Hearing -had on resolution for the paving of alley Bast of St. Peter Street from Jefferson Blvd. to alley north of Jefferson Boulevard, under Improvement Resolution No. 1046. In the City of South Bend, Indiana. Upon said hearing Atty.,John Yeagley appeared and objected to improvement, representing Mr. J. 011ier and Attorney Barry Scanlon appeared for said improvement. Written remonstran ce filed was over -ruled by the $oard and being fully advised in the premises,.decides that the benefits to property liable to be assessed for said improvement°are equal to the estimated cost of the same, as reported by the City Civil Engineer ,,and thereupon -takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, that notides be published on the 14t,h. day of September 1922 and on the 31st.0 day of September 1922 in the South Bend Tribune and News Times, mewspapera of general circulation in said City, stating that► this Board -will Deceive bids far the construction of said improvement up until September 29th., 192 . The Board reserves the right to reject any and all bids. Hearing had on resolution for Pavement on alley west of Lafayette Street from Maation Street to Madison Street, under Improvement Resolution No, 1056. In the City of South Barld, Indiana. Upon sadd-hearing no remwnstrators appeared and no written remon- strance was filed. The Board being fully advised in the promises, decides that the benefits to property liable to be assessed for said -improvement are equal to the estimated cost of the saute, as reported by the City Engineer, and there- upon takes final action on said resolution as originally adopted and the same are hereby in all things, ratified, confirmed and approved.`: Resolved further, that notibes be published on the loth, day of September 1922 and on the 21st., day of September 1922. in the South Bend Tribune and News Times, neilspapers of genral circulation in said.City, stating that this Board will getceive bids for the construction of said improvement up to 10:00 A.M Tuesday September 29th., 1922. The Board reserves the right to reject any and al all bids. Deferred hearing had on Vacation Resolution No. 63 for the Vacatin of alley lying between lets 183 and 184 in the Original Plat of South Bend, Indiana from Main Streette the first alley east of Main Street. Property owners abutting on said alley appeared and objected to vacation of this alley, the Board decided to defer all action on said alley until Wednesday September 20th., 1922 at 7:15 P.M. Deferred hearing had on Vacation Resolution No. 62 for the v40atin of Grace Street Ford Street and alleys East of Arnold Street, in the City of Souk South Bend, Indiana. The property owners appeared and hearing deferred until Wednesday September 27th., 1922 at 7:15 P.M. Heaaring had on assessment roll for grade, curb and walk on Robinson Street from Lincoln Way East to Ewing Avenue under Improvement Resolutia No. 926. In the City of South Bead, Indiana. In the above matter no remonstrators appeared and no written rema monstrance was filed. Upon said hearing no written remonstrance was filed and no remonstra- tors appeared. Prgperty owners residing on Harper Court appeared before the Board in regard to pavement resolution adopted August 2nd.9 1922, and stated that they were unable to obtain asnough, signatures for waiver and requestod that resoluieon be advertised. Board resolved that notice be published on the 16th. day of September 1922 and on the 23rd. day of September 1922 in the South Bend News Times and Tribuno, newspapers of general circulation in said City, stating that this Board will give a hear on said resolution in thd.ae office in the City Hall on the 4th'. day of October 1922 at 7:15 P.M. In case such repairs become necessary the city shall give written notice to the contractor to make the; same, and in case of failure of the contractor to commence such repairs within thirty (30) days after such notice is re- ceived,.the city may make such repairs either by its own employes or by independent contract, and may thereupon recove#"from the contractor and his sureties the reasonable cost of the repairs so made, together with the, cost of the supervision and inspection thereof. The city shall have sixty (60) days after the expiration of said guarantee period. in which to notify the contractor of any such repairs necessary on the date of such expiration. Wheifever (in the case of pavement) the repairs necessary to be made at the expiration of the guarantee period shall amount to more than fifiy per cent. (50%) of the surface of any one block, the entire pavement of that block shall be taken tip and relaid in accordance with the original specifications.
