Indiana, an Ordinance and a petition by all (100%) property owners which proposes the annexation of real estate located in Centre Township. St. Joseph County. Indiana. which is more particularly described on Section I of this Resolution; and WHEREAS, the territory proposed to be annexed encompasses approximately » acres of agricultural land, which property is at least 12.x% contiguous to the current Cit}• limits, i.e.. approximately 6~.3% contiguous, generally located directly south and adjacent to the existing Southfield Village subdivision. east of Miami Street and south of Kern Road. It is anticipated that the annexation area will be developed for single-family homes, condominiums, This mix of uses will require a basic level of municipal public services of anon-capital improvement nature, including street and road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services of a capital improvement nature, including street and road construction, street lighting, a sanitary sewer system, a water distribution system, and a storm water system and drainage plan: and WHEREAS, the Board of Public Works now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of anon-capital nature. including police and fire protection, street and road maintenance. street sweeping, flushing, and snow removal. and sewage collection. and other non-capital services normally provided within the corporate boundaries and services of a capital improvement nature including street and road construction, street lighting, a sanitary sewer extension. a water distribution system. and a storm water system to be furnished to the territor<• to be annexed (2) the method(s) of financing those services; (~) the plan for the organization and extension of those services; (-1) that services of a non-capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation. and that then will be provided in a manner equivalent in standard and scope to similar non-capital services provided to areas within the corporate boundaries of the City of South Bend. regardless of similar topography, patterns of land use, and population density; (~) that services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation within the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use. or population density, and in a manner consistent ~~°ith federal. state and local laws. procedures, and planning criteria: and (6) the plan for hiring the employees or other governmental entities whose jobs will be eliminated by the proposed annexation. P/HEREAS, the City of South Bend Board of Public Safety and Board of Public Works have each approved the written fiscal plan and policy and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the following described real property be annexed to the City of South Bend. Section III. The Common Council for the City of South Bend shall and does no~v establish and adopt the Fiscal Plan, attached hereto as Exhibit "A", and made a part hereof, for the furnishing of said services to the territory to be annexed, which provides, among other things, that the public sanitary sewer network is available with capacity sufficient to service this area; that street lighting, parking and will be installed at the developer's expense; and that a street drainage plan will be also be planned, provided and paid for by the developer subject to compliance with state and local law. Section IV. In consideration of pedestrian safety and proper vehicular movement, it is required as a condition of annexation that the developers give very careful consideration to vehicular access and circulation as well as pedestrian movement for the developments within the annexation area. If possible. the site should include open space that could be linked in the future to other areas nearby as part of a larger open space network. Neo-traditional building/site design elements should be included in terms of context, setback, orientation, spacing, style, massing, height, entry, fenestration, materials, accessory buildings, landscape buffering and lighting that achieve development and design of the highest possible quality. It is required that the annexation area integrate harmoniously with the surrounding residential areas. Water as well as sewer service is available in sufficient capacity and it is required that the developer will pay the costs of sewer and water extensions to the project site as needed. Building plans and other information to satisfy these requirements shall be furnished to the City by the Developer. INTRODUCTION A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City") policy for the annexation of property in Portage and Clay Townships, St. Joseph County, Indiana (hereinafter, "Annexation Area"), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located directly south and adjacent to the existing Southfield Village subdivision, east of Miami Street and south of Kern Road. See Map 1. B. Legal Description The Annexation Area is part of the Northwest Fractional Quarter of Fractional Sections 6, Township 36 North, Range 3 East, Centre Township, St. Joseph County, Indiana. For a complete legal description see Page 1 S. C. Contiguity The Annexation Area is at least 1/8 (12.5%) contiguous to the current City limits: Contiguous 2,580 feet 35.7% Non-Contiguous 4, 650 feet 64.3% Total 7,230 feet 100% Southfield Lake Annexation Area 4 D. Size of Annexation Area The Annexation Area is 55 acres in area. E. Buildings and Land Use The Annexation Area is currently used for agriculture. The site contains one single-family structure and a pond. The land is slated to be used for a mix ofsingle-family homes and duplexes and a forest preserve. F. Zoning & Subdivisions The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned "SFl" Single-Family District and "PUD" Planned Unit Development upon approval of the City Council and incorporation into the City of South Bend. G. Population 2.5 persons currently reside in the Annexation Area. H. Tax Rate The tax rates used are those of 2005 payable in 2006. The Township Rate will decrease by $0.1155 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $2.2971 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $2.2971 per $100.00 of assessed valuation. Table 2 shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments 2005 payable 2006, St. Joseph County Auditor property tax records: Land: $320,000 Improvements: $0.00 Net: $320,000 Southfield Lake Annexation Area 5 J. Municipal Legislative District The Annexation Area will be in the 5th District. K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The Centre Township Trustee has been notified of this Annexation. SECTION III. MUNICIPAL SERVICES A. Public Works Sewer -The public sanitary sewer network is available with sufficient capacity to serve this area and more. The City of South Bend constructed and maintains a sewage lift station in the annexation area that has sufficient capacity to serve the annexation area as well as already developed land and other vacant land in the general vicinity of the annexation area. The developer of this property will need to extend sewer lines to the site from various locations adjacent to the annexation area to the extents of this proposed development as well as all other public works infrastructure required for the development. The wastewater treatment plant and downstream collection facilities are adequately sized to handle the additional flow from any development. Revenues from the development of the site will be sufficient to provide sewage collection and treatment services to the site. Water - A 8" water main is located on Deerfield Train that terminates at the eand of the road. There is a 10" water main on the west side of Miami Street running to 150' south of Ridge Trail. Flow test data from June 8, 2001 Ridge Trail indicate a static pressure of 54 psi, residual pressure of 48 psi and a flow rate of 1060 gpm. Depending on the development, it may be necessar}~ to loop the water mains to provided adequate capacity to the annexation area. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36-9-22-2, I.C. 8-1.5-3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. Street Lighting -The developer of this property will be required to install a street lighting system. Additional revenue to the General Fund from this annexation area will be sufficient to pay for street light operations. Waivers of Annexation - No waivers of annexation are in effect for the Annexation Area. Southfield Lake Annexation Area 6 Streets -All non-private streets within the annexation area will be added to the City's roadway inventory. The mileage of any existing road and any new roads that might be developed within the property will add to the State's payments to the Motor Vehicle Highway Fund and Local Road and Street Fund sufficient for street maintenance, sweeping, and snow removal. As presented, the extended roadway of Deerfield Trail will be maintained by City forces. Several private streets are proposed with maintenance being provided by the developer or other arrangement. Drainage Plan -Drainage facilities will be required to be constructed by the developer and meet the latest City of South Bend standards. Police Department $6,228,676 @`~ 7.1, @$13,224 @1.19 miles (6,250 feet) @$15,736 The Annexation Area would be expected to be added to the already existing BEAT 15. Police patrols, traffic enforcement, and emergency responses will be part of the services the City will offer to this area. This proposed annexation would require officers to cover a relatively small additional area to this beat. The Annexation Area is located in an area of the city that is expected to continue to grow, both in commercial development as well as residential. At this time it is not expected that this annexation would cause calls for service to increase significantly and it is not anticipated that it will be necessary to increase police patrols beyond the already existing beat patrol at this time. The area under consideration is not expected to cause any unusual problems. At the present time the cost for servicing the proposed area is not expected to impact the existing budget of the Police Department with any significance. However, this area, as well as all other areas of the City, will continually be monitored for level of service demands and other criteria that would necessitate additional resources through budgetary increases or possibly shifting of existing resources, such as a beat restructure. Police services and response time in this area can be expected to be comparable and consistent with that as in all other areas of the City. Police coverage to this area could begin immediately upon annexation and coordination of the conversion of the 911 emergency phone system for that area. Southfield Lake Annexation Area ~ Note: The cost of service for this Annexation Area is based on the number of parcels. Fire Department Fire Response -The City provides a fully staffed, full time fire department housed in 12 fire stations strategically located throughout the city. The Annexation Area will be serviced primarily by Station #10, located at 5303 York Road, approximately 1.2 miles away. Additional Fire Department units would respond from Fire Station #8 located at 2402 Twyckenham Avenue which is approximately 3.2 miles away. The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate water supply will be necessary as development takes place. The Fire Department will continue to review and monitor response times in this area and make necessary recommendations to improve response times that are comparable to other areas of the City. Emergency Medical Response -The City, under contract with St. Joseph County, provides emergency medical response to the unincorporated areas of St. Joseph County. Of the seven ambulances currently in service, 3 are dedicated for response to the unincorporated areas. These are Medic Units #10, 11, and 12. The Annexation Area is currently being serviced by Medic #10, located at Fire Station #10 at 5303 York Road. Upon incorporation, the Annexation Area will be serviced by Medic #l, also located at Fire Station #10, located at 5303 York Road. Emergency medical response will continue to be provided by the City of South Bend. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Note: The cost of service for this Annexation Area is based on the number of parcels. Household information is provided for comparative purposes. Code Enforcement The Annexation Area will be added to Area 5. $3,128,226 @$23 @$21 @$2121 Administration & Pensions & Benefits $ 6,140,722 @$143 @$129 @$13,029 Total: $47,066 The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Environmental Services Wastewater Treatment - Wastewater treatment services are supported by user fees, and are paid through the Water Works billing system. Solid Waste -Industrial, commercial and apartment customers are not served by the Bureau of Solid Waste. The annexation will contain single-family and duplex residential units and office- retail units. The office-retail uses will have centralized waste collection locations. A licensed private waste hauler will be required to serve these developments. As single-family, duplex units are constructed, The Division of Environmental Services could service them at the rates noted below. Southfield Lake Annexation Area 9 For reference purposes, the following Bureau of Solid Waste rates apply for residential customers: Single family rate: $8.80 per month. Senior rate: $5.50 per month. Duplex rate: $13.80 per month Tri-plex: $18.80 per month Quad: $23.80 per month Recycling fee: $1.97 per month F. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as the Mayor's office, the Legal Department, and the Parks & Recreation. These services are available upon the effective date of the Annexation. Full and dedicated response for non-capital services will be in place within one year of the effective date of the Annexation. Costs for these services have not been calculated. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on acounty-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county-wide agencies and their services that will continue to provide the same type and level of services to the Annexation Area. County-wide services will continue to be supported by the County and Township tax rates that will remain in effect. SECTION IV. LAND USE ANALYSIS & DEVELOPMENT CRITERIA As with any new development, the proposed use and development of this site becomes important relative to its relationship with the existing, surrounding uses. City Plat, South Bend's comprehensive plan, notes that pedestrian movement/safety and vehicular site access are important elements to be addressed in developments of all kinds. City Plan also expresses a need to consider how buildings relate to the street. Building design that is sensitive to massing, shape, scale and finishes will ensure that private development will enhance and reinforce the City's corn_mitinent to development and design of the highest quality. The Annexation Area is an approximately 55 acres in size. Land directly east, south and west of the annexation area is zoned "R" Residential in unincorporated 5t. Joseph County. The area to the north is zoned "PUD"Planned Unit Development and "SF1" Single-Family and Two-Family in the City of South Bend. Southfield Lake Annexation Area 10 The plans that have been unveiled represent a unique mix of walking paths, forest preserve, and housing. The development is a continuation of Southfield Village directly to the north. Southfield Village contains an assisted living facility and a single family subdivision with traditional houses and villas in an inter-generational format. It is anticipated that additional medium density residential, commercial and mixed-use development will occur in areas directly to the east and south of the annexation area. Resultantly, daily traffic volume is anticipated to increase and vehicular patterns will be altered. Moreover, additional demands from the development will be placed on the City of South Bend's infrastructure. Intersection roadway improvements as well as modifications to the City's water and sewer network will be required to accommodate the development. It is anticipated that Miami Street will require safety improvements through widening and traffic calming enhancements. In consideration of pedestrian safety and proper vehicular movement, it should be required as a condition of annexation that the developers give very careful consideration to vehicular access and circulation as well as pedestrian movement for the developments within the annexation area. If possible, the site should include open space that could be linked in the future to other areas nearby as part of a larger open space network. It should also be required that neo-traditional building/site design elements be included in terms of context, setback, orientation, spacing, style, massing, height, entry, fenestration, materials, accessory buildings, landscape buffering and lighting that achieve development and design of the highest possible quality. It is required that the annexation area integrate harmoniously with the surrounding residential areas. Conceptual plans unveiled to date, in fact, appear to satisfy most of the aforementioned requirements. The development is targeted to seniors and young professionals. Preliminary designs show clustered condominiums/villas with shared vehicular access. The proposed PUD zoning will allow the developer to utilize higher standards than those currently in place for traditional zoning classifications. PUD zoning will facilitate a more efficient use of land and a mix of land uses that will encourage walking. The proposed forest preserve and walking paths throughout the development also fulfill several Ciry Plan policies. The building materials, set-backs and other site elements and amenities for the proposed developments within the annexation area appear to honor neo-traditional design fundamentals. Building plans and other information to satisfy these requirements must be submitted by the developer to the City as part of the development review process. Failure to comply with all the conditions may result in the City's repeal of annexation. Southfield Lake Annexation Area 1 ~ SECTION V. FISCAL IMPACT 1) Essential city services can be made available to the residents (and territory) of the Annexation Area in a timely and comparable fashion per the requirements of State law and this fiscal plan. 2) The City is financially able to support city services to the territory sought to be annexed. 3) Required improvements made by the petitioner and/or owner of the parcels must be made in accordance with the standards of the City of South Bend. 4) Required improvements made by the City will be completed within the time frames provide by State law and this fiscal plan. 5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. 6) Property tax revenue and land assessment estimates are based on a combination of: 2005 payable 2006 tax rates, taxes paid in previous years by a comparable development, estimates of units built, estimates of unit values and land assessments, and tax abatements or adjustments, if any. Tax rates are subject to change every year. 7) Department expenditures and revenues are derived from the City of South Bend Budget. 8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City-wide average based on a particular budget year. In the case of the proposed development in the Annexation Area, some of these services will not be required or possibly requested for many years. Hence, the cost of providing services over the first five should be evaluated with this in mind. This Bill proposes to voluntarily annex contiguous territory in Centre Township to the City of South Bend. The resolution indicates the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the provision of services, both capital and non-capital in nature, to the territory to be annexed. This Annexation is a 55.4 acre parcel generally located directly south and a.~ijacent to the existing Southfield Village subdivision, east of h4iami Street and south of Kern Read. Public impravern:.nts are planned for this area and it is anticipated that they will be completed at the expense of the developer. Please note that on page 9 of the fiscal plan that additional development criteria are being required in the come}a of City Play: and have been satisfied in anticipation of this resolution. I am requesting that the attached resolution be placed on the November 27, 2006 agenda of the ~.:olnr.-~on Council meeting at which the companion Bill is given Second Reading.
