in said roil filed Noveinber'`lst,t, 1922 and the final estimate allowed November„l t,*11922 is hereby in all things, ratified, confirmed and approved, Hearing hadon assessment roll and final estimate for seven inch concrete pavement on alley between Keefer's & Cobb's Sub -Division from Colfax Ave. to alley north of LaSalle Avenue and alley North of La Salle Ave Sze from said alley to west line of Cottage Grove Avenue, under Improvement Resolution No. 955. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remonstrance was filed. The Board therfore find that the property assessed -in said -roll filed 'November lst.f J922 is benefitted in the amount of assessments as shown on said roil and the Board further find that the assessment roll Filed November lst., 1922 and the final estimate allowed November 1st.9 19 22 should be And the same are hereby in all things ratified, confirmed and approved, Attorney G. A. Elliott representative and part owner of the Indiana Petroleum Company who -owns gasoline pump at the Northeast corner of Lincol Lincoln Way Cast and Olive Street, stated to the Board that his company's position was not to be antigotistie but they war a willing to do what was fair and requestd that the order as to.the removal of their pump be modified and if same could not be, when due notice was served , pump owned by their company would be removed - from public property. Board advised G. A. Elliott that order to takeout pump at Northeast corner of Lincoln West and Olive Street would not be modified and that a written votice would be servied in the near future. Property owners residing on Ford Street and Grace Street appeared before the Board and complained that the Oliver Chilled Plow Works had not moved Pence near alley to give ample room to drive into alley. This matter referred to the City Engineer to investigate. Chas. W. Cole Civil Engineer appeared before the Board and presented Plat of Sunnyside Manor with following dedication which was approved by.the Board, and referred to the Planning Board for Approval. 571 SUNNYSIDE MANOR The above plat is a plat of Sunnyside Manor and covers the following tract of land. Beginning at a point in the center line of McKinley Avenue, eleven hundred fifty-two and four tenths (1162.4) feet east of the east lane of Sunnyside Avenue, which point is the north one -quarter corner Section 7, Township 37, North Range 3 East; thence east along the north line of said Section 7i one hundred sixty- three and three tenths (163:3) feet, thence south parallel with and one hundred sixty- three and three tenths (1633) feet east of the north and south center line of said Seetiom 79 twelve hundred ninety-two and seventy-t*o hundreths (1292.72) feet, to the center.bine of Washington Street, produced East, thence west along the center line of Washington Street twenty-two and four tenths (22.4) feet; thence south forty-one and twenty=five hundreths (41.25) feet to the south line of Washington Street; thence west along the south line of Washington Street, six hundred and three and six tenths (603.6) feet to a point one hundred and twenty -six and seven tenths (126,7) feet, east of the east line of Jacob Street; thence north parallel with and one hundred twenty six and seven tenths (126. ) feet east of the east, line of said Jacob Street two hundred eight and five tenths (280.5) feet; thence west paralel with and one hundred ninety- eight, (198) feet north of the north line of Washington..Street one hundred ninety-two and seven tenths (192.7) feet to the west line tf Jacob Street;. thence north seven feet; thence west paralel with and two hundred five (205) feet north of the north line of Washington Street four hundred (400) feet to a point one.hundred (100) feet east, of the east line of Sunnyside Avenue., thence north parallel with and one hundred feet east of the east line of Sunny-side Avenue two hundred -eighty-seven and five tenths (287.5) feet to the north line of Colfax Avenue; thence east thirty six (36) feet; thence north parallel with and one hundred and thirty-six (136) feet esist of the east line of Sunnyside Avenue -seven hundred ;fifty-nine (759) feet to the center line of McKinely Avenue, which point is the north line of Section 7; thence east along the north line of said Section 7 Ten hundred sixteen and four tenths (1016.4) feet to the north one -quarter corner of said Section 7, which point is.the place of begnning. The plat contains eighty-seven lots numbered from 1 to 87 inclusive, ?he size of the lots and width of streets and alleys -are marked .on the plat in feet and fractions thereof. The streets and alleys acre hereby dedicated to the public. BUILDING RESTRICTIONS. Be it Knoven,that all persons, natural or artificial who shall hereafter acquire any interest in any lot in said Addition, shall be taken and held to agree with the grantors, and with the owners of any and. all of the other lots in said addition,tsoconform to and observe.the following govenante, restrictions and stipu- lations at least until November lst., 19429 at which time all of any of such striations m%y be revoked or repealed only by the consent of the owners of a majority of the frontage on any particular street, effected, and a breach of any of the restrictions and conditions hereinafter set forth shall operate retoractively to devest the title held bit said offending owner, which said title shall revert to the St.. Joseph Loan & Trust Company, Trustee;. (1) That no building, except a garage, shall be; built, on lots numbered one (1) to five (5) , which shall costx.less•than Fifteen Thousand Dollars ($15,000.00)..That no building, except a garage, shall be built on lots -numbered Six (6) to thirty-six (36), which shall cost less than Eight Thousand Dollars ($89000). That no building, except a garage, shall be built on lots numbered thirty-seven (37) to fifty-one (51) , which shall cost less than Six Thousand Dollars ($69000.) That no building, except a garage, -shall be built on lots numbered fifty-two (52) to eight-s seven (87), which shall cost less than five thousand Dollars ($59000.). • (2)_ That no building shall be built closer than fifty (50) feet, to the street line on Washington Avenue, Colfax Avenue and the 13outh'side of La Salle Avenue; and not closer than twenty-five (25) feet Ut the north side of La Salle Avenue, and the south side of McKinley Avenue. And it is understaod and agreed that any porch with a balcony or anclosed second story shall not. extend beyond the building line herein set forth,, (3) That no building shall be built closer than trot (10) feet to the side lots lines on lots numbered one (1) to five (6). That no building shall be built closer than eight (8) feet from the sides lot lines on lots numbered.six (6) to fifty -one That no building shall be built closer than six (6) feet from side lot lines one lots numbered fifty-two (52) to eight -seven (87) inclusive, With the exceptions That in the event two or more lots are used for the building of one dwelling house, in thatecase the siege lines restrictions shall apply only to the side lines adjacent to the tract'so used for that purpose, and the intermediate side line restrictions shall not apply. 572 t (4) No. lot in said Addition shall be Improved, used or occupied for other than private residential purposes, and no flat or aparatment,, though intended for residence pumpoes, may be erected thereon.
