RESOLUTION NO. 990
RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION
AMENDING THE DEVELOPMENT PLAN FOR THE WEST WASHINGTON - CHAPIN
DEVELOPMENT AREA
WHEREAS, the City of South Bend Redevelopment Commission
( "Commission "), governing body of the City of South Bend Department
of Redevelopment ( "Department ") on October 23, 1987, adopted
Resolution No. 818 declaring the West Washington- Chapin Development
Area in the City of South Bend, Indiana ( "City ") to be a blighted
area within the meaning of the Redevelopment of Cities and Towns
Act of 1953, as amended (Indiana Code 36 -7 -14) ( "Act "); and
WHEREAS, Resolution No. 818 and the West Washington- Chapin
Development Area Development Plan ( "Development Plan ") adopted by
Resolution No. 818 on October 23, 1987 were confirmed by Resolution
No. 824 adopted on December 11, 1987; and
WHEREAS, Resolution No. 818 was further amended by Resolution
No. 908, adopted on February 23, 1990 and said resolution No. 908
APN expanded the West Washington- Chapin Development Area by adding
Expansion Area No. 1 and defined the West Washington- Chapin
Development Area as follows:
A PARCEL of land being a part of the City of South
Bend, Portage Township, St. Joseph County, Indiana
and being more particularly described as follows,

COMMENCING at the point of intersection of Western
Avenue and William Street; thence North along the
centerline of William Street to the Easterly
projection of the Southerly right -of -way of the

projected to the intersection of the West

of the first 14.0 foot alley; thence West along the

the intersection of the East right -of -way line of Maple
Street and West property line of Lot A, Baker's
Subdivision (unrecorded); thence South along the East
right -of -way line of Maple Street and West property
line of said Lot A to the easterly projection of the
Southerly right -of -way line of the first 14.0 foot
alley North of Western Avenue; thence West along the

intersection of the West right -of -way line of Sadie
Street; thence South along the West right -of -way line
of Sadie Street to the intersection of the North
property line of Lot 77 of Arnold's Second Addition to
the City of South Bend (now noted as Block W2- Parcel
21); thence East along a projected line of Said Lot 77,
also being along the North line of Lot 56 of said
Arnold's Second Addition (now noted as Block W3- Parcel
1); thence continuing East along the North Line of Lots
34,33 and 12 of Oak Grove Addition (now noted as Block
W3- Parcel 2, Block W4- Parcel 1 and Parcel 2) to the
intersection of the West right -of -way line of O'Brien
Street; thence North along the West right -of -way line
of O'Brien Street to the intersection of the projected
North property line of Lot 2, of Oak Grove Addition;
thence East along the projected and North line of Lot 2
(now noted as Block W5- Parcel 1) to the East
right -of -way line of Grant Street; thence South along
the East right -of -way line of Grant Street to the
approximate mid -point of Lot 19 of College Grove
Addition (now noted as Block W6- Parcel 1); thence East
along a line and approximate mid -point of Lot 19 to the
East right -of -way line of Johnson Street; thence North
along the East right -of -way line of Johnson Street to
the centerline of the first alley North of Orange
Street; thence East along the alley centerline to a
North -South alley; thence North along said alley
centerline to the North line of Lot 20, College Grove
Addition; thence East along the North line of said Lot
20, and projected to the East right -of -way line of
Brookfield Street; thence South along the East
right -of -way line to a point being the approximate
mid -point of Lot 21 (now noted as the North line of
Block W8- Parcel 1); thence East along an approximate
mid -point line and projecting East to the intersection
of the West right -of -way line of College Street; then
North along the West right -of -way line of College
Street to the intersection of the South right -of -way
line of Linden Street; thence East along the South
right -of -way line of Linden Street to the intersection

WHEREAS, the Development Plan includes a list of parcels of
property to be acquired; and
WHEREAS, it is necessary to modify the list of parcels of
property to be acquired by adding parcels of property to the list;
and
WHEREAS, I.C. 36 -7 -14 -17.5 provides the means for approving an
amendment to the Development Plan that involves the addition of one
or more parcels to the list of parcels to be acquired; and
WHEREAS, the Commission has complied with the notice provision
of I.C. 36- 7- 14- 17.5(a) and (e); and
WHEREAS, at the hearing held by the Commission on the 10th day
of May, 1991, at 10:00 a.m., Eastern Standard Time, at 1200
County -City Building, South Bend, Indiana, the Commission heard all
persons interested in the proceedings and received and
considered written remonstrances and objections and other such
evidence presented.

of Kuespert & Sommer's Addition (now noted as
Block W44- Parcel 7); thence Northeasterly along a
projected line and parallel with the Northwesterly
line of Kuespert & Sommer's Addition to the
intersection of the centerline of LaPorte Avenue;
thence Northwesterly along the centerline of
LaPorte Avenue to the intersection of the
projected centerline of the first 14.0 foot
East -West alley lying North of LaSalle Court;
thence East along the centerline of said alley to
the intersection of the West property line of Lot
1, part of the original Lot 1 of Chapin's
Subdivision of bank outlots 1 and 2; thence South
along the West property line of said Lot 1 to the
Northwest corner of Lot 3 of Horatio Chapin
Subdivision (now noted as Block W52- Parcel 6);
thence Southeasterly along the North property line
of Lots 3,5,7, 9 and 11 (now noted as Block
W52- Parcels 6,7,8,9 and 10) to the intersection of
the centerline of William Street; thence South
along the centerline of William Street to the
point of beginning; and
WHEREAS, the Development Plan includes a list of parcels of
property to be acquired; and
WHEREAS, it is necessary to modify the list of parcels of
property to be acquired by adding parcels of property to the list;
and
WHEREAS, I.C. 36 -7 -14 -17.5 provides the means for approving an
amendment to the Development Plan that involves the addition of one
or more parcels to the list of parcels to be acquired; and
WHEREAS, the Commission has complied with the notice provision

County -City Building, South Bend, Indiana, the Commission heard all

NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF
REDEVELOPMENT, AS FOLLOWS:
1. The Commission finds that the amendment is reasonable and
appropriate when considered in relation to the Development
Plan.
2. The Commission finds that the Development Plan, with the
proposed amendment, conforms to the comprehensive plan of the
City.
3. To accomplish redevelopment of the Area it is necessary to
acquire additional land within the Area as shown on Amendment C
of the Development Plan attached hereto and incorporated
herein.
4. It is estimated that the cost of acquisition and redevelopment
of the property being added to the acquisition list is $85,000.
5. The Development Plan is amended by Amendment C as shown by the
page attached hereto, and is hereby in all respects approved.
6. The secretary is hereby directed to file a certified copy of
said Development Plan, as amended, with the minutes of this
meeting.
7. The Secretary is directed to record this resolution pursuant to
the requirements of I.C. 36- 7- 14- 17.5(g).
8. All other findings, determinations, and conclusions in
Resolution No. 818, as amended, shall remain as stated therein.
9. The United States of America is hereby assured of full
compliance by the South Bend Redevelopment Commission with
regulations of the Department of Housing and Urban Development
effectuating Title VI of the Civil Rights Act of 1964, as
amended.
Adopted at a meeting of the South Bend Redevelopment Commission
held on May 10, 1991, at the Office of the Commission, 1200
County -City Building, 227 West Jefferson Boulevard, South Bend,
Indiana.
