Wednesday Nky 31st., 1
Board met in regular session at 7:15 P.M. All members present.
This being the date, set for deferred hearing on resolution for pipe sewer
on Kessler Blvd. and Rose Street. Attorney Gillom appeared and represented property cwners
and objected verbally to. con.necting sewer to Beale Street, Dr. Vaughan appeared for sewer,
the Board after hearing all parties interested.deferred said meeting until Wednesday June
7th., 1922 at 7:15P.M.
The matter'of petition on South Michigan Street from Donmoyer Avenue to
City Limits type of pavement was discussed, John Tasher and Farneman and other property
owners appeared and stated to the Board that all parties signinBapetition for concrete
pavement wanted same. The Board awarded the contract to H. N.. rnes as follows to
for $19,812.40
Concerning the improvement of the roadway of Michigan Street from South
line of Donmoyer Avenue to City Limits in pursuance to Resolution No. 961 the petition
of freeholders residing on said street is considered, and the report of the City Engineer
is received and all evidence is heard, and the Board finds that said petitioners constitute
a majority in number of the freeholders residing upon said street to be.improved,'that said
petition is sufficient and it is therefore considered, and adjudged that said* improvement be
made with concrete the kind of pavement requested in said petition; and Vie City Engineer
reports that H. N. Barnes is the lowest and best bidder for said kind of pavement, and the
Board so finds, and lets the contract for said improvement to him, and orders said improvement
be made with concrete and all proceedings heretofore had in this matter are hereby confirmed
and ratified. '

May 2791922.

Re: Contract of Joseph Luther for
water connections on S Main St.
Gentlemen: -
In response to your°request for an opinion upon the above mentioned contract
you are advised -that in my judgement this contract is not enforcible for the follow-
ing rei-sons: Clause 31 of Seetibn 8655 Burns Rev. St. authorizes the City Council to
enact an Ordinance " To regulate the making of private connections with sewer,''gas
water and other like pipes and public conveniences and to compel owners of property
to bring such connections inside the curbs of streets before the permanent improvement
thereof; and on default of, the owners making such connections, to authorize they proper
City.Officals to do ao at the owners expense and to make such expense a lien on the
property, colleetiable in the same manner as expenses for other street and sewer
improvements."
The City Council did on the 24th. day of July,1916 adopt Ordinance No.
1.842 fcr the purpose of exercising the power conferred by the Legislature by the above
act,' -''However, Section l of the said Ordinances No. 1842 was void for the reason that
it aEttempted to delegate the power given to the City Council to the Board of Public
Works and this Section has recently been amended to correct this defect, The result
is, that at the time the Board of Works adopted the resolution of May 1921, the Board
of Works had no power to require these connections to be made and there wasno
Ordinance which required the.same. Before the expense of making such connections
could be made a lien on -the abutting property it would have been necessatty, under the
Statute, that there be an Ordinance requiring these connections, providing for a
notice to the property owners and a reasonable period for the property owners to comply
with the requirements of the Ordinance,
Further, it will be observed that subsequent to the adoption of the
resolution for the improvement of South Main Street that the action of the Board was
rescinded, and since no steps were taken either by the City of by the Contractor toward
carrying out the contract for water connections, a fair inference is that the whole
project was abandoned by commion ccrisent and may be a further defect in the proceedings
in this; the Statute itself oontemplates the giving of some notice to property owners
to make such connections. The notice given and provided for b the Ordinance is two

Pole and wire inspector reported as follows,on light petitions: -
There is now six carolina Poplar trees on Portage Avenue five trees
south of queen Dteet One tree north of Queen Street. Cut down poplar trees and there will
be betwee light.
Light now at corner of Grace.Street and Olive Street should be reset
to the south end, or placed on the east, side of Olive Street, also the alley at the rear of
the church is a private alley, I beg to recommend that no light be placed, the church
should provde lights. Same approved.
Renewal certificate of Harvey Hager for $1,000.00 Excavation bond
approved..
The following permission was granted to the H. G. Christman Company
for to construct and maintain a single track siding across Calvert Street immediately west
and along side of alley vest of Main Street.
To the Honorable Board of Public Works,
South Bend, Indiana.
Gentlemen: -
The undersigned, H. Q. Christman Company, a corporation o:' this City, , hereby
and by these presents make application and petition to your Honorable Body for the right and
privilege to construct and.maintain a single.track sieving a cross_Calver Street
immediately west and along side of the alley west of Main Street. .
This siding is -to be constructed off of and from the main line of the P. C.
C. & St. L. Railroad, the total length of said siding to be four hundred eighty six (486) fe,
feet from its connection with the main line at switch point and three hundred fifty two
(352) feet from the point of clearance. -The siding will be constructed entirely upon
the private right of way of the P. C. C. & St. L. Railroad, except only where it crosses
Calvert Street, and it is intended for and will be used bythe H. G. Christman Company
for their use and the use df the tenants of the building now in course of construction at
hhe south --west corner of Main and Calvert Streets said building to be one hundred sixty-
five (165) feet in width and the full depth of Ue lot of one hundred. thirty -two
(132) feet,
This building is to be occupied by the Weiss-Mueelssel Company wholesale
--iiobbers of hardware specialities and toys, and this siding will serve both the Weiss-
Jjuessel Company, the tenant o terislCtoiberused byat em on�work�in�thersoutmherin Company*
for the delivery of building
of the city.
There are alread private sidinggs servingmerchants and .industries immediately
north of Calvert Street, andthealley whicFi the siding in question parallel has,been
v eated in order to more.pro erly serve said firms and individuals. In the construction
of the siding in question, it will not be necessary to vacate the alley south of Calvert
Street. However, unquestionably, this is a matter that will eventually be done, as
industries and merchants are comlAlled to go south to find locations where they can be.
served by private sidings. -
.After considerable negotiation's, the undersigned were able to induce the P. C.
C. & St. L. Railroad Company to construct this siding upon their own private ri ht of
wmy, in order to eliminate the necessity at this time for asking the vacation o� the
alley, and to that extend co-operate with your Board in only asking for the granting
of the right and privilege of constructing said siding across Calvert Street. In a short
time other merchants adn industries will purchase the property now occupied by dwelling
houses immediately south of Calvert Street, who will unquestionably then petition your
Honorable Body for the vacation of the alley so that sidings can be constructed along
side of the property to be served, in the same manner as is the pro]perty immediately north
of Calvert Street.
Attached hereto and made a part of this petition is a blue print, marked
Exhibit A, which shows the correct location of the siding shown in yellow on said
blue print and the place where it is intended to be constructed and the measurements
showing the length of construction.
The petitioner hereto also agrees upon the granting of the right herein
petitioned for, to maintain the alley in the rear of its premises in good repair and
- open to traffic. °
WHEREFORE, your petitions prays that it be granted the right and privilege
to construct and maintain said track over and across said Calvert Street at said location

At this time I wish to report our progress on same.
Items Nos. 1 and 8 are entirely completed,
Items Nos, 293, 4 and 8 ake underway. -
Items 6,79 10 912 and 15 oover pavements in alleys where no work is
required by us.
Item No. 11 -no work will be necessary by us on account of narrow
pavement _
Items 4,13,14916,17 and 18 have not yet been started.
In addition to.the items cited above we wish to advise that the work j
necessary ahead of the widening and paving of Main.Street has been completed.

I beg to advise that I submitted your estimate to our Executive Committee
and they do not feel that we ,s ould incur or assume _any portion of the exepnse' in'
repaving the street, other than the rebuilding of our tracks --and putting same in first
class condition for the repaving.
As a matter of fact, the burdens that our company, as well as the
majority of other traction lines in Indiana, have has to carry for several years past.,
have left the average company in such a position financially that, regardless of
what they would like to do in many instances, they are dorced to restrict their
expenditures to the minimum; and in many instances, have been unable to carry out
many obligations that they had assumed.
It is the policy of our company ft do everything that is required of it ,
but in our present condition we.cannot assume any burdens other than those we have
legally incurred.- C
