20' °Board met in regular session at 10:00 A.M. All members present. City Attorney L. W.I. Hammond appeared before the Board and took up matter of appeals taken by various -property owners on their assessments MR ing Avenue Pavement assessments in August 1921 and now pending in Couht for and stated.' that he would like to have property appraised to ascertain the value of the various lots before oing to tridal. The Board authorized Mr. Hammond to,obtain the services of two disinterested ps-rties to appraise lots., The- matter of vacating a five foot``strip of La Monte Terrace was discuss and the City Attorney reported that there were decisions on similiar cases other than those quoted by the Attorney for the parties who asked for part of La -Monte Terrace be vacated, which would also protect the City`s rIghtp in the matter. - A property ownere residing on Olive Strut in Vernon Heights Addition appeared before the Board and complained of the condition of Olive Huey and Elmer Streets in Vernon Heights Addition, after,a discussion with.D. C. L'ayton, Street Commissioner it was decided that petitions should be presented -for grading and: gravel- ingof these streets and same would be considered. Mr. Jacob Hoffman and Engineers of the La Salle Hotel Company appeared before the Board and requested,permission to install a transformer vault for the - La Salle Hotel in Michigan Street. Attorney Iden S. Romig appeared before the Board and presneted Plat known as Romig First Addition to South Bend . Mr. L. P. Hardy moved that Plat be approved subject to the City Planning Commission, same seconded and carried and plat was approved as follows:- P L +A T. The belov#nnaxddmap represents a plat of a tract of land in the City of South Bend, St. Joseph County, Indiana., which is to be known as Romig`s First Addition to the City of South Bend , and which tract is bounded by a line running as follows, to -wit: Beginning at the northwest intersection of Ewin Avenue and -Gertrude St., in said City, and running North on the West line of sad Gertrude St., to a point (200.8) two hundred and eight tenths feet south of the intersection of said Street with the southerly line of Prairie Avenue, thence wept from said point a distance of One Hundred Six and*Twenty--five hundreths feet 106.25) thence north -to the southerly Line of said Prairie Avenue, thence southwesterly about 92.3 ft. along the southerly line of said Prairie Avenue to the intersection of said avenue with a fourteen (14) foot alley, thence south along the easterly line of said 140foot alley to its intersection with Ewing Avenue, thence East along the southerly line of said Ewing Avenue to the lace of beginning. The sa id tract being in the east helf of the Southeast r2) arter (2� of Section Fifteen (15), Township thirty-seven (37) north, Range two East. The dimensions of, t e lots and the alleys are marked in feet upon said plat and the lots are twenty "three (23) in number being numbered from one to twenty -three inclusive: The lleys and the five-foot strip of the easterly side thereof being along the westerly side or said Gertrude Street, which said ;give foot strip has not heretofore been dedciated to the publics are hereby dedicate t the public for public highway. Mr. James luther appeared before the Board and presented petition signed by a number of property owners to have alley between St. Peter Street and Notre Dame Avenue running from Sarin Street to South Bend Avenue opened and house in said alley should be condemned and moved. Same read and placed on file to be investigated. E. A. Coates and J. G. Schaub of the Williston Construction Company a peared before the Board and presented the following written request for permission to place asphalt plant, same xas approved. March 16,1922. Gentlemen: - We are about to complete arrangements -for locating our Asphalt Plant on the pro er y of the.South'Bend Chilled Plow Company at a point in their yard about 200 ft. easi of Gran, Street and about 150 ft. south or Washington Street. Since a6 City Ordinance provides that, before locating an Asphalt Plant, at any pplace ihn the Cityy Limits it is necessary to obtain the approval of the Board of Public V�orks, we, therei'ores respectfully request $bur approval of this site for the location of our asphalt Plant. Board referred said petition to,T.,H. Beaning pole and wire inspector for investigation and. report. Mr. Fishering of Fort Wayne Indiana appeared before the Board in regard to the collection and disposal of garbage in this City and stated what his contract was with the City of Port Wayne and requested permission to make a survey of this City and submit a proposition for the Board's consideration, same was granted. Gentlemen: -- I have been asked by the Mayor to exmmnn.e,the legal notices recently published by order of your Board, a copy of which is.enclosed herewith, and to advise your Board upon the possiblity of cutting these notices down in order to save expenses of publica- tion"s. It is my opinion that more than fifty -per cent-per.this sppace can be saved with - .out affecting the validity of the notices. The following is the language of the Statute with respect to the contents of the notice: " Notice -of such resolution shall be published once each week for two weeka which notice shall call attention to the passage of preliminary resolution and shall state on a day named, not less than ten days from the date of the last publication when the Board will hear all persons inte ested or whose propertyis liable to the assessed for the proposed improvement, and will decide whether the bnefits to the property liable to be assessed for such improvement will equal the estimated costs thereof," Much -of the matter contained in the notices as printed is a repetition nd much of it is not required by law to be stated in the notice for example, nearly all ti4le notices describe in detail the character of construction of each improvement followed by the statement that details, drawings , plans, and specifications are ell filed in the office of the Board of Works. The law requires ftly that pp�roperty olvners be notified of the passage of the preliminary* resolution and of the time fixed. for the hearing and in my judgement the notice is sufficient if it idenitifies the street or alley which is to be improved and fixes the day for the hearing. I belie e the tax payers of the City can be saved thousands of dallfars in this one item of advertising expense, particularly since under the present law these notices are now required to be Oublished in two newspapers instead of one ad as formerly provided.
