In regard to the awarding of -the contract for grade, curb walk and macadam pavement
on Leeper Avenue -between Howard Street and Angella Avenue, the 'following resolution
was adopted.
Concerning the improvement of the roadway of Leeper Avenue from Howard
Street to ,North Line of Angella Avenue in pursuance to Resolution No. 405 ,the Board
finds that a petition has been filed with said Board by a majority in number of the
freeholders residing; on said Street to be improved .requesting that it be improved with
a different kind of pavement or binder than the kind heretofore adopted by the Board
in its preliminary order; and the City Engineer reports that Harry N. Barnes is the
lowest and best bidder for the kind of pavement heretofore adopted by the Board, and
the Board find that said Harry N Barnes is the lowest and best bidder and hereby lets'
the contract for said improvement to him, and orders that said improvement be made
with Bituminous Filled & Glutrin Bound. lst. 1000 ft. of Howard Street Bituminous
filled balance Glutrin bound, and all proceedings heretofore had in this matter are
hereby confirmed and ratified.

At the Boardvs request Mr. Atkins representing the South Bend Home
Telephone Company was present, and was notified to stop all the above mentioned com-
pa,nies, underground work as same was not in accordance with Underground Ordinances.
Mr. Atkins was requested to report upon the above at meeting Tuesday Ocotber 26th.

Engineer filed assessment roll and final estimate for euv-fi and walk
on Dubai 1 Avenue from W. line of High Street to West line ofDale Avenue, under
Improvement Resolution No. 395. In the City of South Bend, Indiana.
Resolved, that notices as to the amounts of assessments be published
for six consecutive days in -he South Bend Daily Tribune, commencing on the 25th .
day of October,1915 stating that this Board will give a hearing on the amount of such
assessments at its office in the City Hall on the 9th. day of November,1915 at 7:45 P.
Resolved further, that the entire work under the above contract be
accepted and approved and the final estimate thereon allowed. Notice of this resolutia
shall be published on the 25th. day of October,1915 in the South Bend Daily Tribune,
stating that this Board will, give a hearing on the acceptance of such work at its
office in the City Hall on the 9th. day of November,1915. at 7:45 P.M.
The City Engineer submitted the list of property owners in the
matter of the appropriation of certain property under condemnation Resolution No.
41 as per resolution on Page No. 756.,%hich list includes the names of the'owners and
holders of property and of interests therein sought to be taken or beneficially or
injuriously effected, and the description of the several piepes of property which
is affected by the said appropriation proceedings.
Thereupon the Board proceeded to award the damages sustained
and to assess the benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and un—
animously adopted, resolved that said list, together with the amounts of benefits and
damages and net benefits and net damages therein set forth as to the several parcels of
land be adopted and that the respective amount of benefits contained in said list be
and are hereby assessed agains•kthe , several tracts of land as specifically set forth in
said list,_and that the respective amounts of damages contained in the said list be and
are hereby awarded to the several tracts of land as speficially set forth in said list,
and that the net benefits or het damages, as the case may be as to the respective tract
of,land, contained in said list are hereby awarded br assessed, as the case may be
as to the said several tracts of land.

The Board hereby further sets off the benefits and damages each aD.inst the
other vrhere both benefits and damages are assessed against the same piece of property,
tract 6f lard or interest., and hereby fixes said respective net benefits as the amount that
shall be paid by the ressective owners as benefits, and further hereby fixes the respective
net damages as to the several tracts as the amount that shall be , paid to -the owners of the
respective tracts as damages.
Thereupon, upon motion duly made and seconded and unaously adopted the
16th. day of November,1915: was fixed as the day on which this'Board will receive or hear '
remonstrances from persons with regard to the amount of their respective awards or assess—
ments, and the Clerk of this Board was intructed to prepare and cause to be duly and legally
given, notices to the owners of each parcel of property, shoring the amount of the assessmey3t
or award, with a description of the property affected, and the date of said hearing.
The. City Engineer submitted the list of property owners in the matter of

page 732 of this record, which list includes the names of the owners and holders of property
of interests therein sought to be taken or benefically or injuriously effected, and the
description of the several pieces of property which is affected by the said appropriation

adopted, resolved that said list together with amounts ofbenefits and damages and net
benefits and net damages therein set forth as to the several parcels of land be adopted
and that the respective amount of benefits contained in said list be and are hereby assessed
against the several tracts of land as specifically set forth in said list, and that the
respective amounts of damages contained in the said list be and are hereby awarded to the
several tracts of lands as specifically -set forth in said list, and that the net benefits
or net damages, as the.pase may be as to the respective tracts of -land, contained in said
list are hereby awarded or assessed, as the case may be as to the said several tracts of land.
The Board hereby further sets off the benefits and damages each against

tract of land or in terest, and hereby fixes said respective net benefits as the amount that
shall be paid by the respective owners as benefits, and further hereby fixes the respective
net damages as to the several tracts as the amount that. shall be paid to the owners of the
