HomeMy WebLinkAbout09/28/1915 Board of Public Works Minutes770 Tuesday September 28th.01915. Board met in regular session at 10:00 A.N. Kr A. H. Rice absent. W. W. Sibley, Chris. Aichele and Fred P. Fatter appeared before the Board and remonstrated against Staples and Ackerman putting in water connections on Indiana Avenue from Miami Street to Franklin Street, as same was.not in compliance with plumbing rules. The Board instructed the City Engineer to notify Staples & Ackerman to stop work on same until this matter was fixed up. Mrs.Ella Brown appeared before the Board and requested that a water tap ebe eliminated from part of her lot No. 63 on Indiana.Avenue. The Board notified Mrs. Brown it agreeablewith contractor v&o had contract for putting water taps in on Indiana Avenue, that they would cancel tap from part of Lot 63 , The Board ordered that the matter of the grand Trunk Western Ry. Co. planking between their tracks on Di%4 sion Street this City be referred to the legal ✓ department for enforcement. Attorney Oare appeared before the Board in regard to petition filed August 31st.11915. for petition for the Vandalia Railroad Company to lay a sidetrack his a alley'between Main and Lafayette Streets and Sample and Garst Streets same to be, a continuation of the track now accommodating the Campbell Folding Paper Box Company. The Board took said matter under advisement for one week. Communication received from Lucius B. Andrus of the Indiana & Michigan Elea. Company stating that an 80 C.P. street light was placed in service at the corner of Walsh and Madison Street on Sept, 13,1915 Lamp No. 931. Excavation bond for the sum of One Thousand ($1,000.00)Dollars_. signed by Thilman Brothers was approved by the Board. September 29#1915. To the Hon. Board of Public Works of the City of South Bend, Indiana. Gentlemen:- I herewith presented partial estimate No. 1. for the ; Uich igan Street Trunk sewer improvement from La Salle Avenue to Monroe Street in accordance with the terms of the contract between the City and J. H. Chaill, Contractor. Completed work. 1010. Frederick J. Anderson City Engineer. The above estimate - was allowed. In regard toncomplaint about poles being outside of new curb on east sid side of N. Hill Street between Corby and Howard Street, the Board ordered that the Home Telephone Company be notified to replace said poles inside of the curb. 771 The Board ordered that the following letter be.sent to the Postal Telegraph and Cable Company . Dear Sir :- Replying to your letter of Sept. 27th. , 1915 will say that the Board of Public Worms will grant you: permission to go aerial on the small stretch on Michigan Avenue between Wilber and Olive Streets as you suggest in your letter, provided however, that you go jointly with the Traction Company. The Traction Conpany insist that their poles are in good shape and that they are no covered by this Ordinance and this is the opinion of the Board. IY, this work is not started within the next fifteen (15) days, our legal department till be notified to bring prosecution against your ODapany as provided by the Underground Ordinance. Hearing had on Improvement Resolution No. 407 for Pavement on Keasey Street from .,"Michigan Street to Carrell Street, In the City of South Bend, Indiana. Upon said hearing aemonstrators appeared but no written remonstrance was filed. And the Board being fully advised in the premises, decides that the benefits toproperty liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupin takes final action on said resolu- tion as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Re }� olved further that notices be.publiehed on the lst. day of March,1916 and on the�$th. day of March,1916. in a newspaper of general ciroulatiob in said City, stating that this Board will receive bids for the construction of said improveme-Its up to 10:00 A:M on the 28th. day of Yarch,1916• The Board reserves the right to reject any and all bids. Upon said hearing no remonstrators appeared and no remonstrances were filed. And the Board being fully advised in the premises, decides that the benefits to pro- perty liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution, as originally adopted, and the sane is hereby in all things rati- fied confirmed and approved. Resolved further, that. notices be published on the 30th. day of September 1915 and on the 7th. day of Oetober,1915 in a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improve- ment up to 10: 00 A.M. on the 19th. day of O ctobe r,1915. The Board reserves th r right reelect any and all bids. Hearing given on Condemnation Resolution No. 40 for the appeopriation of ✓ a strip of land for the Opening of Carroll Street from Lake...Shore a --id Michigan Southern By. right of way to Tutt Street, In the City of South Bead, Indiana. In the above matter the following property owners appeared and remon- strated against said opening, Atty. Baker for the Birdsell Mfg, Co. Atty. Dinnen, Supt. Stith and Agt. Potter for the New York Central Ry. Company, Fabric Roll Pro- tector Company etc., and a written remonstrance was filed with the Board. The Board after having said matter under advisement decided to rescind the above mentioned resolution for said opening of Carroll Street. Mr. Brown appeared before the Board in regard to fence in alle)r between Lafayette Street and Park Avenue, and the City Civil Engineer made the fb llowing report to the Board. To the Henora{le Board of Public 'Works City Gentlemen: - I have investigated Mr. Brown's complaint in regard to Mrs. Sibley+s. Bond and contract for pipe sewer on Golden Avenue from portage Avenue to Woodward Avenue signed by Hoban and Roach as priniapal and London Lancashire Gu rantee & ,Accident Company as sureties, 'vas approved by the Board. Bond and Contract for pipe sewer on Calvert Street from Mia mi Street to High Street, under Improvement. Resolution No. 403* signed by Sta Iles and Ackerman as priniepal ✓ and American Surety Company of New Yok as sureties was approved by the Board. Contrae t for water connection on Indiana Avenue from Franklin Stree to to Miami_' Street, under -Improvement Resolution No. 4061, signed by Staples and Ackerman was appr�'ved by the Board. SEWR IMPROVEMENT RESOLUTION NO.412. Resolved, by the Board of public Works ofAthe City'of South Bend, County Of St. Joseph, State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from eollateral drains, be and the same is ,. hereby ordered in and along Fox Street from St. Joseph Street to Fellows Street as follows, to —wit: — Beginning at the manhoike at the intersection of the north line of Fox Street and center of St. Joseph Street; thence south easterly to the intersection of the east line of St. Joseph Street and center line of Fox Street with a 12 inch vitrified pipe sewer; thence east along the center line of Pox Street to a point about 22 feet west of the west line of Fellows Street with a 12 inch vitrified pipe sewer. Together with the necessary Manholes, inlets, conduits, flush tank and house connections to the curb line along the line of said improvement. Alia s shown on the plans and in accordance with the profiles detail drawings and specifications on file in the office of the Department of public Works of the City of South Bend, Indiana, and said sewer, with all its appurtenances shall be constructed in accordance with the profile and specifications now o_i Pile in the office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders vftose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled *An Act Concerning Municipal Corporation," approved March 6,1905 Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bonds or bonds shall be issued to the contractor in payment for such work, unless the property awt ers pay said assessments before said bond or bonds are issued. Under no circumstances shal. the City of South Bend be or be held responsible for any sum -or sums due from said property owner or owners for said work, or for the collection of same, or for the payment of arW bond or bonds, certificate of certificates i sued to said c ntrartor in payment for such work, except for such moneys as shall have been actually received by.rthe City from the assessments For such Improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Aot. Yotice of this resolution shall be published on the 1st. day of October 1915 and on the Sth. day of 0ctober,1915. in the South Bend Daily Tribune, This Board will give h hearing on this resolution at -its office in the City Hall on the 26h day of October 1915 at 7: 45 P.M* BOARD OF PUBLIC WORKS Adopted this 20th. day of September,1915. 774 Tuesday September 29th.,1915. Continued. The City Engineer submitted the list of property owners in the matter of the appropriation of certain property under Condemnation Resol'ition No. 38 for the Widening of Eddy Street and Mishawaka Avenue from Jefferson Blvd. to East line of Pottowatomie Parkas per resolution on Page 696 of this record. Which list includes the names of the o!-,mers and holders of property and of interests therein sought to be taken or bene- fically or injuriously effected, and the description of the several pieces of property which is affected by the said appropriation proceedings. Thereupon the Board proceeded to award the damages sustained and to assess the benefits accruing to each piece of property upon said list. It was thereupon, upon motion duly made and seconded and unanimously adopted, resolved that said list, together with the amounts of benefits and damages and net bene- ftts :;and net damages therein set forth as to the several Parcels of land be adopted end that the respective amount of benefits contained in said list be and,are hereby ass- essed against the several tracts df land as specifical y set forth in said list, and that the respective amounts of damages contained in the said list be and are hereby awarded to the several tracts of land as specifically set forth in said list, and that the net benefits or net damages, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or assessed,, as the case may be as to the said several tracts of land. The Board hereby further sets off the benefits and damages eabh against the other where both benefits and damages are assessed against the Aare p; Ace of property, tract of land or interest, and hereby fixes said respective net benefits as the amount that shall be paid by the respective owners as benefits, and further hereby fixes:the respective net damages as to the several tracts as the amount that shall be paid to the owners of the respective tracts as damages. Thereupon, upon motion duly made and seconded and unanimously adapted, the . Twenty-third day of November,1915 at 7:45 P.M. was fixed as the day on which this Board will receive or hear remonstrances from persons with regard to the amount of their respective awards or assessments, and the Clerk of this Board was instructed to prepare and cause to be duly and legally given, notices toithe owners or each parcel or property, showing the amount of the assessments or award, with a description of the property affected, and the date df said hearing.
