Orie Parker appeared before the Board and filed a remonstrance as- follows: - TO THE HONORABT,E BOARD OF PUBLT C WORKS. ✓ We. the undersigned citizens, residents and property owners of the City of South Bendm Indiana, hereby protest and remonstrate to your Honorable Board and say; That we reside in the vicinity of the Franklin School Building on the comer of East Sam ple and South Clinton Streets in said City; that said City by its Board of', Public Works has heretofore and is now allowing and permitting the use of a portion of said South Clinton Street a public highway opposite the said School property as a, playground for the pupils of said school. That said street is used each school day for a period of one hour during the forenoon and for a period of about one hour at noon as a school playground, and for this purpose a strip of about two hundred feet of said street is roped off by tw ropes running across the entire traveled public highway, to the entire exclusion of all vehicles and travel for all purposes. That by reson of said closing of said street at said times all traffiQ is suspended from Bronson Street to . Sample Street on Clinton Street and all vehicles are compelled to go out of thie rway a distance of four or five ordinary city blocks. That the residents are Prevented from receiving legitimate and usual service from merchant delivers and are deprived from the use of said street, for their own approach to their houses by vehicle , *T.d aredeprived of the usual and efficent fire protection to their homes and property._ That residents immediately oppiste the school are annoyed Rnd greatly disturbed. in the peace and quiet enjoyment of their properties; all to the, great damag e. and in jur3t of the said properttes. The undersigned furtfler show that- they in a sufficient ground about the school building that belongs to the City for use as a playground. Therefore the undersigned p •-otest and-regxest the Honorable -Board to keep and maintain said street as an open public hi f-�tway throughout the entire day. Signed and dated October 25th.11915. Dr. Montgomery appeared before the Board in regard to haVing a proper drain installed on Erns3erger Street Mere said street is being improved. The Ciy 61 Engineer was instructed to take said matter up -with -County Engineer. Atty. Dinnen appeared before the Board representing the South Bend Home Telephone Company in the absence of Mr. E. C. Daicey, Mgr. of said company,. and dis- cussed the laying of underground cuntbz.it. The Board informed tepresex tatives of said company that the work would have to be done in accordance t1th the City Ordinance. Bond and contract for Bituninous and Glutrin Bound Madadam pavement on Leeper Avenue from Howard Street to Angella Avenue signed by H. N. Barnes as principal and London Lancashire Indemnity Company of America was approved by the Board. Permission granted the Central Union Telephone Company to set two 25 ✓ foot poles on west side of alley between Main and Michigan Streets no-th of Eckman Street, also to notify said company to stencil all of their poles now standing in south Bend according to City Ordinance. Petition filed for a street light at or near the alley at the beginning ✓ of the 1100 block W. Whereas, one Cyrenous Keller did purchase from the City of South Bend, Ibdia na for the consideration of $1.00 the following described property; All of lot 16 Block 5 Range I East in the City Cemetery of the City of South Bend, Indian, and, WHEREAS, said Cyrenous Keller sole owner of the above described property have; lost the deed for said of now, THEREFORE, BE: IT RESOLVED, By the Board of Public Works of the said City, that the Mayor of said City be and he is hereby instructed to issue a duplicate -deed to said Cyrenous Keller for said described property. Whereas the Grand Trunk Railway Company has been during the last three months notified on several occasions by the Board of Public Works, City of South Bend to repair and replank its roadway on Division Street from Michigan Street to end of track on Division Street. Whereas the said railway company had -agreed to replank said roadway but has used dilitary methods in having the natter postponed from time to time, and, Whereas it is the opinion of the Board that this could. be taken care of at once and, Be It Resolved that said railway company be given thirty (30) days to have said work completed and if it is not done within that time the street commissioner is hereby ordered to replank said roadway and the cost of replanking said roadway shall be charged against said company and turned over to the City Attorney for collection. Company. Whereas the Indiana & Michigan Electr is Company and the Beard of Public Works entered into an agreement on the 14ta. day of September 1915 viiereby the. Resolved, that notices as to the amounts of asse-ssments be published for six consecutive days in the South. Bend Daily Tribune, commencing on the 1st. day of November,1915 scat ng that this Board will give a hearing on the. amount of such assess- ments at its office in the City Hall on the 9tho day of November,1915 at 7:45 P.M. Resolved further, that the entire work under the above contrasts be accepted and approved and the final estimate thereon allowed. All members present. ✓ Hearing had on improvement resolution no. 412* for the pipe sewer on Pox Street from St. Joseph Street to Fellows Street, In the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no remonstrances were filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same,. as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the sane is hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the ?.nthday of October 1915 and on the 4th. day of Noveinber1915. in a newspaper of gener 1 circulat4on in said City, stating that this Board will receive bids, for the construction of said improvements up to 10:00 A.M. on the 16th. day of Novebber,1915. BE IT RESOLVED BY -THE ]BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,ST. JOSEPH COUNTY,STATE OF INDIANA, that it is desired and deemed necessary to improve the following described tract of land located at the south east cornerof west La Salle Avenue and La Porte Avenue. Beginning at a point on the northerly side of the Chicago , Lake Shore and South Bend Railway Co.- track , where a line 10 feet distant from the north rail of said Chicago, Lake Shore and South Bend Ry. Co. track intersects the easterly curb line of La Porte Avenue; thence northwesterly along said curb line and said curb line produced to a point in line with the south curb line of La Salle Avenue produced west; thence east to a point where a line 14-1/2 feet. distant from the northerly rail of said Chicago, Lake Shore & South Bend Ry. Co. track intersects the present south curb line of La Salle Avenue; thence south westerly parallel to end 14-1/2 feet dis- tant from said north rail to a point seven feet north of the south line_ of Nass le Avenue; thence south to a point 10 feet distant from the north rail of the Chicago, Lkke Shore & South Bend Ry. Ci. track; thence southwesterly parallel to and 10 feet distant from said north rail to the easterly curb line of La Porte Avenue which point is the place of beginning. To be improved by grading and paving the above described tract 'witr asphalt, Bitulithic, Creosoted Wooden Blocks or Brick laid on a five (5) inch Portland cement concrete foundation. Constructing curb and cement walk, and the construction of the necessary storm water inlets and conduits, setting a:1.1 manholes covers and inlets to the proper grade -and congyucti g the necessary marginal cement curb. All as shown on the plans and in accordance- with the, prdtiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for, except streetand alley intersections shall be paid by special assessment to be levied upon the property specially ben.efitted, to the amount that the same maybe legally assessed therefor, in accordance with An Act of the General Assembly of the State of Indiana, entitle d M An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and pursuant to the provi-signs of all acts amendatory and supplemental thereto. The cost of all street and alley intersections, including one- half of the width of the improvement opposite street and alleys which run into, but do not cross said roadway herein proposed to be improved and that portion of such street or alley abutting upon property belonging to said City, or upon property not subject to such assessment, shall be paid by the City in cash out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the prov- isions of Section 109 of the above entitled Act. Assessments of ten dolloars and more against each lot, if deferred are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the cotractor to bhe amount of such deferred assessments in .pro rata payment for such improvement. Under no etrcumstances shall the City of South Bend be.' or be held responsible for any sum or sums due from said property owner or owners for said work,or for the collection of the: same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have actually been received by the City From the assessments for such improve- ment, or such moneys as said City is by said entitled Act and-amendments,and supple- ments thereto required to pay. All proceedings had, and work done in the making of said imp=ovement, assessment of property, collection of assessments and issuance of bonds therefor, shall be s_s provided - for in said above entitled Act,' and Acts amendatory thereof and supplemental thereto . BE IT FURTHER RESOLVED, That the Board -of Public Works fix the 23rd.. day of November 1915 at the hour of 7:45 P.D[* at the office of the Board of Public Works, of this City, as the time and place for the public consideration of said pro- posed improvement, at which said Board of Public 'Works will hear all persons interested or whose property is liable to be assessed for said improvement, and will decide whether tAe benefit to the property liable to be assessed for said improvement will equal the estimated cost thereof. In regard to the awarding of contract for macadam pavement on Bartlett Street from St. Joseph St. to Riverside Drive, the same was deferred. until Tuesday IJpyPmber 2nd. 1915. at 7:45 P.M. Mr. Guy Staples that waiver signed by property owners would be presented by this time. Mr. Campbell Supt. of the J. H. Cahill Co. contractor on Michigan St. Trunk sewer, appeared before the Board and :took -L)-p the matter of payment for extensions on extra water connections put in. The Board took this matter under advisement until Tuesday November 2nd.1915. at 10:00 A.M. City engineer submited est(mated cost of pavement improvement on a tract of land located at the southeast corner of La Salle Avenue and La Porte Avenue at ....66.451.00 . The Board ordered the Central Union Telephone Company notified to reset at once their guy wire in the rear of 1019 W. Thomas Street to the east as the same as it now stands is in the way df property owners garage. The matter of complaint of Xnepper Bros. filling up Bowman Greek at the rear of 215- B. Fvx Street, the same was referred to the City Attorney. President.
