10/05/1915 Board of Public Works Minutes
77 4 Board met in regular session at 10:00 A.M. All members present. Atty. Martin appeared before the Board representing Mrs. Emma W. Harlin, and objected to water and. gas connections vihich had been ordered placed on Lot 23 Keasey Street. The Board informed Mr. Martin that these connections had to be made previous to a pavement being laid. The Board approved of the following resolution. R E S 0 L U T I0 1 Resolved by the Board of Public Works of this City, that the Birdsell Mfg. ✓ gompany be ordered to disconnect their sewer connection with the Columbia Street sewer at the south end of Columbia Street, and suggest that they connect with the Fellows Street sewer which is larger to take care of the sewerage. The.Clerk was instructed to notify Birdsell Mfg. Co. by letter. Mr. tit• Sommerer appeared before the Board and requested permission to out into Cedar Street Pavement to connect sewer and Water , which were -not put in preivous to pavement vbicn was ordered in in 1914. The -Board instructed the Engineer to grant permit, with understanding that Mr. Sommerer was to pay for repaving. The Board instructed the Clerk to notify Chas. Jordon Company c ntractors on the .Crockett Bldg. on Lafayette street to clean up building material viz lch has been ✓ obstructing the street immediately. Also to notify Jos. A. Weraal nski, owner_ of apart— ment building on South Scott Street to clean up building material obstructing said street. The time for obstructing the above streets for building ppurposes has expired Complaint having been received by the Board in regard to lights not being utrned on earlier, the Clerk was instructed to notify said Indiana & Michigan Bl.ectria Company to turn same on earlier. Permission granted the Central Union Telephone Company to open alley North of Washington Street from the alley intersection west of Main Street and Forth df Washington Street to the rear of the Crockett Bldg., a distance of about 100 Peet The trench to be opened will be 200 wide and about 40" deep. This work is necessary In order to burnish Telephone -service for the Crockett Bldg., Petition fl led for a pavement on Liston Street from Birdsell Street to Adams Street. Same referred to the City Engineer for investigation. Gopy of communication sent to the Grand Trunk Western Ry. Company by the City Atotnrye Eli F. Seebirt, was filed with the Board. The following report was received from the City Engineer. To the Hon. Board of Public Works, of the City of South Bend, Indiana, Gentlemen: I have made an investigation of the Columba Street sewer as regjested ,,//by your Board. This sewer from the alley south of South Street to the south end of Columbia Street is only an eight (S) inch sewer and was constructed in 1894 and assessed against the abutting property. Birdsellts dod not pay any part of the cost. The sheds in Birdsellts lumber yard are all connected with down spouts and these in turn I believe are connected with the Columbia Street -sewer. I hap a talk with Mr. Byron Birdsell in regard to this matter and he stated that nearly all of these down spiuts and sewers were clogged at the present time and that the roof water runs over the ground surface and out to Fellows Street. Engineer filed assessment roll and final estimate for Pavement on Vassar ✓ Avenue from Portage Avenue to Riverside Drive, under Improvement Resolution No. 370. In the City of South Bend., Indiana. Resolved, that notices as to the amounts of assessments be published for six,. consecutive days in the South Bend Daily Tribune, commencing on the llth. day of October,1915 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 26t. day of 0ctober,1915. at 7:45 P.M. Resolved further, that the entire work under the above contract be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be pub— lished on the llth. day of October in the South Bend Dail.* Tribune, stating that this Board will skive a hearing on the acepptance of such m rk at its office in the City Hall on the 26th. day of 0ctober,1915. at 7:45 P.M. Engineer filed assessment roll and final estimate for Asphaltic Concrete pa vement on North Michigan Street from Foote Stret to south end of the Michigan Street bridge also intersection at noftbhend of Michigan Street bridge, under Improvement Resolution No. 350. In the City of South Bend, Indiana. Resolved, that notices as to the amounts of assessments were sent to the property owners by card as per agreement signed by property owners waiving all notice of assessments by publication, stating that said Board will give a hearing -on the amount of such assessments at its office in the City Hall on the 12th. day of October,1915. at 7:45 P.M. President. 780 Board met in regular session at 7:45 P.M. All members present. Hearing on on Condemnation Resolution No. 41 for the -appacptiating a strip ✓ of land for the widening of Ewing Avenue from Michigan Street to Fellows Street, In the City of South Bend, Indiana. In the above matter a remonstrator appeared but no written re onstrances were filed. The Board being ful;y adivsed in the matter takes final aetio n on said resolution, confirming without modification, all former action taken on the same. The Board therefore declares the above property in all things condemned and appropriated for public use, the Board now orders that alist or roll be prepared if all the owners or holders of property and of valuable interests therein sought to be taken or to be injuriously affected, which .said list or roll shall also describe the property beneficially affected. Hearing had on assessment roll and final estimate for water connections on ✓ Franklin Street front Semple 'Street =�: to Indiana Avenue, under Improvement Resolution No. 352. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrance was filed. The Board therefore find that the property assessed in said roll Piled Sept. 7th.. 1915 is benefited in the amount of assessments as shown on said roll, and the Board further find that the assessment roll `filed September 7th.91915 and the final a sti- mate allowed September 7th.91915 should be and the same are hereby in all things ratified, confirmed and approved Hearing had on ipe sewer on Jagi.ith Court from Paririe Avenue to a point ✓ 70 feet east of East lin of Chapin Street, under Improvement Resolution No. 394. In the City of South Bend., Indiana.. ' - In' the above matter remonstrators appeared and remonstranced against assess— ments, but no written remonstrance was filed. The Board thereffte find that the property assessed in said rolls filed September 7th.21915.is benefited in the amount of assessments as shown on said Yells, and the Board iurthe.r find that the assessment roll filed September 7th.91915 and the final estimate allowed September 7th.,1915. should be and the same are hereby innall thugs ratified, ce nfirmed and approved. Mr, Campbell representing the J. H. Cahill Co. Contractors on Mdbchigan Street Trunk sewer, appeared before the Board and requested that they be granted an extension, on their contract of three weeks. The Board took said matter under advisement until Wednesday October 6tri . ,191.5. at 10:00 A.M. -Communication received from Board or Public Safety in regard to con.- '� dition of water at No. S Hose House. The same was referred to the Water Dept., Engineer filed assessment roll and final estimate for pipe sewer on St. Peter and Sorin Street from South Bend Avenue and St. Louis Street Blvd. to Eqidy Street, under Im provement Resolution No. 390. In the City of South Bend, Indiana Res&lvcd, that notices as to the amounts of assessments be published on the Sth. day of October,1915 add on the 15th. day of October,1915 in the South Bend Daily Tribune, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 26th. day of October,1915 at 7:45 P.M. Resolved further, that the entire work under the above contracts be ac— cep,eA and approved and the fi.ial 'estimate thereon allowed. Notice of this resolu— tion shall be published on the 8th-i day of October91915. and on the 15h. day of October,1915, in the South Bend Daily Tribune, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 26th, day of October,1915. at 7:45 P.M. 1 Application from the Kale & Bryan Company to rebuild and add too a billboard on E. Jefferson St. near Vistula Avenue was approved by the Board. The Indiana & Michigan Elea. Company reported the following lamps placed. A 6© C.P. light, at the cornerof Kirby and Paris Sts. Septa 24-.1915. ✓ Lam Ho. 934. An 80 C.P.. light at the corner of Hildreth and Clover Sts. Sept, 29,1915. Lamp No. 935. The Board ordered that the Indiana & Michigan Elea. Co. be notified to remove pole to the south about ten feet at the rear of 941 Park Avenue, as same is in the way of a garage that property owner is building. The Board notified th e. Postal —Telegraph Cable Co. to remove at once dead poles add wires on the west side of South Lafayette Street . south from the Lake ✓ Shore & Aichtgan Southern icy. also to replace one pole just south of StudebakerTs second bridge as it is dangerous, !resident.
