Tuesdey March 7th., 1922.
Board met in regular.session at 10:00 A.M. All members present.
Pole and Wire Inspector Beaning appeared before the Board and
filed the following recommendations for lights.
I recommend an Are light on,Southwest corner of Wayne Street and
Francis Street on a 12 ft. mast arm. Same approved by the Board.,
Councilman --Hardman appeared before the -Board with a.property
owner in regard to lights anal water in Vernon Heights Addition. The Board advised
Councilman Hardman to take up water petitions with the Water Board Wednesday March 8th.
1922 and to file petitions for lights and same would be investigated.
Petition filed for gradigg and sidewalk and curb of Nest Bergan .
Street from Portage Avenue to North Olive Street si nea bJ. M. Warwick 1819 W. Bergan
Street. F. L. Lockwood Bergan Street and Albert G. ode 2601 W. Bergan Street and
letter as follows attached. Petition placed on.file and a deed for Bergen Street to
be submitted.

the City any or all streets in the proposed plat of the Jackson subdivision.

Mr. J. H. Kelsy appeared before the Board and presented petition
for pavement on Leer Street from Calvert Street to Ewing Avenue. The same placed on
filed to be held until Finacial conditions permit consideration.
Attorney Lenn J. Oare representing the H. A. good Realty Company
appeared before the Board and presented a motion to have order of the Board of-
February 28th.9 regarding the vacation of the five feet of the south side, of Laiionte
Terrace this City rescinded and cited various cases on law regarding same INTO action
taken, o m91,19n-,,_and , the..Board advised , Attorney Oare that they would have ihis ':,later
referred to the City Autorney for an opinion.
City Engineer took up the matter of selling the old blue print
machine for $25.00. Same approved by the Board.
Mr. Sotthworth.of the Chicago, South Bend & Northern Indiana
Railway Company @,ppeared before the Board in regard to permission to put in a feeder.
line out to the south part of the City, and requested to go on the Indiana ,& Michigan
Elea. Co. poles and not to set a separate line of poles. Deferred a week to work
up a new route and report Tuesday March 14th., 1922 at 10:00 A.M.

pipe sewer on Corby Street from Eddy Street to E. Line of Third. Place of Park Place
for the.amount of ; Partial enstimate approved February 28th., 1922
for 85% cancelled.
The following resolutions were adopted by the Board.
Resolved that the Board of Public Works accept the certified check Of
$300.00 offered by Hoban & Roach, in leiu of withholding an equal amouht from the final
t-stimate on cone*iU for pipe sewer on Corby Street as per order of January 25th., 1922
Said $300.00 to- _be held until Hoban & Roach have placed street in proper condition, or used
as liquidated damages, should they fail to perform this part of their contract to the
satisfaction of the Board of Public Works, otherwise the check to be returned to Hoban
Roach.
R E S 0 L U T I 0 N.
WHEREAS when a parcel of land is dedicated for a street the larger central
portion is set aside for vehicle traffic, parallel portions on each side are set &aide
for sidewalks for pedestrians, and other parallel portions are usually set aside to be
maintained for lawns or parks and to planted with grass and shade trees, and
WHEREAS it has become the custom in some instances to place the sidewalks
with the curbs immediately adjoining the portions set aside for street traffic, and to
place the porition reserved for lawn or park immediately adjoining the private property line,
and.
WHEREAScertain attorneys contend that the lawn or park so located would in
time revert to the owner of the land whose propert it adjoined aiidthe City would lose
its title to it, or could maintain its title only 4 costly litigation, and
• WHEREAS sidewalks built with curb adjoining the street are not practicable
in 45at *herever a driveway is required leading onto a private lot for �arage or other
purposes, the curb must be cut down tothe level of the street,t and the eve of the sidewalk
destroyed making the walk dangerous for pedestrians, and further when it becomes necessary
to place at guy wire to support a light, telegraph or telephone pole in the curb adjoinin the
sidewalk here exists an element of danger, and nelt,her.these elements or risk or dangeg
would exist if the -lawn or park was located between the sidewalk and the street, therefor
BE IT RESOLVED that the Engimeerin department of the City of South Bend
is'hereby instructed whenever the same comes within ifs authority and whenever it may be
feasible so to do to locate all sidewalks adjoining the private property line or parallel
w'ith said line and not over two feet.distant rpom said private property line, and to locate.
the lawn or park between the sidewalk and the street.
This being the date set for receixingg bids for the sale of garbage in the
City. Bo bids received. Harry Conly of Kalamozoo, Mich appeared before the Board and'
in regard to the disposal of arbagge-in this City. No action taken and this matter deferred.

STREET OR ALLEY IMPROVEMENT'RESOLUTION NO. 943.
Be Ir Resolved by the Board of Public Works of the City of South Bend,
St. Joseph County; State of=Indiana, that it desired and deemed necessary to,improve
Sunnyside Acenue Prom -a point 44 feet south of the south line of Washington Avenue
to the north line, of Washington Avenge, and Washington Avenue from Sunnyside
Avenue to the east line of Jacoh Street as follows, to --wit:_
Said Avenue shall be, graded and the roadway thereof shall be paved;
also the roadway of centain portions of the streets and alleys which enter or inter-
sect said avenue'thsll be graded and paved. The paving material to be used in
making said improvement: shall be sheet asphalt, bitulithic , a sphaltic:concrete,
brick -or portland.ce'ment concrete seven (1) inches thick, and the foundation shall ve"
sheet asphalt, bitulithic 'asphaltic concrete and brick or rolled gravel six ,(6)
inches thick for the brick,, also cement curb shall be constructed along said
street where same is necessary and .not already constructed; storm water inlets
and conduits shall beconstructed where necessary; all storm water inlets and manholes
shall bw set to the proper gxade;;,ceme`nt marginal curb shall be constructed at all
street and alley intersections Where necessary, all as si.more parti-cutlary
