Board met in regular session at 9:00 A.M. All members present. C.ounoilmsn Sid Thornton and Atty. Omacht appeared befarre the Board in regard to petition filed in Spring for grade, curb and walk on Tu-rnock Street. Advised that.% resolution had been ordered tor same. V. Babcock, Atty. 0. Deahl and Mr..Nolan representatives of the Indiana Petroleum Company appeared before the Board in reggard to permission to pur in driveway in lawn space at northeast corner of Lincoln Way West and Olive Street around filling tank at curb. This matter discussed and.;the Board ordered these parties to remove entirely all pumps off of City property, and permit -for driveway denied. :inspector reported as follows on light petitions: Light in alley running eas tna dwest from Follows Street to Erskine Ilvd. between Ewing Avenue and Seeberger Drive. Those. garages are_the old sheds left by the Builder's of the Erskine homes there is now an are light to the _ northwest a -quarter of a block-. No. building or trees between the li ht and garages. There dre two boulevard lights about-200feet tothe east this same alley the light toward the garages is painted, black on the side tenmrds the garage. The people using the garages should furnish their lights. a Y u Grade approved on Grant Street from Indiana Avenue to Prairie Avenue. Report p ort of ins actor on boulevard lights wanted on 161x E. Wayne Street east from 51,. Jesaph St, to the River. T beg to recommend twenty one iron posts with single lights of 100 Candle power be placed on E. Wayne Street between St. Joseph Street and the River acid remove two arc lights. When boulevard lights are placed on E. Wayne Street slso place same style lights on Carroll, Columbia and Lincoln Way East. The arc lights` now there show better lights than 21 boulevard lights. Thos. H. Beaning. The annexed plat is a plat of Queensboro Addition to the City of South Bend, St-. In -the above. wnueetion, we wish to again$* remind the Board that the specifications under which Mishawaka Avenue was improved, provide generally for the ingredients entering into the asphaltic const,ructon, both as to binder and top surface, The specifications also provide that -the particular* percentages of each used shall depend on the character of the street, the usuage reasonably to be expected, and other considerations, and that the judgement of the City Engineer, his ,agents, and assistants shall be binding upon the company as to the particular formula to be used.. Since some misunderstanding and possible controversy has arisen.over the matter of the exact formula as to various operations of the work_ on the above named street,`we are desirous that, the City Engineer and his.chemist shall specifically advise us as to 'the exact character and composition of either the binder or top .surface to be used in the proposed repair work. We are very glad to have our chemist confer otith,the Cityts chemist to the end that the best results may be approached with reference to all proposed repair work. We understand that in conformity with our con"fer'ence with the Board of Public Works and Mayor -some weeks ago,, that whatever is done with reference to repairing the street, at, this time, both as to the extend of the repairs and the character of the work, shall be w6thout prejudice either to the City or our company, as to the question of liability of the Whine Construotion.Co. under its bond and contract covering the street in Question.
