Hardy absent, This.being.the date set for the meeting of property holders on Dayton Street between Marine Street and Leer Street for the.discussion of the advisabilt� of paving Dayton Street this year. Property owners present stated all were in favor of street being paved. Board a#arded contract as follows: Concerning the improvement of the roadway of Dayton Street from Marine Street to Leer Street with asphalt, asphaltic concrete, bitulithiem concrete or beick, in pursuance to Resolution No. 1021 the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing on said, street to be improved, requesting that it be improved with,a different kind of pavement than the kind heretofore adopted by the Board in its preliminary order; and the City, Engineer reports that the White Construction Co, is the lowest Iciest bidder for the kind of pavement heretofore adopted by the Board, and the Board find that the White Construct tion Company is tho`lewest, and best bidder and hereby lets the contract for said improvement to them and orders that said improvement be made with asphaltic concete, uusing Mexican Asphalt and all proceedings heretofore had in this matter are hereby *confirmed and ratified. And the Board being fully advised in the premises, decides that Lhe benefits to property liable to'be assessed for said improvement are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted and the same is hereby in all things, ratified, confirmed and approved. Resolved further, that notices be published on the 29th. day of Sept., 1922 and on the 6th. day of October 1922 in the South Bend N4ws Times and South Bend Daily Tribune, stating that this Board will receive bids for the construction of said improvement up to 10:00 A.M. Tuesday October 17th., 1922 at. The Board reserves the right to reject any and all bids. Ford St, from a point two hundred thirty-five feet -east of the east line of Arnold St. to the east end of said street, a distance of fifty-two feet. Alley between and parallel with Ford Street and Grace Street -from a point two hundred thirty-five feet east of the east line of Arnold Street to the east end of said alley, a distance of fifty -.two feet. Upon said hearing remonstrators appeared and objected to the condition of the cement sidewalk and curb,but no written remonstrance filed, The Board therefore find that property assessed in assessment roll filed 1922 is benefitted in the amount of a ssesssments as shown on said roll, and the Board further find that the assessment roll filer 4111-d'atHebfinal estimate allowed 1922 should be and the same are hereby in all things, ratified, confirmed and approved, and the Board ordered the ity Controller notified that the sum of $200.00 be held up until repairs are made to sidewalk satisfactory to the City Engineer. d.
