That said lots 65,84 and 139 were separately assessed for one or more
of the improvements herein described, where they were affected thereby, and will
not be affected by the proposed proceedings under this petition.
That the certain tract of land of which all of said lots are a part,
was duly assessed, in whole or in part, for the following public

That the legal description of said tract -of lard is as follows'.,-
Beginning at.the intersection of the westerly line of Portage
Avenue and the North line of Keller Street, in the said City of South Bend; thence west
along the north line of Keller Street to a point 143 feet west of the west line of
College Street; thence north along a line 143 feet west of and parallel to the west
-line of College Street to the south line of Hamilton Street; thence east along the
south line of Hamilton Street to the westerly line of Portage P_venue; thence south-
easterly along to west line of Portage Avenue to the place.of beginning.
Said. improvement assessments which were so levied against said real
estate, and the amount and name of each of said.assessments which are no unpaid, and
the number of installments thereof which are no unpaid, are filed herewith and made a
dart of this petition and'are marked respectively Exhibits "A","B"-,"C", "D", "E",
F" , and " G" , .
That after said assessments were levied against said land , the same
was platted, and the plat thereof has been approved as required by law, and is known
and described as Marquette Park Addition to the City of South Bend, Indiana and is
recorded in Plat Board No. 10j.at page No. 1579 in the Officer of the Recorder of
St. Joseph County, in said State.
Your petitioners further state that there is no interest how due
on any of said assessments, and there are no penalties or costs due thereon
a
In the event that a reassessment -shall be made as herein requested,
the undersigned petitioners and lot owners each hereby authorizes Ralph E.
Treanor, as his attorney in fact, to sign and enter into'an agreement, and waiver
in writing, in the form and manner provided,by law to be approved by the said
Board of Public Works, for the privilege of paying such improvement reassessments
In thenumber of installments required for the remainder of -the ten years'
period granted under the original improvement assessments for said improvement
it being agreed and'understood that,. ::the undersigned Marquette Park Corporation
shall pay full 111 such unpaid installments of said reassessments as the same
shall severally become due against the said lots of the individual owners above
named, together with all costs and penalties that ma 'be added thereto, and all
interest thereon.
Wherefore your petitioners request your Board to reassess the unpaid
amount of eab.h of said improvement assessments, including all unpaid interest
thereon, so that each lot or tract of land of the said new subdivision, as shown
by the approved plat thereof, shall bear its fair and equitable proportion of
each original unpaid assessment, and all interest then due thereon, and all pen-
alties and costs, bf any be due, and that all reassessments payments'fall
due in the remaining years of the ten year period and on the same dates .

We, the undersigned, now owners of lots of recently platted
property on that part of streets which have been improved as prdvide-d by resolution
of the Board of Public Works of the City of South Bend, Indiana`, as follows: -
Portage Avenue from Noth line of Morris Park Addition to
North line of Section 3,1 Twp. 38 North Range 2 Eadt, grade, curb and walk under
Improvement Resolution.No. 264. Assessment Roll No. 755.
Portage Avenue from Keller Street to North City Limits by grading

Which property was assessed as one tract and which since said
assessments have been plaited and that part, of said assessments have been readjusted
by said Board :of Public Works, and said lots re -assessed with their several
proportions of said assessments no unpaid;
Now, therefore, iin consideration of the benefits to said
lots conferred by said assessments of said unpaid installments of said improvement
assessments, including all interest, penalties and costs due thereon, and the granting
of the privilege of paying the improvement reassessments on the subdivided lot, or
lots in the number of installments required for the remainder of the ten years` period
granted under such original improvement assessments, on the real estate described
in the petition of Marquette Park Corporation owners of the original tract, for
adjustment of said original assessments,, -and all acts of the said Marquette Park
Corporation at the time in connaction therwith in securing the privilege of paying
such improvement assessments. in ten annual installments, and all acts of the said Boaz
Board of Public Works in connection with the reassessmnets authorized by law, as
agreed to make no objection to -any illegality or irregularlity in the matter of the
original assessments or of the reassessments of said improvement assessments.

tion the form of waiver hereto sttached, accopy of which is made a part. hereof.
The.said waiver to be filed with the City of South Bend, Indiana, in accordance
with Section 2 Chapter 185 of the Acts of 1915 Page 6779 concerning the method
and procedure used in the reassessments of public improvements.
This is to certify that the above is a true sRA copy of a resolution

this 2"5rd. day of August 1922 for the reassessmsnets of certain newly platted
hots in Marquette Park Addition to the City of South Bend, Indiana, abutting
upon the following streets;
Portage Avenue from the north line of Morris Park Addition
to north 1tne of Section 34 Twp. 38 North Range 2 East.
Portage Avenue from Keller Street to north City -Limits.
Portage Avenue from alley north of KinylStreet to Stocker
Place.
Portage Avenue from Keller Street to north line of Section

Hearing given on Vacation Resolution No. 62 for the Vacation of
grace Street from a point two hundred forty-nine feet east of the east line of Arnold
Street, to the east end of said street, a distance of thirty-eight feet. Ford Street
from a point two hundred thirty-five feet east of the east line of Arnold Street to
the east, end of said street, a distance of gif$y -two feet. Alley between and parallel
with Ford Street and Grace Streets from a point two hundred thirty-five feet east of
the east line of.Arnold Street, to the east end -of said alley, a distance of fifty-
two feet. Alley east„and of and parallll with Arnold Street, extending from the
east end of Grace St., one hundred fifteen and one-half feet south to the alley, bbove
described$ in the City of South Bend, Indiana.
In the above matter a written remonstrance wqs filed by property
owners objecting to_ the above vacation proceedings and remonstr€ t4r.s appeared. The
Board after hearing all parties interested presented deferred this hearing until
Wednesday August 30th., 1922 at 7:15 P.M.
Property owners having places of business on South Michigan Street
appeared before the Board and took up tie matter of placing more lights on South Michigan
Street bet, Monroe Street and Broadway. The Board after hearing all parties
interested advised property owners they :could make trip of investigation on South
Michigan Street in regard to lights.

Gentlemen: -
We, the undersigned resident property,owners, remonstrate. against any
further action by your Honorable Body in the matter of improvement of Marine Street
from Indiana Avenue to Calvert Street by pavement this year for the following
reasons: That said improvement is not necessary for public needs. That the cost.
of this proposed improvement would be excessive at this time and would be a hardship
to,many owners and purchasers of property; and further thick it to late in the
season to let a contract for, pavement.

order designating the kind of pavement, the Board at 10:00 A.M. Tuesday August
22nd., 1922 publicly opened read and considered all bids and then continued thet

Be It Resolved by the Board of Public Works of the Cit.of.South Bend,
St. Joseph County, State of Indiana, that it is desired and deeded necessary to
improve Alley West of Lafayette Street from Marion Street to Madison Street as follows,
Said alley shall be graded and the roadway thereof shall be paved;
Also the roadway of certain portions of the streets and alleys which enter or
.intersect said street shall bevgraded andpaved, The paving material to be used in
making said improvement shall be Sheet, Asphalt, Bitiluthic, Asphaltic concrete, brick
or portlsnd cement concrete seven (7) inchesthick,, for the sheet asphalt, Bitulithic,
asphaltic concrete and brick, or rolled gravel six E6) inches thick fo the brick, storm
water inlets and conduits shall be .constructed where necessary; all storm water inlets
and manhole tops shall be sect to the proper grade; cement marginal curb shall be construe
