Elliott at peared before the Board and presented petition for vacation of ai alley as follows: - To the Honorable Board of Public Forks, South Bend, Indiana. Gentlemen: - The undersigned petitioner respectfully shows to the Board thathe is the owner of the following pieces'of real estate both situated on Lincoln Way Test In the City of South Bend, Indiana, to )wi!,:. 10 A lot or "parcel of land having a frontage f forty • .(40) feet on Lincoln Way Test, taken off of and from the entire width of the Easterly ends of Lots numbered Twenty-five (25) and Twenty-seven (27) as shown on the recorded Plat of Witherill's Second Addition to the City of South Bend, which part is bounded by a line running as follows, via; Beginning at the point of the intersection of the southerly line of said -incoln Way West with the East line of paid Lot No. Twenty sven (27) thence running Northwesterly along the Southerly line of said Lincoln Way West, a distance of forty (40) feet; thence south parallel with the east easterly line of said Lots Nos. Twenty -Five (25) and Twenty seven (27) , a distance of seventy-nine and eight tenths (79.8) feet to the Southerly li a of said Lot ARo. That the paccels described above and owned by this petitioner are situated on either side of the bove strip named for alley purposes in said plat,.and the strip divides about equally the property of eighty -six (86) feet frontage on Lincoln Way West of this petitioner. T is petitioner desires to build an the property adjoining and definite action nnot be taken until the disposal of the Four and Ninety-five hundreths (4 95) feet referred to has been taken., Pet,ition&r would further sho',V that the four and ninety-five hundreths (4.96) feet has never been used for alley purposes, an the same is not available for alley purposes because of its width. That all of the lots in the Block bounded by Lincoln Way West on the North Harrison Avenue on the Fast and Sherman Avenue on the Test, Fuerbringer Street on the South are all so situated and have access to streets and alleys having the necessary widths to be used at the present time. Resolution No. 1016 filed with the Board Tkursday September 7th., 1922 was presented to the Board and the Clerk instructed to send the following nigh letter to the United States Fidelity and Guaranty Co. of Baltimore, Maryland sureties on said Bond as to their authority to sign a bond outs$ outside of Ohio.
